Update: Counterattack bombshell 7-2 Supreme Court immigration victory:
The Supreme Court ruled Thursday for the Trump administration in a key immigration case, determining that a federal law limiting an asylum applicant’s ability to appeal a determination that he lacked a credible fear of persecution from his home country does not violate the Constitution.
The ruling means the administration can deport some people seeking asylum without allowing them to make their case to a federal judge. The 7-2 ruling applies to those who fail their initial asylum screenings, making them eligible for quick deportation. [spin]
Alito’s opinion also shot down the argument that the IIRIRA violated the Fifth Amendment’s Due Process Clause, citing an 1892 decision that ruled that for “foreigners who have never been naturalized, nor acquired any domicil or residence within the United States, nor even been admitted into the country pursuant to law,” decisions of administrative or executive officers exercising powers granted by Congress amount to due process. The Trump administration is seeking to expand authority so that people detained anywhere in the U.S. and up to two years after they got here could be quickly deported. On Tuesday, a federal appeals court threw out a trial judge’s ruling that had blocked the expanded policy.

President Trump is also moving ahead with deporting illegal aliens. In this President Trump won a big victory in court:
The new D.C. Circuit ruling found a lower court judge erred last September when she barred the expansion of “expedited removal,” which had previously been used for immigrants taken into custody within 100 miles of the Mexican border and only when agents contend the immigrants have been in the U.S. for less than 2 weeks.
The plan the appeals court greenlighted Monday would allow authorities to use the sped-up process with alleged illegal immigrants picked up anywhere in the country who appear to have been in the U.S. for less than two years. The process typically bypasses immigration judges and provides for no review of their decisions in the cases where they are brought in.
Legal immigration is also coming under control:
President Trump on Monday signed an executive order to suspend the issuance of certain temporary worker visas through the end of 2020, cracking down further on immigration after signing a more narrow measure in April.
The order applies to H-1B visas, H-2B visas, H-4 visas, L-1 visas and certain J-1 visas. It is the latest effort by the Trump administration to satisfy immigration hawks and groups that argue American workers should be prioritized, especially amid the economic downturn caused by the coronavirus pandemic.
The great pushback is aided by the appointments to the federal courts President Trump has made. One big pushback is the Circuit Court’s schlonging of Judge Sullivan in the case of General Michael Flynn:

The legal geniuses at Red State are worried that this may not be the end of the General Flynn unjust prosecution. They speculate that the circuit may not accept the decision of the three judge panel, but may instead elect to hear the case in banc, meaning before the entire panel, which consists of 9 left wing hacks and four traditionalist jurists. The question is not a legal question at all. It is a political one. I’m sure others have pointed this out, but this seems to open up a pretty devastating line of attack on Biden. How can you be President of the United States if you are too afraid to leave the basement of your house? How can you be President of the United States if you are too frail to risk exposure to a virus with a 99.8% cure rate?
Trump’s best answer to the debate dodge is that he’s going to be showing up for the debates, and if Biden is too much of a coward to show up, he’ll just treat the debates as a Town Hall and answer every question himself. He certainly has the ability to do so.

1. The police need to have cameramen, helicopters with cameras, and body cameras on the officers to catch EVERY SINGLE ACT OF VIOLENCE COMMITTED BY THESE ANIMALS. This occurred to me as I watched those jackals with their cell phone cameras, which will be used to drive CNN headlines about white supremacy, and police brutality. Massive prosecutions must follow.
2. One further point. Experience suggests that none of this will will stop as long as the elites can launch these mortar attacks on this country, and benefit from them. If we want it to stop then it is axiomatic that the elites must be made to feel the same pain as the rest of us.
If we are going to defund the police for distressed communities, then equity, which delights to do justice and that not by halves, must outlaw the use of security forces and walls which the elites use to protect themselves and their families from the forces they have unleashed and applaud. I guarndamnedtee you if that were to happen they would howl like the stuck pigs they truly are.
The irony here is problematic. If we increase the powers of the state to deal with these BLM and ANTIFA pigs then those same powers will be used by democrats to destroy the personal liberty of the rest of us when those who learn nothing from history return them to power. That is the trap, and it suggests the wisdom of the old adage, never wish for anything too much because you may have the misfortune of getting what you wished for. And that is the bait the left wants us to take, which is why the reasoned approach of Bill Barr is the right one, if we can EVER AGAIN trust the FBI.
With respect to the FBI, it has been true throughout history when the federal authority loses its legitimacy in the eyes of the population, they treat that authority as the enemy. This was true in Sicily and it gave rise to the Black Hand, the Camora and the Mafia. It was also true in Missouri and throughout the south after the American civil war, where the local population protected those who committed criminal acts because they hated the federal government and saw these people as heroes fighting against an oppressive external power. I have seen those statements at cemetaries in East Texas dating back to the Civil War. The title of Sidney Powell’s book about the justice department under Obama says it all: “Conviction Machine”. Their withholding of exculpatory evidence , and their use of perjury traps tells you to never ever trust them. I hope to God that revelation is not lost on the country, but given the level of sophistication I see in the younger generation brainwashed by corrupt professors I fear it will be.

Tucker Carlson took to the airwaves last night and delivered a message some don’t want to fathom. Namely, that Trump could actually lose the 2020 election. Later, he would make his case by laying out the current chaos engulfing the nation, the shifting public sentiment against the President, and by playing audio of a woman having her car attacked by rioters. She was told by the 911 dispatcher to “call city all” and that she was in the middle of a “sanctioned event.” Eventually, the mayor of her city would apologize, not to the terrorized woman, but to the rioters.
It was a powerful reminder that people are being abandoned across the country, whether it’s business owners in the “CHOP” or residents in Democrat cities in red states. Governments are failing their people out of a fear of retribution, or in some cases, direct support of anarchy. But perhaps more troubling, and something Carlson brought up, is that so many voters seem to agree with or sympathize with the chaos.
Here’s Carlson last night.
As Carlson points out, the affirmative case for Trump has always been to avoid the moment we are in right now. Trump ran as the law and order candidate and has continually promised to stop anarchy in its tracks. Like the “security moms” of the Bush era, many voters put Trump in office, not because they are enamored with his personality, but because they saw him as strong. He’s not currently living up to that image. To many on the right, that’s not a bad thing. They want to see people in these Democrat run cities reap the consequences of their voting patterns, with the assumption that they won’t like it and will turn back.
But what if there is no backlash coming? Carlson points that possibility out by noting that GOP leaders in Congress, in all their fecklessness, have said little about the current chaos except that it’ll blow back on Democrats. Everyone keeps thinking we’ll reach the end of the track on crazy train, but the truth is, the train never gets there. People just end up giving ground and becoming more and more conditioned to the current reality. The only real way to not let this become the new normal is to stop it.
This is about the point where people will say “but he’s running against a potato, how can Trump look weak.” Here’s the problem. The worst thing that can happen to any candidate, incumbent or otherwise, is to have the election become a referendum on them. When people are focused on only one side’s flaws, the person on that side typically loses. 2016 was a referendum on Hillary Clinton’s corruption and career failures. Right now, 2020 is looking directly at Trump while Biden happily and smartly hides in his basement.
That means Trump has to retake the initiative. The case for Trump was never to sit back and watch the country devolve into chaos. Marco Rubio or Ted Cruz could have done that with a lot less consternation about their tweeting. Trump was not elected for his awesome personality or ability to bring the country together. People know that, and I don’t think anyone is pretending that’s who he is. He was elected precisely to avoid moments like we are currently in. It’s not a coincidence that his failure to take action over the last month has led to his worst approval ratings in recent memory. Meanwhile, Trump was tweeting about Carly Fiorina yesterday, someone most swing voters don’t even know exists.
Many will scoff at Carlson’s warning, but they ignore him at their own peril. Even assuming every single poll is fake, including Trump’s internal polls which also show him losing, wouldn’t you rather be safe than sorry? Every Trump supporter should be treating this election like he actually is down 10 points (which is his current RCP average deficit). Over-confidence and assumptions about the economy rebounding or a “silent majority” are how you wake up with Joe Biden as President-elect in November. That’s a reality the country can’t afford.

Trump’s Swoon Is Real; But Don’t Count Him Out Just Yet

On Thursday night, Tucker Carlson devoted his opening monologue to President Trump’s dwindling chances of victory. My colleague, Bonchie, covered Carlson’s warning here.
CNN was quick on Friday to give Joe Biden all of the electoral votes (more than 400) that Fox News’ latest poll indicates he would win if the election were held today. (It’s worth noting that Fox News polls are conducted by Siena College for the New York Times.) The Fox results, unfortunately, were not that far off from the rest of the major polls. The Real Clear Politics average of the national polls shows Biden a solid ten points ahead of Trump and polls for the battleground ground states show Biden with steep leads.
Wall Street Journal columnist Peggy Noonan’s assessment of President Trump’s chances for reelection were even more dismal. Her position is summed up by her title, “The Week it Went South for Trump.” Her lede says,”He hasn’t been equal to the crises. He never makes anything better. And everyone kind of knows.” Noonan’s dislike of the President is well-known, but she still makes some valid points.
On Friday morning, The Wall Street Journal’s editorial board joined the growing chorus of those predicting his electoral doom. They write that Sleepy Joe may soon have a new nickname – President-elect! %$*&!
The op-ed makes the point that he has no clear message for his second term “beyond four more years of himself.” (Biden has no clear message for his candidacy except ‘I can beat Trump.’)
The editors write that Trump was doing well with his daily coronavirus briefings until he turned them into “brawls with the bear-baiting press.” When he does talk about the pandemic, “his default is defensive self-congratulation.” I have to say this is true. He frequently takes credit for saving millions of lives.
Trump’s approval numbers have been slowly falling and they’re currently closing in on 40%, a level that spelled doom for Presidents George H.W. Bush and Jimmy Carter.
The editors mention a recent tweet in which he said a 75-year old man who was pushed by police in Buffalo might be an antifa activist. He offered no evidence.
Since racial division is front and center at the moment, the editors would like to see Trump address it:
Americans don’t like racial enmity and they want their President to reduce it. Mr. Trump has preached racial harmony on occasion, but he gives it all back with riffs that misjudge the national moment. His “law and order” message might resonate if disorder and rioting continue through the summer, but only if Mr. Trump is also talking about racial reconciliation and opportunity for all.
They note that swing voters have fallen away in the last two months.
This includes suburban women, independents, and seniors who took a risk on him in 2016 as an outsider who would shake things up. Now millions of Americans are close to deciding that four more years are more risk than they can stand…
His recent events in Tulsa and Arizona were dominated by personal grievances. He resorted to his familiar themes from 2016 like reducing immigration and denouncing the press, but he offered nothing for those who aren’t already persuaded.
On Thursday, Biden made his first public appearance in nearly three months. He told his audience that over 120 million Americans had died of the coronavirus which he later corrected. But he left the podium without taking a single question. He’s not weighing in on the issues of the day as most presidential candidates do. Nor does he have a message beyond “he’s not Donald Trump.”
The editors say that some Democrats are ‘literally advising Mr. Biden to barely campaign at all. Eliminate the risk of a mental stumble that will raise doubts about his declining capacity that was obvious in the primaries.”
It’s great that Tucker Carlson, the WSJ and others are giving the Trump team this wake-up call while he still has time to turn this ship around.
But even as things currently stand, not all is doom and gloom for the President. Much of the swoon has occurred over the last month and he still has four months before Election Day. Here are some points to consider.
1. Biden’s absence may be precisely why his poll numbers are increasing.
Not everyone pays attention to the primaries. Those who are really into politics follow primaries. Moreover, Democrats who are very concerned about politics follow Democratic primaries and Republicans tend to follow Republican primaries. We all watched the Democratic debates this year because the Republican nomination was not seriously contested and the stakes are so high.
Primary debates, although some of them had their moments of excitement, are generally pretty boring.
My point is that the vast majority of voters haven’t been glued to primary events and may not know that Biden is failing cognitively. They remember Biden as he was during the Obama Administration. It wasn’t until he launched his campaign in April 2019 that anything appeared amiss. And since then, he’s been gradually deteriorating. Once he starts holding rallies, even virtual rallies, and certainly when the presidential debates are held, Americans will see firsthand that Biden is not fit for office.
2. President Trump has faced increasing criticism because he has not laid out a formal, detailed agenda for his second term. These have been unprecedented times. Number one on his list will be to return America to prosperity. Voters prefer Trump to Biden on the economy. And this is something the President can and does tout. Prior to the lockdowns, he had presided over a robust economy.
Much of his agenda will be a continuation of his first term agenda. He will complete the border wall. He will continue to work out more favorable global trade relationships, he will bring pharmaceutical manufacturing back to the U.S. He vows to expand school choice and health-care choice.
Critics are right that the Trump campaign needs to formalize their agenda.
In the meantime, what is Biden’s agenda? It might be better to ask, what is the agenda of Biden’s handlers?
During his Tulsa, OK rally, Trump described Biden as a helpless puppet of the radical left. Biden will not be running the show. How could he possibly?
In a previous post, I described what a Biden presidency would look like.
It will be his Vice President and other party leaders who will make the decisions. Possible choices for a Biden running mate include Sen. Kamala Harris (D-CA), former Georgia gubernatorial candidate Stacey Abrams, or Sen. Elizabeth Warren (D-MA). One of these women, or perhaps another, would be the de facto president. Nancy Pelosi, AOC, Susan Rice, Sally Yates, perhaps John Kerry and Michael Bloomberg would hold lofty positions in a Biden Administration. In other words, the most progressive politicians in the party would be setting U.S. policy and they would ram through their radical socialist agenda.
3. At this point in 2016, candidate Donald Trump was seriously trailing Hillary Clinton. A Reuters/Ipsos poll taken 6/25-6/29 showed Clinton up ten points. A Pew Research poll conducted between 6/15 and 6/26 put Clinton up nine. An ABC/Washington Post poll taken 6/20-6/23 had Clinton up 12. (Source of data: Real Clear Politics)
We also have to look at the bias of the pollsters themselves. Many of them are Democrats and many Democrats suffer from Trump Derangement Syndrome.
Democrats tried hard to influence the 2016 election. Is there any reason to doubt they’ll do it again?
Whatever it takes, right?
Hot Air’s Allahpundit posted about the latest Fox News poll. His title was “Fox News’s Pollster Is Just Messing With Trump Now.” He wrote:
Fox News polls have become an “event” on social media because everyone understands that the president expects his favorite network to propagandize for him, and yet … Fox’s polling is routinely terrible for him and discouraging.
A collective thrill runs through the media each time they release one: Wait until he sees this.
I’m half-convinced that FNC’s polling bureau dropped this latest round on him purely as payback for him complaining about them all the time. “Remember how he whined about the last national poll? Let’s poll the reddish swing states he thinks are in the bag for him this fall. See how he likes those apples.”

In the next two months, John Durham is expected to complete his investigation into the origins of the FBI’s counter-intelligence probe into the Trump campaign and many believe we’ll see indictments. When independent voters learn the extent of the abuse of power by Obama Administration officials, I’m pretty sure they’ll forget that Trump repeated a conspiracy theory about a 75-year-old man at a protest in Buffalo or held up a Bible at St. John’s Church.
5. Biden’s threat to withhold $1 billion in foreign aid from Ukraine unless the President agreed to fire the prosecutor who was about to question his son, Hunter Biden, will be back in the spotlight.
6. Biden denied knowing anything about the Obama Administration’s set-up of Gen. Michael Flynn in January 2017 in several interviews. Last week, the release of Peter Strzok’s notes told us not only that Biden knew, but that he was the one who came up with the idea of charging Flynn under the Logan Act.
The Trump campaign has their work cut out for them. Among other things, they need to complete a formal agenda.
President Trump told Sean Hannity last night during a Fox News town hall that hundreds of rioters and vandals have been arrested. They need to let the public know because many Americans believe his administration has done nothing to hold people accountable. I think an address to the nation would even be appropriate.
They did it once against all odds, they can do it again.
Biden is far from a shoo-in.

Rush discussed the fine line Trump may be walking. How much of his “bluster” is just that? Not because that is all he WANTS to do but maybe all he can do. Suppose he wanted to really intervene and the military stands down when called? We have had several generals go rogue and no one knows how many “Obama-Generals” remain with allegiance to the Left and not the Commander and Chief or even the country. As with any nation, how the military goes so goes the country. TDS may be rampant in the military. A schism in the military could ignite civil war more decisively than initially grassroots from civilians. The coup that started with the election is still on.
Add to that, the anarchists and devout Progs now know they have spare space to run wild. When Germany re-entererd Ruhr and re-militarized the Rhineland, Britain and France could had squashed that move. Early on, hard nosed reaction to rioters would have saved the integrity of cities especially small businesses. Antifa/BLM boast huge amounts of money to wage war… with much added from appeasing businesses. We are well past the Ruhr. Biden is walking around promising peace in our time.

That is a real possibility given the rebellious public comments of Secretary Asper and Gen. Millie who seemed to object to any military personnel being used to defend Americans at home from rioters they euphemistically called protesters. Inexplicably, Trump has not clearly explained his reasons for not intervening in the riots more aggressively and some of his supporters are beginning to wonder if he is actually a “paper tiger” on some issues which would have been impossible to believe during his surge in popularity.
He could have spoken to the nation and expressed his intentions to pressure the DOJ (next impeachment excuse) to ramp up indictments and call up the National Guard whenever the police are unable to handle the carnage or their mayors forbid the cops to suppress the riots. And make it clear that anyone in his admin that objects can quit and be replaced.
On the other hand, that could’ve been a catastrophic decision based on potential deaths, admin turmoil and the damaging Constitutional arguments about a POTUS intervening in state and local jurisdictions.
I think at this point Trump has nothing to lose
Go out and protect Americans, pound that into every conversation, the Dem mayors and governors refused to help them so he had to step in

Of course it’s not Trumps fault – but TRUMP is the one who needs to be on the air, making a speech , publicizing this bullshit, NOT Tucker Carlson! When shit like this comes out and Trump doesn’t say anything at all about it, it looks like he doesn’t give a shit.
Right now, except for the small handful of people who look at twitter, and there are less of them everyday, Trump looks to most of the country like he’s given up and gone fishing.

Barr Bringing Full Weight of the Federal Government to Stop the ‘Anti-Government Extremists’

What is about the radical leftist chaos currently being perpetrated in the country?
It’s primarily happening in cities run by Democrats so it’s a challenge due to the weak leadership and the failure to actually prosecute a lot of the cases going on, so that’s a problem.
But the federal government has been taking action and it may start producing results.
On Friday, it was announced the that DOJ had created a task force to stop the organized crime of the “anti-government extremists.”

U.S. Attorneys Craig Carpenito and Erin Nealy Cox, who are based in the District of New Jersey and Northern District of Texas, respectively, have been chosen by Attorney General William Barr to lead the effort designed to monitor activity from violent anarchist groups and stop planned criminal activity.
“Some pretend to profess a message of freedom and progress, but they are in fact forces of anarchy, destruction, and coercion,” Barr wrote in a memo shared by DOJ spokeswoman Kerri Kupec, who said it was focused on “violent anti-government extremists.” [….]
“We have evidence that anti-government violent extremists — including those who support the ‘Boogaloo,’ those who self-identify as Antifa, and others — will pose continuing threats of lawlessness. Some of these violent extremists, moreover, may be fortified by foreign entities seeking to sow chaos and disorder in our country,” Barr said.
“The Department of Justice will respond to these violent groups in the same way we respond to other organized criminal or terrorists networks — by disrupting their violent activities and ultimately dismantling their capability to threaten the rule of law,” Barr wrote.
Barr said that the DOJ was using 35 joint terrorist task forces across the country to help in the investigations. He said that they already had over 500 investigations under way.

“When the real violence started around May 25, 26, and so forth, we started using our joint terrorist task forces around the country. And there are 35 of them around the country,” Barr said.
“And now they are starting to go full bore, cranking out investigations, indictments against the people who are involved in this violence. So we’ve had scores of indictments already for such things as arson, destruction of federal property, things like that. And we have, right now, about 500 investigations underway,” he added.
That’s one way to end this, there has to be accountability and consequences with teeth. Right now, they know that in Democratic cities, there largely aren’t any consequences for their actions. If they are arrested, the charges are often just dismissed. Start giving people real penalty and real time, as well as locking up the leaders and the organizers and that will help put a break on some of this insanity. Expose the monetary networks and shame anyone involved in supporting these people. Call them the terrorists they are.
If they don’t get it, shut them down.

I’m reading the site every day. I’m very busy with work and nice summer weather is finally here to enjoy . Its a short season and I try to make the most of it.
I have turned off most of the news and as a Nielsen household i am at least sending a message.
I’m worried but I must say that this site has become my safe spot. Even Varney on FBN is negative on trumps handling of the chaos.
I just don’t post unless I feel I have something to add to the discussion. I do feel that trump missed an opportunity to use prime time to make an inclusive speech to try to diffuse the protests….still not too late for that.
However, most of the country seems to be busy having a fun summer and not too invested at the moment.

Rather, I see it as a case of constructive analysis.
Brad Pascal missed the Tulsa turn out by a country mile.
Ed Rollins, who is clearly in the Trump camp, saw that as a red flag that they need someone internally who can temper such optimistic projections with a healthy dose of reality.
As a matter of fact, he went so far as to say the campaign needs a shake up.
I never put any stock in the suggestion that the current polling numbers, including what the author of one of those articles claimed was internal polling show him in on the same glide path as Carter and Bush the elder. These are extraordinary times, the stakes in this election are megapolitical, references to past polling are, at best, utterly irrelevant and at worst manipulative.
Because I have few facts to deal with, and limited mental capacity compared to someone like, oh say Robbie Mooks, I cannot provide an in depth analysis of why Trump will win, and what he needs to watch out for. I rely on others for that. The best source I know of for that is Victor Davis Hanson, and the best journalist to take apart the other side is my heroine Kim Strassel.
The point is it is a high wire act, cheating is in the wind, and we cannot make too may mistakes here, or the kingdom will be lost.
One qualification on my lack of credentials. Whatever I may not know about the current scene, compared to Reagan’s former speech writer who claims to be blue collar from Queens, writes for the Wall Street Journal and is a true swamp creature and whore of the beltway cocktail party circuit, I am most assuredly an expert. Her latest incantation from the swamp is that Trump has been wrong on everything he has done. Me, I’m on vacation in Blue Ridge Georgia and believe me this is Trump country. Small town America. You know, the Deplorable people. The people they say should be on the trash heap of history.
The fine folks in this part of the state are going about their business and enjoying themselves. Went to downtown Blue Ridge, shopping with the wife today and had a great time and everyone was friendly and lots of tourists. Parking was hard to find, even though it was raining off and on all day.
Earlier we went hiking, and tons of “normal” citizens were out hiking, biking tubing and fishing with their families and dogs. Blacks and whites getting along just fine. There was a black family by the waterfall and I offered to take their picture for them so they could all be in the frame together. They said Thank You and I took the picture for them. No problems.
Sure, in a lot of ways things right now are bullshit and depressing but life goes on and you can’t let the “life” be sucked out of you. There are no do-overs. You got one shot.

Even if I were to comply with your polite request, how are you going to avoid the hideous antennas, towers and nodes they are putting on every street corner? Do you somehow need my silence to pretend they are not there or on their way? Or do you think the narrative is the reality and somehow controlling mine will change it?
President Trump has and Attorney General who was complicit in crafting changes to the FCC rules, as a Telecom Attorney, that allowed them to misappropriate our broadband utility subsidies and falsify the economics of wireless and use the funds other than what they are intended for. It is a huge malinvestment in a toxic, totalitarian technology. He continues to act for the benefit of Telecom instead of the American Public.
