Today it is Attorney General Jeff Sessions who now leads the Department of Justice, catching flak from the Swamp Reich. Why? Why Jeff Sessions? The Swamp Reich is fighting for its very existence:

The Obama administration funneled billions of dollars to activist organizations through a Department of Justice slush fund scheme, according to congressional investigators.

“It’s clear partisan politics played a role in the illicit actions that were made,” Rep. John Ratcliffe, R-Texas, told Fox News. “The DOJ is the last place this should have occurred.”

Findings spearheaded by the House Judiciary Committee point to a process shrouded in secrecy whereby monies were distributed to a labyrinth of nonprofit organizations involved with grass-roots activism.

Advocates for big government and progressive power are using the Justice Department to extort money from corporations,” Judicial Watch’s Tom Fitton told Fox News. “It’s a shakedown. It’s corrupt, pure and simple.”

There is a recent effort by Republicans to eliminate the practice, which many believe was widely abused during the Obama administration.

Always “follow the money”. The Swamp Reich knows Attorney General Jeff Sessions will stop the slush fund which feeds the leftist Swamp. So, the Swamp strikes back.

The Swamp Reich is not just Obama Dimocrats. The #NeverTrump GOP establishment is in on the Swamp. The Swamp is a hot tub for these Obama Dimocrat leftists and the #NeverTrump haters. The thing to do is turn up the heat on the Swamp hot tub and cook them like lobsters.

President Trump knows all this, which is why at Newport News Shipbuilding today, President Trump declared his support for Attorney General Jeff Sessions is “total”. The late afternoon recusal by Attorney General Jeff Sessions puts an end to the latest kerfluffle.

As much as the Swamp Reich tries to take down President Trump and Jeff Sessions, history shows high flying Trump will continue to trump. Consider how much flak has already been fired. A new study finds that 88% of Big Media coverage of President Trump in his first thirty days has been negative.

It is not just that Big Media coverage of President Trump is negative. Consider all the coverage of President Trump which is either deceitful and/or ignores really good President Trump news. For instance, on March 1, the Politico refugees who founded Axios had a startling take on Wall Street reaction to President Trump’s speech:

None of the plots and ploys will work however. Why? Because REALITY that’s why.

But the #ResistTrump clowns really are the last desperate defenders of a crumbling order – as the Swamp Reich collapses all around them and the Führer bunker lies in ruins – and the last acolytes of the old order flee to Argentina to hallucinate a return to power.

What is reality? The reality is that President Donald J. Trump is draining the swamp and getting more and more done every day. On the last day of February President Trump delivered a magnificent speech. That’s reality:

On Saturday, the new chairman of the Obama Dimocrat Party was selected by party leaders in Atlanta. The candidates ranged ideologically from deep crazy leftist (Perez) to deep deep offensively crazy (Keith Ellison) leftist.

The winner? It’s deep crazy leftist Tom Perez and his new deputy deep deep offensively crazy Keith Ellison.

The Obama Dimocrat Party, as we have documented in our long running series of “Mistake in ’08” articles, is now because of Obama’s 2008 capture of the nomination, a black party.

After an election in 2016, in which all our dire predictions from many years ago of the importance of the white working class came true, the Obama Dimocrat Party continues down the Stalin-Lenin road – more content to rule in Hell, than serve in Heaven. The Obama Dimocrat Party, as documented by an analysis of census data, is on the ash-heap of history. The Obama Dimocrat Party is a black party of totalitarian leftists aided and abetted by crackpot white liberals who yearn to be black or to have black friends.

In other words, the Obama Dimocrat Party has contracted Electoral Ebola. The Obama Dimocrat Party, because of the majority-minority districts which only benefit black officialdom who cram black voters into said districts, cannot regain the majority in the House of Representatives as long as these districts exist. The Obama Dimocrat Party, because of their “weighted” convention delegate selection process which rewards black districts, is now the captive of the black electorate wherein whites need not apply unless their platform is to shut white people up:

Team Clinton, meaning the professionally political elements of the Democrat machinery, are pushing the anti-Semitism storylines because the party is in the final stages of framing their argument to ensure their preferred DNC head, Tom Perez, wins as party chair.

The Democratic National Committee votes this week for its next leader. The winner of the DNC chair race will very likely reflect whether the committee’s voting members think it prudent to align their party with the Hillary Clinton-Barack Obama camp, the Bernie Sanders camp — or neither. [snip]

Pushing odd, vague, disingenuous and sparsely connected stories about anti-Semitic news, is the way Team Clinton undermine Perez’s opponent, Keith Ellison.

Representative Ellison, a Muslim, carries a strong anti-Semitic liability from his past associations and past engagements speaking negatively about Jewish people.

Team Clinton are exponentially more shrewd than most give them credit for. Even Machiavelli couldn’t keep up with their schemes. With the DNC election coming up, the professionally Democrat know how to plant the most toxic seeds at just the right moment. This is their play toward that end result, nothing more.

The intelligent question was answered foolishly by Conservative Treehouse. It’s a good example of why, because of such dissimilar mindsets and contrary goals, the right wing constantly fails to understand the left wing and therefore should limit their discussions to those of tactics not strategy when it comes to the aims of the totalitarian left.

The clever but deeply flawed scenario described by Conservative Treehouse was that by “setting up a national dialogue of rising anti-Semitic activity” the Clintons profit because their candidate (Tom Perez) will be the next DNC chair, defeat Muslim Keith Ellison (the Bernie Sanders endorsed candidate) and the Clinton victory will be due to the “do you really want to make our party take this dangerous path… .”

Conservative Treehouse has not a clue what this is about. To claim that the Clinton’s have a brilliant strategy to capture the party and keep Bernie Sanders at bay is so foolish, so entirely naïve, so bereft of understanding of the left, we are almost left speechless. Consider this deranged sentence from the Treehouse:

“What’s so brilliantly Clintonian about this play is how the Democrat apparatus gets their opponents (grassroots supporters of Sanders/Ellison) to push the anti-Semitic narrative by giving the appearance of a target against Trump. The Bernie people are so blind to their own party working against them, they willingly push the narrative and don’t realize it undermines their own leader, Keith Ellison. Brilliant x infinity.”

As if. To say something is “brilliantly Clintonian” after this past election cycle boggles the mind. Really, “brilliantly Clintonian”?

The only thing Conservative Treehouse got right was in noticing the “anti-Semitism” attacks on President Trump in the past few weeks. Conservative Treehouse was also correct in speculating that all the “anti-Semitism” news was more about the DNC chair fight than about President Donald J. Trump. But that was it. The answer to the question posed was rubbish.

So what was going on with all the attention to “anti-Semitism” recently? The answer was simple. It was a way to “normalize” anti-Semitism. It was a way to HELP Keith Ellison, not hurt him.

As pseudo-intellectuals and technology fanboys frequently state regarding some quirky computer software anomalies: “it is a feature, not a bug.”

Keith Ellison has a long history of anti-Semitism. Keith Ellison is a Jew hating Muslim creep as has long been documented by those on the right and from those on the left. For the Obama Dimocrat Party this anti-Semitism is a feature, not a bug. Keith Ellison is in the mainstream of Obama Dimocrat Party leftist thought when it comes to his anti-Semitism. What the Conservative Treehouse does not comprehend is that the anti-Semitism of Keith Ellison helped him in his quest to become the DNC chair, not hurt.

The totalitarian far far left, eager to help Keith Ellison become DNC chair, decided to “normalize” anti-Semitism. That’s why there were so many ridiculous attacks on President Trump who has a Jewish son-in-law, a daughter converted to Judaism, Jewish grandchildren, and a long history of Jewish friends such as Sheldon Adelson. Indeed, the Mar-a-Lago resort featured a long fight by Donald J. Trump to allow blacks and Jews to golf there. Donald J. Trump won his fight against “restricted” golf clubs and scored a victory against anti-Semitism more than 20 years before he ran for president.

So, how did the ridiculous attacks on President Trump attempt to help Keith Ellison? Because anyone in the Obama Dimocrat Party who might have suggested that the election of Muslim Keith Ellison as DNC chair would hurt the Obama Dimocrat Party, was silenced. Anti-Semitism was “normalized”. If some “strategist” said “Muslim Keith Ellison might hurt us with Jewish voters” the answer from the Muslim left was “yeah, but Trump is an anti-Semite too so don’t hold that against Muslim Keith.”

Conservatives don’t understand the convoluted perverse thought patterns of the far left.

The leftists who supported Keith Ellison figured that if they waged a campaign to claim ridiculously that President Trump is an anti-Semite they thereby diluted the “anti-Semite” charge when it was correctly lobbed against Muslim Jew hater Keith Ellison. Now that can be considered “brilliant” as a filthy political ploy.

Anyone who claimed that Bill and/or Hillary Clinton were “brilliant” as strategists in this DNC chair battle – in light of the 2016 election results – simply was not paying attention.

So what were the moves and countermoves of the DNC Chair fight? The fight was simply this: Barack Obama wants to continue to control the Obama Dimocrat Party. That’s why Barack decided to stay in Washington. We wrote about that when few others paid attention. Barack Obama is not staying in Washington for the weather, nor for his daughter. Obama is in Washington because it is from D.C. that Obama can maintain control of the Obama Dimocrat Party and stay on the corrupt gravy train.

Barack Obama’s candidate was Tom Perez. Barack Obama would have backed a horse for DNC chair if that would help him maintain his control of the Obama Dimocrat Party and keep the money flowing.

Bernie Sanders and the far far left wanted Keith Ellison. Socialist kook Bernie thinks he can run for president again in 2020 and somehow win the nomination and the general election. Pocahontas Warren also wants to run for president in 2020 so she too backed Keith Ellison. Sanders and Warren apparently have not learned that at the DNC rigged elections matter.

The DNC chair fight was a clumsy Bernie and Warren struggle to wrest control of the Obama Dimocrat Party from Barack Obama. Barack Obama wants to keep control. Obama continues to control the DNC. Rigged Elections Matter.

Hillary Clinton? That fire has berned out. Hillary Clinton is Obama’s lapdog at best. She has no power here. Tom Perez owes his allegiance and position(s) to Barack Obama and Barack Obama is his master, not Hillary Clinton.

The big winner in all this? President Donald J. Trump. President Trump has played his cards perfectly, brilliantly.

President Trump could have lashed out against the charges of anti-Semitism in an earth shaking way. President Trump could have reminded everyone from every pulpit he commands, of his support for Jews and his Mar-a-Lago destruction of “restricted” anti Jew, anti Black, actions 20 years ago. But President Trump did not do that. President Trump mostly denied, in a calm manner, the accusations. President Trump mostly stayed below the radar on all this.

Why? Why did President Trump not grab the headlines on this issue. Why did President Trump kinda/sorta help leftist Muslim, black racist, Keith Ellison with tweets such as this:


As with his regular faint “praise” of Bernie Sanders, President Trump was dividing the opposition in order to conquer. President Trump played his cards exactly right, in this his second month in office. On the one hand, for the good of the country, President Trump did not want to encourage the DNC to elect a Muslim, racist Black, Jew-hater, leftist totalitarian, even if that did that take the party away from Barack Obama thereby possibly creating a schism in the Obama Dimocrat Party.

On the other hand, President Trump understood that a DNC run by a Muslim, racist Black, Jew-hater, leftist totalitarian, helps cement President Trump’s hold on the white working class and even brings into motion Jews as they leave the Obama Dimocrat Party.


Will American Jews begin the Exodus now that a Muslim, racist Black, Jew-hater, leftist totalitarian loon, is the Deputy DNC chair? We don’t know.

Trump Month 2: “You’re Fired!” Begins

President Trump month 1 was about territory capture. On Trump month 2, in the captured territories, comes the orgy of the Guillotine!

It’s now time to say “you’re fired!”

President Trump has lived his life in the front pages so President Trump understands that Big Media is the enemy of the people. That’s a lesson many of his staff people did not understand fully until the past weeks. We suspect that the delusions are off now for these staffers. Staffers that don’t understand that, or those that want to bad mouth President Trump to Big Media for their own personal advancement, have to be removed.

President Trump as a business man also understands that in business mergers or company takeovers, some staff want to continue infighting instead of accepting the new business structure. President Trump understands that when employees in a business seek to undermine the business they have to be removed. President Trump’s cabinet appointments understand this as well because so many of them come from the world of business.

President Trump also understands that Barack Obama Dimocrats infest the federal bureaucracy and seek to undermine the new administration. These infestations need to be fumigated. As many culprits as possible need to have their heads separated from their shoulders. It’s time to bring out the Guillotine.

It’s Nearly Impossible To Get Fired At The IRS For Tax Evasion

More than 99 percent of the thousands of IRS employees investigated for violating federal tax laws in the last five years avoided termination and continued enforcing other Americans’ tax collections, according to an analysis by The Daily Caller News Foundation’s Investigative Group.

The IRS fired only 74 of 9,176 workers investigated for tax noncompliance from October 2011 to September 2016. Another 280 were allowed to retire or resign as a result of those misconduct investigations, according to the Treasury Inspector General for Tax Administration (TIGTA) Inspector General (IG).

Noncompliance cases — which may involve underreporting income, underpaying taxes or failing to file returns — most commonly resulted in some form of verbal or written reprimand or counseling, according to the 10 semi-annual IG reports analyzed. The IRS employed about 85,000 people at 500 offices across the country in 2016.

That IRS corruption is no surprise because Barack Obama appointed a tax cheat, Tim Geithner, to run the Treasury Department which numbers the IRS as one of its fiefdoms. The lack of prosecution of the corrupt IRS director John Koskinen is another clue. It’s time to fire Koskinen.

The firings required to remove the Obama left-overs will be many. Fortunately President Trump is on the job. There is lots of “you’re fired!” good news.

The White House budget office has drafted a hit list of programs that President Trump could eliminate to trim domestic spending, including longstanding conservative targets like the Corporation for Public Broadcasting, the Legal Services Corporation, AmeriCorps and the National Endowments for the Arts and the Humanities.

Work on the first Trump administration budget has been delayed as the budget office awaited Senate confirmation of former Representative Mick Mulvaney, a spending hard-liner, as budget director. Now that he is in place, his office is ready to move ahead with a list of nine programs to eliminate, an opening salvo in the Trump administration’s effort to reorder the government and increase spending on defense and infrastructure. [snip]

The Office of Management and Budget is currently operating with a skeleton staff; Mr. Mulvaney was only confirmed on Thursday. Still, officials there plan to ask agencies targeted for elimination for their responses by next Friday and to finalize the list by March 13, according to a person familiar with the process.

Obama Dimocrats will demand money for wasteful programs that are no longer needed other than to continue to pay salaries to their cronies. But it is time to Guillotine waste, fraud, abuse, and the federal workforce that preys on the taxpayer. It’s long past time for Big Bird to leave the government cage and work in the marketplace. If Big Bird cannot feed itself fat with the hundreds of millions (billions?) made at Sesame Street, then let’s roast that fowl and have a big bird Thanksgiving.

Much of seventh-floor staff, who work for the Deputy Secretary of State for Management and Resources and the Counselor offices, were told today that their services were no longer needed. [snip]

Two sources also told CBS News that Ambassador Kristie Kenney, the Counselor of the State Department and one of the last remaining senior officials, was informed that she will be let go. She is a career foreign service officer who had served as an ambassador under Presidents Obama, Bush and Clinton. Her staff was told that Secretary Tillerson does not intend to fill the counselor’s position anytime soon.[snip]

“It is irresponsible to let qualified, nonpartisan, experienced people go before you have any idea of their replacement. You can’t do foreign policy by sitting in the White House, just out of your back pocket,” explains Tom Countryman, Former Assistant Secetary for Non-Proliferation who was let go earlier this month. This may be what President Trump was referring to when he repeatedly said that “our people” are not yet in place at U.S. government agencies. He blamed the leaks of embarrassing White House transcripts of his phone calls with foreign leaders – including difficult conversations he had with Mexico and Australia – on officials who had previously worked for the Obama Administration.

News that a top State Department official discussed a “quid pro quo” in exchange for the FBI changing the classification of a Hillary Clinton email is shocking enough. But word that the coterie of State officials who controlled the release of the emails called itself “The Shadow Government” is mind-blowing.

The latest FBI dump of documents from the investigation into Clinton’s email follies includes a summary of one agent’s talks with Undersecretary Patrick Kennedy — who, the agent said, “pressured” him to “change the classified email to unclassified.”

Kennedy “asked his assistance in altering the email’s classification in exchange for a ‘quid pro quo,’ ” the summary says. “In exchange for marking the email unclassified, State would reciprocate by allowing the FBI to place more agents in countries where they were presently forbidden.” [snip]

The FBI also released the summary of an interview that revealed a cabal at State that oversaw the email release — a “powerful group of very high-ranking STATE officials that some referred to as ‘The 7th Floor Group’ or as ‘The Shadow Government.’

The 7th Floor Group, the Shadow Government swamp is being drained. The Guillotine is lapping up blood and remains thirsty. Candidate Donald J. Trump’s “drain the swamp” promise is underway and will be fulfilled.

Why was T-Rex Tillerson so necessary for the job of Secretary of State? Secretary Tillerson ran the massive Exxon-Mobil corporation so he knows how to run a massive operation like the State Department. You need a T-Rex to drain the swamp. That is what Secretary Tillerson is doing and why he is under attack from within the State Department:

One of Rex Tillerson’s first directives as U.S. secretary of state was an order to senior staff that his briefing materials not exceed two pages.

It was a reflection of Tillerson’s management style honed at the helm of Exxon Mobil, an oil company known for its relentless focus on efficiency, and one reason his closest aides at the State Department refer to him as “the CEO” rather than “the Secretary.” [snip]

His aide R.C. Hammond said the directive reflected Tillerson’s focus on key facts rather than lack of interest in finer points of foreign policy.

He is asking people to be efficient with their information,” Hammond said, adding that if Tillerson needed more information he would ask for it. “He is a decision-maker and he needs the facts in front of him.” [snip]

Senior State Department officials who have attended meetings with Tillerson say they find him sociable and a man of substance, whose direct manner and probing questions reflect his training as an engineer seeking to solve problems rather than play politics. [snip]

Just two State Department positions of 116 key posts requiring executive branch nomination have been filled, according to the nonpartisan Partnership for Public Service – Tillerson’s and that of U.S. ambassador to the United Nations. [snip]

“People want to back him,” one veteran senior official said about the former Exxon Mobil boss. “But people are feeling that this building is being stripped,” said the official, referring to a sense that with so many top positions vacant, the State Department is not fully equipped to help make policy in the new administration.

There is also unease over possible deep staff cuts and the future of some departments. Two people said employees in the Bureau of Management and Resources were told to apply for other positions within the State Department. Hammond, Tillerson’s aide said no decision had been taken to close that division.

The swamp is being drained, not merely stripped. It must be understood that the swamp monsters will fight back to protect their swamp. Thus far the “intelligence” bureaucrats and the NSC swamp monsters have leaked and leaked to destroy President Trump. Many across the political spectrum have spoken out against the “coup” led by these swamp monsters. Even some die hard leftists, such as former Congressman Dennis Kucinich, see the danger of the swamp monsters, the 7th Floor, the Shadow Government:

Now, some unnamed, rogue, intelligence officials, allegedly fearing leaks, are reportedly withholding secret information from the new president, while their own unsubstantiated leaks promote a narrative that Russia hacked the U.S. election, colluding with Trump aides. [snip]

Intelligence agencies play politics. Given the separation of powers doctrine, they have no legal right to monitor Congressional phone calls, and are to discontinue the monitoring if it accidentally occurs.

Our nation is endangered by never-ending attempts to engineer coups abroad. We also face dangers from within by unquestioned acceptance of stories peddled by some past or present anonymous, “official” US sources. [snip]

I well understand the disappointment of Democrats over the election. But we must not let our disappointment cause us to align with those who would imperil our country by either stirring passions for war or using covert, unconstitutional means to oust a President.

The consequences of the behind-the-scenes machinations of anonymous intelligence officials goes way beyond the personality and policies of one president. This is about our nation. It is about our Constitution and the rule of law.

We are witnessing an attempt by some shadowy intelligence operatives to further divide us, to destabilize America for ideology, money and power. People need to look carefully at every headline and media report to discern the underlying motives, so in our efforts to challenge this administration, we do not fall prey to those who can, with insidious anonymity, destroy our democracy and our freedoms. We must look beyond partisanship.

As we wrote previously, “Such is the state of the Obama Dimocrat Party that even those that once were certifiable kooks now appear rational by comparison.” Kucinich is not alone on the left in warning about the Shadow Government, the 7th Floor, the NSC, the intelligence community coup:

Said an intelligence officer: “I know what’s best for foreign policy and national security… And I’m going to act on that.

Some of us might applaud this man, including a few of my fellow Democrats. In their minds, this is a case of Mr. Smith Goes to Langley to do battle against a corrupt President Trump.

One small problem. The intelligence officer quoted above was actually Aldrich Ames, a CIA traitor whose crime of treason in the 1980s and 1990s resulted in the compromise of more than 100 assets. Many were tortured and executed as a result.

Ames’ flawed logic is eerily similar to that of his present-day colleagues who are engaged in a shadow war with their commander in chief. They, too, have decided that their superior judgment is more important than following the law. [snip]

For reasons of misguided righteousness or partisan hatred, they’ve taken it upon themselves to be judge, jury, and executioner. They have prosecuted their case in the court of public opinion, with likeminded media outlets such as CNN, The New York Times, and the Washington Post serving as court stenographers.

Elected by no one, responsible only to each other, these spies have determined that Trump is guilty of high crimes and misdemeanors.

Days ago, they delivered their verdict. According to one intelligence official, the president “will die in jail.”

I understand how this might feel appealing to deeply partisan Democrats. After all, I didn’t want Trump to win either. [snip] We must instead let the system continue to work, as it has, and make our case to the American people during future elections.

If you’re not convinced, imagine the consequences of letting spies decide not just Trump’s fate but other political winners and losers too. Imagine how they might treat our candidates next. [snip]

This is the slippery slope of political tribalism that, up until a few months ago, I would have thought impossible in America. Certainly it happens in third world nations but not here. I was trained to believe that we were exceptional.

In the culture of America’s spies, you live and die by a set of rules. One of them is a sacred pledge of allegiance to the constitution and commander in chief. Spies may not like a president or their policies but they must salute their leader nonetheless. If they cannot, they are told to resign.

Spies also take a vow of secrecy, specifically to keep classified information hidden from anyone who doesn’t have an authorized need to know. It’s a commitment one keeps for a lifetime. And should that vow be violated, the consequences are dire. Prison time. Colleagues and informants killed. Enemies emboldened. The country less safe.

Spies also accept and embrace a final rule: there must be an unbreakable wall between government workers and the democratic process.

Why?

Because many spies have access to powerful tools that, if used improperly, could cause incredible damage to the nation’s stability. Accordingly, clandestine officers have a special covenant with the American people – codified by the Hatch Act – that limits their participation in politics.

During my time as a CIA officer, I quickly learned why all these rules were in place. I read people’s emails. I listened to phone calls. I recruited assets that told the dirtiest and most embarrassing of secrets. I came to realize that my power was both an awesome responsibility and, at times, wickedly seductive.

Some of us faltered in our commitments. I remember colleagues who believed themselves above the rules, conducting quiet investigations into cheating wives or ex-boyfriends. They were eventually discovered and rightfully thrown out. They had demonstrated an inability to handle the burden of power.

And that is precisely what we are experiencing today. The spies who are plotting against President Trump are breaking U.S. laws. They’re violating their oaths. And they’re committing treason to remedy (perceived) treason.

They likely don’t see it that way, of course. But, then again, neither did Aldrich Ames.

With luck and aggressive investigations, these renegade spies will join their fallen colleague at the Allenwood Correctional Facility for the remainder of their lives.

Drain the swamp. Fill the prisons if necessary with those who violate their oaths and plot against the duly elected government and president of the United States.

It’s not just the State Department that requires a drain of the swamp. There are the corruptions and plots at the EPA that need to feel the slice of the Guillotine:

In a show of defiance, EPA workers fight to stop Pruitt’s confirmation

WASHINGTON — Employees of the Environmental Protection Agency have been calling their senators to urge them to vote on Friday against the confirmation of Scott Pruitt, President Donald Trump’s contentious nominee to run the agency, a remarkable display of activism and defiance that presages turbulent times ahead for the EPA.

Many of the scientists, environmental lawyers and policy experts who work in EPA offices around the country say the calls are a last resort for workers who fear a nominee selected to run an agency he has made a career out of fighting — by a president who has vowed to “get rid of” it.

“Mr. Pruitt’s background speaks for itself, and it comes on top of what the president wants to do to EPA,” said John O’Grady, a biochemist at the agency since the first Bush administration and president of the union representing the EPA’s 15,000 employees nationwide.

Nicole Cantello, an EPA lawyer who heads the union in the Chicago area, said: “It seems like Trump and Pruitt want a complete reversal of what EPA has done. I don’t know if there’s any other agency that’s been so reviled. So it’s in our interests to do this.”

The union has sent emails and posted Facebook and Twitter messages urging members to make the calls.

“It is rare,” said James A. Thurber, the director of the Center for Congressional and Presidential Studies at American University. “I can’t think of any other time when people in the bureaucracy have done this.” [snip]

But because Civil Service rules make it difficult to fire federal workers, the show of defiance indicates that Pruitt will face strong internal opposition to many of his promised efforts to curtail EPA activities and influence.

“What it means is that it’s going to be a bloodbath when Pruitt gets in there,” said Christine Todd Whitman, a former Republican governor of New Jersey and the EPA administrator during the first term of President George W. Bush.

Whitman predicted a standoff between career employees and their politically appointed bosses, noting that Pruitt will be blocked by legal Civil Service protections from immediately firing longtime employees but would likely be able to retaliate against them in other ways, such as shifting them to different jobs. The showdown could embolden the White House and Congress to change federal Civil Service laws.

The Civil Service is supposed to be a class of experts implementing policy, regardless of politics,” said Myron Ebell, a fellow at the free-market Competitive Enterprise Institute, who led Trump’s environmental transition team. “If they have now become a special interest group pleading their own agenda, then it is probably time to look at reforming the Civil Service laws.” [snip]

Within days of Pruitt’s swearing-in, Trump is expected to sign one or more executive orders aimed at undoing Obama’s climate change regulations, and possibly to begin dismantling some EPA offices and programs, according to people familiar with the White House’s plans.

While it will be impossible to undo most major rules or programs that quickly, the presidential signatures would authorize Pruitt to cut existing environmental regulations — and, eventually, the jobs of many of the people who enforce them. [snip]

I’ve been here for 30 years, and I’ve never called my senator about a nominee before,” said an EPA employee in North Carolina who spoke on the condition of anonymity out of fear losing her job.

The calls to senators come on top of an anti-Pruitt protest last week by Chicago EPA employees, and agency workers say that if Pruitt is confirmed, they intend to amplify their resistance to him, taking their case to the American public.

“At this point, it’s just, ‘call your senator,’” O’Grady, the union president, said. “We plan on more demonstrations, more rallies. I think you will see the employees’ union reaching out to NGOs and having alliances with them,” he added, referring to nongovernmental organizations. “We’re looking at working with PR firms.” [snip]

But former EPA officials said the open rebellion by current employees is extraordinary, especially considering that their resistance could backfire once Pruitt arrives on the job.

Scott Pruitt won confirmation on Friday. The EPA swamp will be drained and the ecology of government restored. Get ready for “reforming the Civil Service laws”. Remember, we save the best for last.

President Donald J. Trump is working night and day, seven days a week, but the congress is a freakin’ waste. But not entirely a waste. The goofball congress, run by the GOP establishment and Trump haters, have done a few things.

The wastrel congress run by Paul Ryan and Mitch McConnell have done very little during the first Trump month. The Senate as usual has lounged in the swamp as if it were a high class hot tub at a Trump resort – failing to quickly fill President Trump’s cabinet. The House, under Paul Ryan, promises to get things done – after a week’s “recess” having done little thus far. Paul Ryan says that after the recess the House will begin to repeal ObamaCare and continue to prepare budgets and tax reform.

We’ll give Paul Ryan, Mitch McConnell and the Congress through the Trump month 2 – before we start to scream and shout. We want to preserve our dulcimer tones and sweet demeanor/disposition.

There is some hope we will remain sweet and purring. We saved the best for last.

During Trump month 1, a great many preparatory steps have been taken. A great many seeds planted. The next steps, the flowering seeds, might blossom unto heaven and feed the Guillotine in Trump month 2. Here’s a corpuscle taste, written by leftist NYMAG, to whet the appetite of the Guillotine:

The GOP Just Gave Congress the Power to Cut the Salaries of Individual Civil Servants to $1

This week, congressional Republicans gave themselves the power to slash the annual salary of any individual federal worker to as low as $1 — and the budget of any individual federal program right down to zero.

They executed this attack on the independence of the civil service by reviving an obscure provision enacted by Congress in 1876: The Holman Rule, named after the Indiana congressman who devised it, empowers any member of Congress to submit an amendment to an appropriations bill that targets the funding of a specific government program or employee. [snip]

For the past three decades, Congress has had the power to slash any agency’s overall budget, but not to target specific projects or civil servants for funding cuts or downsizing.

Until now.

This is a big rule change inside there that allows people to get at places they hadn’t before,” House Majority Leader Kevin McCarthy told reporters this week. “All agencies should be held accountable and tested in a manner and this is an avenue to allow them to do it.” [snip]

Virginia congressman H. Morgan Griffith led the charge for reviving the Holman Rule, after learning about how much the federal government spends on the upkeep of wild horses ($80 million, apparently). When the Washington Post asked Griffith if the new rule would be used to cut “huge swaths” of the federal workforce, he replied, “I can’t tell you it won’t happen … The power is there. But isn’t that appropriate? Who runs this country, the people of the United States or the people on the people’s payroll?

For the next year, passing an amendment slashing an individual worker’s salary or position will require a simple majority in both houses of Congress.

Now that is Civil Service Reform. Sadly, the only way some workers, especially protected government workers, will be productive and follow the orders of those duly elected to run the government is under the threat of “You’re fired.” The unfortunate fact, as demonstrated by the IRS tax cheats, is that the federal bureaucracy needs to be cut back drastically. Also, the tail needs to understand it does not get to shake the big dog.

On Saint Valentine’s Day, Governor Chris Christie met with President Trump. No one other than the President and the Governor know what happened at that meeting. The best guess is Governor Christie will soon be employed by the President. As NYMAG reported, Governor Christie at a private function said that he advised President Trump early on “to immediately ask the Republican Congress to change the civil service laws. Because if they do, it will make it a lot easier to fire” Obama appointees.

Governor Christie might be the incoming “drain the swamp” machine. We’ll know soon enough. For now, the Guillotine is the apprentice on the job – beheading the swamp monsters – under orders from President Trump.

Keep on grinning! President Trump is in Melbourne, Florida today to speak to the American people. The event is paid for by his campaign. Is it his reelection campaign? Is it the campaign he just won? Whatever! It’s a winning campaign.

Why is it a winning campaign? Because President Trump is telling the truth, the unvarnished politically incorrect truth.

On the day Donald J. Trump announced for president we wrote his greatest strength was his use of the English language (shades of Winston Churchill). President Trump continues to trump because his use of English is a precision instrument. We’re not talking about details nor the obsessions of pedants. We’re talking about how President Trump tells the truth. Example:


President Trump is absolutely correct. The propaganda ministers, the liars who hide behind the First Amendment, the Big Media vipers who pretend to be “news” but are “fake news” deceivers, are the enemies of the people.

Chuck Todd did not seem to mind when Anderson Cooper asked Hillary Clinton about her “enemies” and Hillary Clinton responded with a list of her deplorable enemies. Oh, and we haven’t heard denunciations of Eleanor Roosevelt attacking her “enemies” either.



Chuck Todd also did not seem to mind how in 2008 Big Media shilled for Barack Obama over Hillary Clinton and in 2016 Big Media shilled for Hillary Clinton over Donald J. Trump. Big Media abused its power in both those important elections. The difference in who won is that in 2016 Donald J. Trump would not play the sap for Big Media like Hillary Clinton did in 2008.


Chuck Todd and his Big Media pals are the ones abusing their power with their partisan pussyhats firmly on their heads. What Chuck Todd is whining about is that President Trump will fight fire with fire.

President Trump Vs. The Swamp, Kooks

The fun is just beginning. We’re laughing at two categories of fool today.

Type one to mock is the Trump supporter chicken littles who think their world is crashing because the fight is on and things are not going as rosy sweet as they feverishly imagined.

Type two to mock are the DailyKooks who have gone full tilt nuts along with the GOP establishment still hoping the red they see is President Trump’s blood. We laugh at them both as Trump week 4 continues and hundreds, yes hundreds, of Trump weeks are to come.

Let’s return to the basics of the Trump Revolution to understand what is happening. Donald J. Trump launched a hostile takeover of the Republican Party back in June 2015. During the nomination fight Donald J. Trump attacked Republicans such as George W. Bush and his Iraq War at Republican debates. Donald J. Trump rampaged through the debates and the nomination fight against the GOP establishment. Once Donald J. Trump was the GOP nominee he trained his artillery against the Obama Dimocrat Party and the self-proclaimed Obama Third Term a.k.a. Hillary Clinton. Against Big Media, the Dimocrats, the GOP establishment, the intelligencia, Academia, Big Business, Big Institutions, the neo-con right, and the totalitarian left, Donald J. Trump fought and won. Ergo, President Donald J. Trump.

The chicken littles of today somehow thought that after the President Donald J. Trump inauguration the war would turn into the discourse of a little girl’s plastic tea cup party featuring operatic debates in which the harshest imaginable behavior would be the occasional “tut-tut old sport” verbiage. That was never going to happen. Neither that nor any variant short of all out war, bloody war was ever going to happen.

It’s all out war. The inauguration of President Donald J. Trump was the starting fire of all out war. We wrote about what to expect and we said it will be all out war until the political equivalent of Hiroshima and Nagasaki. That’s what it’s like. President Trump and the overthrow of the political establishment is all out war, not a pretty picture of well ordered landings from a luxury cruise ship assisted by charming escorts. President Trump represents an invasion that seeks to overthrow the political order. The political order will fight back.

What President Trump understands is that once you land on the beach the imperative is to move swiftly inland and capture territory. President Trump, like the General Patton he so often references, knows that the army must move forward with surprising speed and worry about patching problems up as you go along.

Some parts of the beachhead advance. Other parts of the invasion are stalled. The order is to keep moving forward. There’s blood everywhere. The necessity is to break through the roadblocks and move forward. Move forward. There’s blood everywhere, but move forward, even when it is your friend that was mowed down, move forward, move forward:



Let’s look at the entire battlefield: the GOP establishment continues to fight back with delay tactics while the neo-cons and their bureaucratic allies continue all out war with flame-throwers and exhortations to fight on against President Trump. From the left it is madness and fury against President Trump. All along President Trump continues to move forward, move forward.

A few data points of the fight as it progresses which helps us map out tactically how to move forward on the strategy:

Remember the withdrawal of Obama’s pick for National Intelligence Council chairman, Charles Freeman, in March 2009? Obama had tapped the former U.S. ambassador to Saudi Arabia for the sensitive post despite abundant conflicts of interests. Freeman had served for four years on the board of the China National Offshore Oil Corporation, a company owned by the Chinese communist government. The state-owned firm has invested in Sudan and Iran. Freeman also led the Middle East Policy Council, a Washington, D.C.-based group funded by the Saudi government. [snip]

Obama knew all that and looked the other way at Freeman’s role as a de facto lobbyist for Saudi royalty. Even worse, he ignored Freeman’s Jew-bashing and tyrant-coddling record with a Blame America axe to grind. Freeman carped that our country exhibited “an ugly mood of chauvinism” after the 9/11 attacks and condemned his fellow countrymen for connecting the dots of Islam and Saudi-funded jihad: “Before Americans call on others to examine themselves,” he fumed with Jeremiah Wright-style bombast, “we should examine ourselves.”

In fine form, Freeman inveighed against the “Israel Lobby” in his resignation letter. [snip]

By this time in Obama’s first term, former Democratic New Mexico Governor Bill Richardson had withdrawn as Commerce Secretary nominee after both liberals and conservatives protested his long record of corruption and incompetence. [snip]

Richardson’s replacement, former GOP Sen. Judd Gregg, accepted and then quickly withdrew after disagreements over Obama’s massive federal stimulus proposal and Democrats’ politicization of the Census.

Another Beltway barnacle, former Democratic South Dakota Sen. Tom Daschle, was also forced to withdraw from his nomination as Obama’s Health and Human Services secretary amid a storm of ethical scandal, conflicts of interest, and tax avoidance. That was compounded by Treasury Secretary Geithner’s admission of “tax goofs” involving his failure to pay $43,000 in federal self-employment taxes for four separate years (until, that is, he was tapped for his Obama post). At least five other Treasury staff picks withdrew before the Obama administration had reached the 100-day mark over tax problems, conflicts of interest, bad judgment and records of lax oversight of industry.

By the end of his first 100 days, Obama had set a turnover record for an incoming cabinet with four major withdrawals. And by the hallowed 100-day mark, Obama had announced less than half of the total Senate-confirmed Cabinet department positions he needed to fill, with only 10 approved — even though the Democrats had an overwhelming majority in the Senate at the time.

That brief history should shut up the chicken littles of 2016 pearl clutching about Mike Flynn and/or Puzder.

Ultimately, you’re committed not so much to conservative principles, but rather to a Beltway status quo that Trump is a huge threat to. Based on your actions over the past few months, I can see (and indeed, so can everybody else) that you wouldn’t have cared all that much if it had been Hillary Clinton who won the election. Even if Jeb Bush or Ted Cruz had came out on top in the Republican primaries, and then went on to lose in the general election to Hillary Clinton, you would not have been greatly discomfited. Yes, you wouldn’t have liked it, and yes, I’m sure that for at least the next four years, the Weekly Standard would be filled with articles and think pieces critical of Clinton and her policies, but they would all pretty much impotent to actually change anything.

So I think the election of President Trump has given us the chance, for the first time, to effect real change in national politics. And it’s been instructive to see how you and the rest of the #NeverTump crowd are all weeping and wailing and digging in your heels, even now, even after most of the decisions Trump has made so far have been conservative. This tells me that you’re part of the problem that electing Trump is supposed to solve. And it confirms to me that voting for Trump was the correct choice.

Data point, #NeverTrump John Podhoretz is worried about the destruction of Mike Flynn by the “deep state” which we once all called the “police state”. Podhoretz did not like Flynn but sees the danger:

If this was intelligence, the revelation of the Flynn meeting just revealed something to the Russians we shouldn’t want revealed — which is that we were listening in on them and doing so effectively. [snip]

And as for playing fast and loose with confidential information on American citizens: No joke, people — if they can do it to Mike Flynn, they can do it to you. [snip]

It would be pretty to think so, but we also know that Flynn had an antagonistic relationship with America’s intelligence agencies. If these leaks came about not out of high principle but because officials at those agencies were taking out a potential adversary, that is nothing more or less than a monstrous abuse of power. [snip]

If those who fear Trump embrace antinomianism because they think he’s going to destroy our democracy, they should stop and consider whether their zeal to stop him might be blinding them to a different threat from the federal government that will erode our rights as citizens.

Data point, Don Surber who understands why Mike Flynn had to go, but also understands the threat from the “police state” a.k.a. “deep state”.

This particular data point from Don Surber has been driven very well by President Trump who Tweeted: “The real story here is why are there so many illegal leaks coming out of Washington? Will these leaks be happening as I deal on N.Korea etc?”

The data points on the political assassination of Mike Flynn are many. Perhaps it was Barack Obama who directed his thugs to kill Flynn. After all, at the end of his term Barack Obama gave the NSA broad new powers that likely were used to kill Flynn. Our bet is that it was a combination of Obama, Obama thugs, and the bureaucrats of the police state along with the GOP establishment that politically killed Flynn. Keep that all in mind as we data point our map.

Don’t forget the Glenn Greenwald – who applauds what happened to Flynn even while seeing all the lies on top of lies, data point. Greenwald’s position is complex. He believes Flynn lied and it was necessary to expose that lie. Greenwald also sees the hypocrisy of Obama Dimocrats who said nothing as Obama hunted down leakers with more gusto than Richard Nixon, now praising those who leaked against President Trump. Greenwald also recalls the felony lies of James Clapper to Congress in public testimony in order to protect Obama. Greenwald misses his own hypocrisies. But the data point that matters here is this:

Thomas Friedman said the resignation of Ret. Lt. Gen. Mike Flynn as National Security Adviser showed it was never taken seriously that the Russians “hacked our election.”

“Trump actually tweeted out some positive encouragement of this. Did the two of them cook this up all along?” Friedman asked of Flynn and Trump.

“We have never taken seriously from the very beginning Russia hacked our election,” the New York Times scribe said on Morning Joe Tuesday. “That was a 9/11 scale event. They attacked the core of our democracy. That was a Pearl Harbor scale event.

Pearl Harbor? 9/11? Only in the Kingdom of the Kooks does such madness prevail. Did the Russians corrupt the primary in which Hillary Clinton could barely beat socialist kook Bernie Sanders? Bernie Sanders did not fight Hillary Clinton on emails. Bernie Sanders enabled Hillary Clinton on her email problems.



The “Russians did it” theory of the kooks is that the Russians won the election for Trump by hacking, then leaking, emails from John Podesta and the DNC. Bernie Sanders never exploited the emails however so how is it that Hillary Clinton was barely able to defeat Bernie Sanders and therefore the Russians are to blame for her loss? Indeed, Bernie Sanders’ supporters and Hillary Clinton supporters are still fighting each other. But the Russians did not help socialist Sanders. Yet Hillary Clinton, despite a DNC that rigged circumstances and situations for her, could not dispatch the socialist kook.

If Hillary Clinton has dispatched socialist kook Sanders in Iowa and New Hampshire, unified Obama’s party behind her very early, understood the change Donald J. Trump represented, she could have won the election by leveraging the establishments of both parties and her money advantage (though we doubt it because it was a change election). We knew back in 2013 that Hillary Clinton was a “muddled message mess”.

Hillary Clinton ran the dumbest, stupidest, campaign ever. Hillary Clinton, as we wrote, deserved to lose.

Hillary Clinton deserved to lose and she lost. It wasn’t the Russians, nor Bernie Sanders, nor fill-in-the-excuse that is to blame. Hillary Clinton deserved to lose. As we wrote repeatedly at least since 2012, the 2016 election was a change election and the candidate of change would win. Hillary Clinton declared herself the Obama Third Term, not the candidate of change, so she lost. Donald J. Trump made himself the leader of a movement for change, real change, not phony hope and change, so Donald J. Trump is now President Trump.

President Trump is moving forward.

Even with a barely moving congress, President Trump is moving forward. Consider the initiatives President Trump has signed and the long term ramifications of same. As he meets with foreign leaders, such as Netanyahu, Trump moves forward. David Friedman will soon be the American ambassador to Israel too. On immigration, President Trump will win, even if he faces fire as he lands on the beachhead. As his cabinet fills, President Trump gets reinforcements and continues to move forward.

On issue after issue President Trump moves forward. Every day productive activity is moving forward even as during the campaign the chicken littles and the left will declare what they don’t understand to be “chaos”.

TPP is gone. A lot has been done. What President Trump has done will not soon be gone. It will last for generations.

As to the intelligence community and Mike Flynn remember that not even journalists are protected under 18 § 798 of the U.S. Code. Keep an eye on that as President Trump takes control in the coming weeks and months of the NSA and the “deep state”.

The Supreme Court? President Trump will win there too and the win will last generations.

Casus Belli: 9th Circuit Immigration Order Declares War On President Trump

Update: The fog of war continues. The Ninth Circuit declared war on President Trump, the Executive Branch, and our system of enumerated powers and separation of powers. That is the main lesson from their latest clown ruling on President Trump’s immigration order. Now the Ninth Circus has gone further nuts, if that is possible. There is a new order from the Ninth Circus:

BREAKING: 9th Circuit Judge Wants Another Vote over Trump Travel Ban Decision

In a somewhat rare move, one of the judges on the 9th Circuit of Appeals has made a request that a vote be taken as to whether the order issued by the three judges Thursday night should be reconsidered en banc, which means before the entire 9th Circuit bench rather than by just the panel selected from them. It’s not clear if this mean that this judge believes that there is enough votes to overturn the lower court’s decision which put a temporary halt to Trump’s controversial travel ban. Regardless, it is an interesting move, and throws another legal twist into the ongoing court battle between President Trump and those trying to prevent his controversial immigration ban from being enforced. The court has instructed both Trump’s team and lawyers for the State of Washington and Minnesota to file briefs due by Thursday February 16th, stating whether they believe the motion should be considered en banc. Earlier today, Trump indicated that he did not plan to appeal the 9th Circuit’s decision to the U.S. Supreme Court, and instead planned to fight the case on the merits in the lower court.

What does this all mean? Is the Ninth Circus afraid of what has been unleashed by it’s mad war against separation of powers and at least one judge is blinking, afraid or concerned by the implications of what the Ninth Circus has done? Or is the fear of President Trump forcing the Ninth Circus to reconsider their craziness? Or is the Ninth Circus afraid that President Trump’s alleged plans to fight the case in the lower court and the court of public opinion and thereby this new order is a way to force President Trump to stay at the appeals level and on to the Supreme Court before Justice Gorsuch appears on the high court?

We won’t speculate as to those questions. But we do know who will win and who will lose: President Trump will win and the Ninth Circuit will lose. Why do we say that with such assuredness? Because President Trump has a lot of cards to play while the Ninth Circuit – with it’s ridiculous ruling which gave standing to non-citizens in other countries and gave legal standing to the complaining states without real grievances – played it’s last hand.

Eventually this all goes to the Supreme Court, unless the Ninth Circus surrenders, and President Trump has the appointment trump hand. The Ninth Circus is in for a world of hurt, possibly including getting smashed to bits, and of course the Congress can always cut the court budget giving the Ninth Circus and the Judicial Branch a good lesson in separation of powers.

What would we like to see happen in our entertainment fantasies? It would be fun if Attorney General Jeff Sessions would reply to the court with a letter saying “listen you dumbass motherf*cker refugees from Barnum & Bailey, you will get an asswhipping ejamacation on separation of powers when we bust up your little clown tent and start to pass legislation with Article III, Section 2 “exceptions, and under such regulations as the Congress shall make” which strip you of judicial review and then you can chew on your own butts for taking on President Trump before I was in office and he had to fight you alone you jerkoff lunatics, and let me also tell you you goddamned motherfu*king ….”

The Ninth Circus has made it’s ridiculous ruling (full text HERE) on President Trump’s executive order on immigration. As expected, the Ninth Circus of Hell, the Circuit most overturned by the Supreme Court, upheld the district court clown’s temporary restraining order.

As we wrote previously, President Trump will eventually win this battle for the reasons we outlined (um, paging Justice Gorsuch, paging Justice Gorsuch – time to bitch-slap the Ninth Circus clowns!). The good news in all this is that as of today the newly confirmed Attorney General Jeff Sessions is on the job and ready to help President Trump.

So what happens now? There are essentially two options: Option 1: ask Justice Kennedy for a stay from the TRO, which we suspect Justice Kennedy would grant and then continue to slog it out in the courts until reinforcements arrive to support President Trump in the Supreme Court. Option 2: go full tilt political on this and burn down the liberal Ninth Circuit – holding these leftist loons responsible if their stay of President Trump’s order leads to any harm to this country – and going to the country to denounce the leftist loons.

Big Media has already declared President Trump is on a “collision course” with the left and that includes the leftist loons in the judiciary so this is just sauce for this strong leader. President Trump has a strong case to make to the American people on immigration and the American people agree with President Trump:

Fifty-five per cent of registered voters support Trump’s travel ban affecting seven Muslim-majority countries. The same number approve of his plan to deny federal funds to cities that shield illegal-immigrant criminals from deportation.

The numbers come from a new Morning Consult poll conducted for the Washington, D.C.-area Politico newspaper.

Also winning the approval of an American majority is the president’s demand that bureaucrats freeze new federal regulations until his administration can review them and assess their impacts. That measure has 54-percent approval. [snip]

The remaining eight executive orders in the new poll won support from between 46 and 49 per cent of registered voters.

None of them is ‘under water’ – political-speak for having more disapproval than approval.

What Do Europeans Think About Muslim Immigration?

There is evidence to suggest that both Trump and these radical right-wing parties reflect an underlying reservoir of public support.

Drawing on a unique, new Chatham House survey of more than 10,000 people from 10 European states, we can throw new light on what people think about migration from mainly Muslim countries. Our results are striking and sobering. They suggest that public opposition to any further migration from predominantly Muslim states is by no means confined to Trump’s electorate in the US but is fairly widespread.

In our survey, carried out before President Trump’s executive order was announced, respondents were given the following statement: ‘All further migration from mainly Muslim countries should be stopped’. They were then asked to what extent did they agree or disagree with this statement. Overall, across all 10 of the European countries an average of 55% agreed that all further migration from mainly Muslim countries should be stopped, 25% neither agreed nor disagreed and 20% disagreed.

Majorities in all but two of the ten states agreed, ranging from 71% in Poland, 65% in Austria, 53% in Germany and 51% in Italy to 47% in the United Kingdom and 41% in Spain. In no country did the percentage that disagreed surpass 32%.

Public opposition to further migration from Muslim states is especially intense in Austria, Poland, Hungary, France and Belgium, despite these countries having very different sized resident Muslim populations. In each of these countries, at least 38% of the sample ‘strongly agreed’ with the statement. With the exception of Poland, these countries have either been at the centre of the refugee crisis or experienced terrorist attacks in recent years. It is also worth noting that in most of these states the radical right is, to varying degrees, entrenched as a political force and is looking to mobilize this angst over Islam into the ballot box, either at elections in 2017 or longer term.

President Trump did not issue a Muslim ban, but it would appear that as a political argument, it is a strong one.

Option 1 or Option 2? With this violation of the separation of powers doctrine, three clowns in the Ninth Circus have opened a war on the executive branch. The notion, as today’s decision states, that Washington state has standing in this suit because some of its students are inconvenienced is an appalling standard. The notion that these judges get to decide, however disguised, on the wisdom of the President’s policy instead of strictly on the law and presidential authority is a casus belli. The Ninth Circus has declared war on President Trump so President Trump is justified if he decides to go all out war as well.

Option 1 or Option 2? Which will President Trump choose? Perhaps a combination of Option 1 and Option 2: a fight in the court system and the court of public opinion? You betcha, in all caps:

Devos, Immigration, Filibuster: President Trump’s New Theme Song

There’s a new song in town. The mocking “You Can’t Always Get What You Want” was Donald J. Trump’s campaign theme song. The defiant “Heart of Stone” as in “you’ll never break” heralded the beginning of the Trump years at the inauguration. Now there is a new President Trump theme song which demonstrates the difference between Barack the Boob compared to get-it-done Don.

Today, Betsy Devos is the new Secretary of Education after the latest 24 hour prank by Obama Dimocrats intent on denial. Tomorrow Jeff Sessions will be confirmed as the new Attorney General to head the Department of (finally!) Justice. Tonight there will be courtroom antics on the West Coast regarding President Trump’s “extreme vetting” of passengers from a bunch of “terrorist friendly” countries. Four of these countries are so debased they don’t even have American embassies due to lack of security.

Later in the month there will be further filibuster antics by Obama Dimocrats to block President Trump’s choice, Neil Gorsuch, from the Supreme Court. This spasm of “resistance” by the deluded Obama Dimocrats will also fail.

This week though, the attention will be on the President Trump temporary “travel ban” to Make America Safe Again. While others chew on their toe nails with worry, we’ll be dabbing some color on our fingernails. Why? Because no matter what happens today or tomorrow President Trump will win all these fights. We’ll lay it all out below. But first, let’s listen to that new President Trump theme song because it explains so much about why Barack the Boob failed while President Trump is all success:

Yeah, time is on Trump’s side, yes it is. And don’t think for a second that President Trump doesn’t know it.

Barack the Boob ran for president having done nothing but self advancement in his life. Barack the Boob was a lost boy when he was inaugurated. Barack the Boob was entirely befuddled as to how to run the vast American government because Barack the Boob had never run any business or large organization. Never. During the campaign Barack the Boob tried to sell the notion that his campaign was a vast enterprise and Barack the Boob staked his silly claim to experience running a large enterprise on his campaign! It was a silly claim. Barack the Boob proved just how silly, the moment he bungled the oath of office and continued giving speeches after he occupied the White House.

Barack the Boob never ran a large enterprise so he did not know what to do other than invite sports and movie stars to the White House. Consider the dire consequences if Barack the Boob had known what he was doing.

All that immigration stuff he tried to do at the end of his term might have succeeded if Barack the Boob had done it earlier in his term and known what to do. That broken filibuster on lower court judges would have been so much more successful if the filibuster had been broken early in Barack the Boob’s term. On issue after issue, Barack the Boob struck too late, too stupidly, and therefore failed. Obama failed because he should never have been president due to lack of experience, lack of love of country, lack of a coherent world view.

President Trump will not fail. President Trump knows how to run a vast enterprise so he will not fail. Neil Gorsuch will be the next Supreme Court justice. President Trump and the Senate Republicans won’t even have to get rid of the filibuster to confirm Neil Gorsuch, as has been discussed in our comments section. For those interested in the details of how to confirm Neil Gorsuch without getting rid of the filibuster Sean Davis explains the back and forth of Senate rules, particularly Rule 19.

There is no need to get rid of the filibuster in the Senate. The Republican Senate can get rid of the filibuster if it so chooses. Our advice, which echoes President Trump, is a quote from Shakespeare: If it were done when ’tis done, then ’twere well, It were done quickly. In other words, if ya gotta do it, do it fast. If the Republican Senate is to get rid of the filibuster they might as well get full advantage of it for the next eight years at least (and it will still pay dividends under President Pence). The sooner it is done, the greater the chances of success in later initiatives, and the greater the chances of electoral victory. In other words, a virtuous circle.

If the filibuster falls on Supreme Court nominees just be aware that it is very likely that the entire filibuster, for every issue, is likely dead also. As we wrote previously, the Obama Dimocrats are in full “resistance” mode and will continue their Barackesque petulance and temper tantrums until they wake up in 2019 to Republican supermajorities in the Senate and Supreme Court. The looming disaster is what even Rahm Emanuel is “chill pill” warning Obama Dimocrats about today.

No amount of Obama Dimocrat “resistance” will block Neil Gorsuch from the Supreme Court. Likewise, West Coast “resistance” court antics will not stop President Trump from ultimate victory.

The tomfoolery on the West Coast will end in a President Trump victory. At some point it will all wind up in the Supreme Court and President Trump’s current appointee Neil Gorsuch and later appointees will eventually make it to the Supreme Court. President Trump will prevail.

We’re not going to waste time here with detailed discussions of the West Coast court antics. Byron York has done a masterful job of that already:

That the judge in Seattle even asked the question was entirely inappropriate and demonstrates the political, not legal, nature of the temporary injunction he ordered against President Trump’s immigration order. The duty of the court is to determine whether or not President Trump has the authority, not the wisdom of the order. The judge, by his question, proved he is biased against President Trump’s legal order.

Likewise, the Ninth Circuit will be biased against President Trump and will likely rule against President Trump. Then it will likely all go to the Supreme Court which is currently split 4-4 so the Ninth Circuit order will probably rule the day. But it won’t matter. It just won’t matter. Time, is on Trump’s side, yes it is.

Assume all the worst. Assume the Ninth Circuit rules against President Trump. Assume Justice Kennedy refers the entire matter to the full court instead of granting a stay all on his own. Assume the Supreme Court is deadlocked so that the Ninth Circuit leftist loons prevail. Assume the West Coast “judge” issues a preliminary then permanent injunction against President Trump’s immigration order. Assume all the worst, that the courts will not care about the law but instead about their “feelings” and political views. Assume all the worst. It won’t matter. It just won’t matter. Time, is on Trump’s side, yes it is.

Once Neil Gorsuch is on the Supreme Court, President Trump can try again. Once the next justice appointed by President Trump is on the Supreme Court, President Trump can try again. All President Trump has to do is file a slightly altered executive order and the whole process will begin again. Except, the next time, the Supreme Court will be at full Trump. President Trump eventually wins on his immigration executive order because President Trump is correct on the law.

The losers in all this will be the American people and the Obama Dimocrats. The American people will be made less safe. At some point the terrorists flooding into the country because of the West Coast leftist court loons will attack. Who will benefit? President Trump. President Trump will be able to point at the Obama Dimocrats and the leftist loons in the court system and denounce the blood on their hands. Time is on Trump’s side, yes it is.

There are other losers. Silicon Valley. The technology companies have come out in oppostion to President Trump. They have intervened in the courts and filed amicus briefs against President Trump’s order. They will regret it:

President Donald Trump’s clash with Silicon Valley over immigration is about to become even more contentious.

After the new president banned refugees and travelers from seven predominantly Muslim countries, Google, Facebook, Salesforce, Microsoft and others railed against the move, saying it violated the country’s principles and risked disrupting its engine of innovation. Trump’s next steps could strike even closer to home: His administration has drafted an executive order aimed at overhauling the work-visa programs technology companies depend on to hire tens of thousands of employees each year.

If implemented, the reforms could shift the way American companies like Microsoft Corp., Amazon.com Inc. and Apple Inc. recruit talent and force wholesale changes at Indian companies such as Infosys Ltd. and Wipro Ltd. Businesses would have to try to hire American first and if they recruit foreign workers, priority would be given to the most highly paid.

Our country’s immigration policies should be designed and implemented to serve, first and foremost, the U.S. national interest,” the draft proposal reads, according to a copy reviewed by Bloomberg. “Visa programs for foreign workers … should be administered in a manner that protects the civil rights of American workers and current lawful residents, and that prioritizes the protection of American workers — our forgotten working people — and the jobs they hold.”

Technology companies on the West Coast want to protect their profits, not American workers. That is the source of the “resistance” to President Trump from the technology oligarchs.

Again, they will rue the day they opposed American workers and President Trump. Time, is on Trump’s side, yes it is.

It is possible that President Trump could prevail in the Ninth Circuit. We’ll light a sparkler if the Ninth Circuit does the right thing. Justice Kennedy could also issue a stay all on his own if the Ninth Circuit stays on it’s leftist lunacy, and we’ll light the same sparkler in that event. Mostly, we’ll yawn. Eventually, as we wrote earlier, Trump prevails:

Trump is stronger than national polls suggest

President Trump is still popular in core Republican strongholds, even though he has suffered a dip in the national public opinion polls.

Trump’s approval rating is 45 percent, an underwater mark previously unseen for a president this early in his first term. But Trump’s image and his policies are holding up just fine among voters in Republican districts and states key to the president’s ability to drive his agenda through Congress, and his party’s success in 2018. While his national numbers aren’t good, Trump is much stronger in the states that could decide the outcome of the midterm elections, according to Republican operatives who have reviewed polling produced since New Year’s Day. For now, that suggests Democrats are less likely to benefit from the president’s struggles nationally than has been the case in past election cycles.

Like Trump’s loss of the national popular vote, Republican operatives say the president’s high disapproval numbers are being driven by dissatisfaction with his leadership in progressive, high-population metro centers, like Chicago, Los Angeles, and New York.

The midterm elections, however, are going to be fought on Senate battlegrounds that include red states like Missouri and West Virginia and swing states like Ohio, Pennsylvania and Wisconsin — all won by Trump.

Every day, while Rahm orders “chill pills” for Obama Dimocrats, President Trump continues to work and win. Did we mention this is only week 3 of President Trump? There are several hundred weeks to come. Every day President Trump pulls out a win, like a super human Tom Brady.

As we end President Trump first term week 2 – Obama Dimocrats are all hyper crazy all the hyper time now with their ceaseless, senseless, tactical tricks against President Trump. This nuclear bomb(s) we speak of is not the “nuclear option” Republicans might use to confirm President Trump’s first Supreme Court Justice. This nuclear bomb we speak of is not imminent. But the double nuclear bomb attack against the Obama Dimocrat Party is coming like a terrible swift sword. We explain below.

Consider the madness that seized the Japanese people in the 1930s. Japan’s military leaders, political leaders, royal family, and much of the population went collectively insane. The madness continued from expansion, invasions, and several months of some success. Then in quick succession – Pearl Harbor, Midway, MacArthur’s return to the Philippines, island hopping, Okinawa, and then the beginning of the American attacks on the Japanese home islands.

The Japanese people, military hierarchy, political establishment, and Emperor, remained defiant through every defeat and the pending invasion of the homeland itself. Then came the sky blistering nuclear attack on Hiroshima. Nothing changed. The Japanese population and establishment remained defiant.

Then came the second nuclear barbecue of the city of Nagasaki. Only then, only then, did the Emperor, for the first time ever, address his people and declare the singular path whereby Japan could survive was by “enduring the unendurable and suffering what is unsufferable.”



Think about all that. All that suffering, all the future of suffering, all the present suffering, yet the collective madness was unabated as the Japanese people dug ditches around their towns and prepared for house-to-house fighting against the American might. It was only after contemplating the nuclear destruction of Kyoto, Tokyo, and every city and industrial center was inevitable that the madness abated and the Japanese people collectively returned to their senses.

It took all that for the Japanese people to accept reality and the shattering of their delusions. That’s why we are not surprised at the madness exhibited these days by Obama Dimocrats. It will take the political equivalent of nuclear attacks on Hiroshima and Nagasaki for Obama Dimocrats to accept reality.

The madness of the Obama Dimocrats took years to fully develop. We charted the course of the insanity in our long running series “Mistake In ’08” and “Situation Comedy“. Like the Japanese people in the 1930s the Democratic Party by 2008 was seized with a delusion, fueled with Hopium and deluded dreams of a permanent majority, based on racist delusions about minorities and white people. Defeat after defeat, which started in 2009 and continued through 2014, and then the cataclysm of November 2016 has not brought the Democrats to elusive sanity. We know when the madness will break.

For the present everyone on the left, right, and center, should understand that the leftist Obama Dimocrat insanity will continue unabated. Indeed, our diagnosis indicates that the fever swamps will only continue to grow, the madness will be ever more stark, and that we have not yet witnessed the Obama Dimocrat peak crazy. Evidence?

Only an insane collective injected with mind-bending Hopium would have re-elected Nancy Pelosi to the House minority leadership after yet another defeat; only an insane crew would have New Yorker Chuckie Schumer lead the Senate minority after another New Yorker just lost the fight for national leadership; only an insane clown posse would consider a black Muslim to chair their party after an election that featured the loss of senior citizens, white women, and the white working class – all of which once not so long ago were the foundation rock of the winning Democratic Party.

So when will the fever of madness break? It’s going to take a long while.

Before we continue with our diagnosis, and tell you when the Obama Dimocrats will face the Hiroshima and Nagasaki that will force them back to reality, let’s look at some of the symptoms exhibited by the patient.

The Obama Dimocrats in the U.S. Senate refuse to meet with President Trump’s nominee to the U.S. Supreme Court. Do they really think this helps them? Do they really think that their pique at the Republicans who refused to meet with Obama’s last gasp candidate somehow helps them gain high moral ground at the beginning of the eight years of Trump? Do the Obama Dimocrats even understand that their tactical ploy has already failed because of the next election?

There’s even more dumb. The latest plan not to shake germaphobe Trump’s hand at the State of the Union speech will only provide President Trump a clear visual argument of his literally reaching out to Dimocrats only to be refused. The additional scheme to load the audience at that telecast speech with people who will make President Trump “uncomfortable” is a retread of the Hillary “Mark Cuban” tactic to “unnerve” candidate Trump at the debates – which did not work. This bit of stupidity will also result in President Trump seeding the audience with mothers of children killed by illegal immigrants, as well as Latinos and law enforcement killed by Muslim terrorists.

The left wing intelligentsia is stark raving mad too. There are those who crave their destruction and don’t “fear” the nuclear option the Republican senate will deploy if that is what it takes to confirm President Trump’s first Supreme Court Justice. Somehow these geniuses don’t understand that the earlier in President Trump’s term that the nuclear option is deployed the longer President Trump and the Republicans will have the advantage to force through their agenda. But Obama Dimocrats are so crazed they want to force a fight at a point when they are at their weakest and President Trump is just beginning to exercise his mighty political muscles.

As one Trump-hating Obama Dimocrat observed during his Trump-hating diatribe about President Trump: It’s almost like he knows what he’s doing.” As this Trump-hater observes:

The Democratic Party faces a two-headed problem. Its base doesn’t trust its leadership, and so when the leadership says this isn’t the hill to die on, they suspect betrayal. But that same base is too inefficiently distributed to win a close national election. The Democrats have to find ways to expand their coalition while simultaneously convincing their base that they can be trusted.

Whether by instinct or through good advice, Trump has hit on a perfect move to frustrate that goal.

Obama Dimocrats should acknowledge that indeed, President Trump does know what he is doing. Some Trump-haters even understand that the Obama Dimocrats have destroyed themselves by moving beyond the left into the abyss of political psychiatric lunacy:

This is right now the key division in the Democratic Party. The activist left, emboldened by Hillary Clinton’s failure, wants Schumer and company to look weak so politicians more allergic to compromise can replace them. They are joined in this effort by less-crafty new arrivals to the Party, folks who have never much cared for serious politics but are disgusted by Trump’s win.

Together, they want more protests, more fights, more disruption. They’re looking to break stuff, and for some that is an end in itself.

The Obama Dimocrats, like the Japanese in the 1930s, have lost their collective minds.

So back to our diagnosis as we track the course of the insanity that afflicts Obama Dimocrats. When will this feverish madness end?

Some on the right foolishly and mistakenly believe the madness will break during the Supreme Court confirmation fight for soon-to-be Justice Gorsuch. Some on the right, not understanding Obama Dimocrats, foolishly don’t understand the political battle as they concoct wild theories about why the filibuster won’t be deployed against soon-to-be Justice Gorsuch. These are dangerous delusions. The left is not even near full madness.

Is there a chance that Obama Dimocrats will come to peace, sit down amongst themselves, make a rational assessment of their “Mistake in ’08” and devise a return to the FDR political party before the Obama collective madness? No, the fever madness will rise to levels not seen since Fort Sumter. To continue with our World War II Pacific Theater terminology to diagnose the present phase of the collective malady of today’s Obama Dimocrats, this period of our history is akin to the “island hopping” course of the war, which culminated in the invasion of Okinawa.

The Obama Dimocrat fever madness will reach it’s peak when President Trump nominates his second Supreme Court pick which replaces one of the left-wingers on the court or Justice Kennedy, the “swing” vote on the high court. At this point Obama Dimocrats will be horror movie “walking dead” level characters completely detached from anything which can be described as “reality” even in the quanta universe.

Once the second Supreme Court Justice is on the high court, and Republicans dominate the high court 6-3, will the Obama Dimocrat madness stabilize and the trip to sanity begin? No. This, to return to our World War II Pacific Theater terminology, will be the Hiroshima bomb that begins to tear through the matrix of Obama Dimocrat madness. It will only be the beginning of the end.

Still the madness will persist. The delusions will not be shattered. The commitment to “Resistance” will continue unabated.

Then, and only then, will the Nagasaki bomb drop and the radioactive mushroom cloud of reality will kill the Obama Dimocrat madness.

What is that Nagasaki bomb that breaks the “Resistance” much like the Japanese resistance was broken? The 2018 elections. Only after Obama Dimocrats, after the November 2018 congressional elections, wake up to see the devastation of what their Obama madness has wrought will the fever break. Only then.

Only after the Supreme Court has 6 or 7 Republican Justices, all young, prepared to remain on the court for decade after decade after decade – only after Republicans maintain control of governorships and state legislatures and continue to make inroads into municipal governments, – only after the House of Representatives continues to grow its Republican majorities, – only after the 2018 elections result in well over 60 Republican senators, – will the Obama Dimocrat fever of madness break. Only then. That will be Nagasaki. That will be when the “Mistake in ’08” will be acknowledged even in the padded cells of the DNC.

Then, and only then, will Obama Dimocrats return to sanity. Then, and only then, will they have to acknowledge how correct our analysis has been since 2007. Then, and only then, will they wake up surrounded by ashes, to endure the unendurable and suffer what is unsufferable – the return to sanity from the Obama years.

It’s only week two of the Trump Revolution and the patriots are happy. For the Kooks it feels like the end times Apocalypse Superbowl. We’ve seen this before. Should we snoop around and get the score? Yeah! Put your shoulder-pads and girdles on – we’re going in.

The game is just about to begin. The playing field is packed. The players are in uniform. There’s a guy as big as a quarterback, but he’s too fat. He’s eating quarter-pounders from McDonalds.

Let’s listen to this big fat nut on the playing field spouting gibberish:

Michael Moore to Dems: Block Gorsuch or face primaries

Liberal filmmaker Michael Moore on Wednesday threatened any Senate Democrats who do not block President Trump’s Supreme Court nominee with primary challenges in their next election.


That’s loser talk.

Now, there’s a tight-ass talking to quarter-pounder. We think it’s his not too tight rear end:

Sen. Jeff Merkley (D-Ore.) has vowed to filibuster any nominee from Trump, meaning Gorsuch would require 60 votes under current rules.

Coming in from the goal thing-a-majigs is one of the blockheads who must be drunk on krank Gatorade cause he’s saying a lot but not making much sense. We suspect he’s been hit on the head a lot:

Democrats must fight it to the bitter end. The preservation of the final, tattered remains of American constitutional government demands it.

This has nothing to do with Gorsuch as a nominee. On first assessment, there is no doubt he is eminently qualified, perhaps more so than several other sitting justices were at the time of their nomination. He has done it all. His legal education is first-rate, with a law degree from Harvard and a doctorate in jurisprudence from Oxford. He has seen up close how the Supreme Court works, serving as a clerk for Justice Byron White and then Justice Anthony Kennedy. For more than a decade, he has served as a judge on the U.S. Court of Appeals for the 10th Circuit, where he has gained a reputation as someone committed to the rule of law. He is a member of the federal Advisory Committee on Appellate Rules. [snip]

The end game: Force Trump to renominate Garland.

Wut???? As we back away… real slowly, from this guy… who has obviously been hit one too many times on his head, we bounce off of fatso, still eating quarter-pounders. Yikes! Does this guy ever stop eating?

Another blockhead approaches us from behind the tight rear end. This one is a real doozy. From the looks of his face, this guy has been hit a lot of times right in the kisser. Shutting our eyes and then looking down at the field, we listen to the mad ravings of this running hack:

Yes, blocking Gorsuch would likely be just a symbolic gesture, given that his bona fides as a fairly typical right-wing jurist will likely see him confirmed, possibly with even a few Democratic votes.

So is it worth losing the filibuster, with its supermajority requirement, over him? After all, three of the five justices who keep Roe v. Wade alive are about a decade older than the Golden Girls during their last season on NBC. And if the vacancy helped Trump win, wouldn’t it be a bad idea to focus on this, given that nine of the 10 swing state Senate elections in 2018 take place in states Trump won?

Now you’re thinking like a Democrat.

Um, ugh, yeah… back away real real slowly from this half wit. He’s not thinking at all. Something’s wrong with him. He’s not only two french fries short of a happy meal… he’s the owner of Chock-full-O’-nuts.

After dunking our heads for a while in a bucket of cold water, as the fat guy is sniffing around looking for more quarter-pounders to suck in, we notice it is half-time and the half-time show is on. What a relief! An hour away from the rear end, the quarter-pounder, and the running hack, is time we need to recover from the kookarama.

Director Judd Apatow Supports Far-Left Berkeley Riot, Warns ‘This is Just the Beginning’

Hollywood director, writer, and producer Judd Apatow warned conservatives on Twitter that last night’s riot at UC Berkeley was “just the beginning,” adding: “When will all the fools who are still supporting Trump realize what is at stake?”

Apatow, who directed The 40 Year Old Virgin, Trainwreck, and Knocked Up, made the threatening tweet after far-left “anti-fascist” rioters assaulted numerous attendees, started fires, smashed up shops and ATMs, and attacked people’s cars at Breitbart Senior Editor MILO’s UC Berkeley show on Wednesday.

The half-time show gets worse as another “entertainer” takes the spotlight:

Even the left acknowledged that video was a sort of tone-deaf singalong that inadvertently affirms criticism that movie stars may indeed be out of touch with regular people.” Well, here he comes… we guess he did survive. Wonder what new insights this “entertainer” will provide at the half-time Kookarama Superbowl Apolcalypse? Shush… here he is:

Matthew McConaughey is urging his fellow Hollywood actors to “embrace” President Trump. [snip]

In an interview with the BBC’s “Andrew Marr Show” this week, host Andrew Marr compared the characters in McConaughey’s new movie “Gold” to “not Trump’s America, but this is small-time, central redneck America sticking one up to the snotty East Coast and the elites.”

He then asked McConaughey if it was time for Hollywood to give the president a break.

“They don’t have a choice now,” McConaughey answered. “He’s our president. It’s very dynamic and as divisive of a time and inauguration as we’ve had, at the same time, it’s time for us to embrace. Shake hands with this fact, be constructive with him over the next four years.” [snip]

“Even those who most strongly may disagree with his principles or things he’s said or done — which is another thing, we’ll see what he does compared to what he has said — no matter how much you disagreed along the way, it’s time to think how constructive can you be. Because he’s out president for the next four years, at least,” he said.

Wow! Well, that blew our mind. The fat guy is still eating quarter-pounders and now looking at Matt like a sausage sandwich with gravy on it.

We figure we better run while the running is good. Forget the rest of the Kook Apocalypse Superbowl. Sneaking out we run into a guy in uniform with a measuring tape. He’s building a wall:

DHS secretary: Border wall should be finished in two years

MCALLEN, Texas – EXCLUSIVE: In his first television interview as Homeland Security secretary, retired four-star Marine Gen. John F. Kelly told Fox News he wants the U.S.-Mexico border wall finished in two years – setting an ambitious schedule for the project ordered last week by President Trump.

The wall will be built where it’s needed first, and then it will be filled in. That’s the way I look at it,” Kelly said. “I really hope to have it done within the next two years.”

Two years only and the wall, that great big beautiful wall will be built. If poet Robert Frost is correct that “good fences make good neighbors” imagine what good neighbors a great big beautiful wall will make.

#SCOTUS Scalia Smiles: President Trump Nominates Neil Gorsuch To Supreme Court To Cage The Commerce Clause

It’s the Commerce Clause, stupid. It’s also about the immense vastness of Donald J. Trump’s election victory. The nomination of Neil Gorsuch to the Supreme Court by President Donald J. Trump will be remembered as the brave and transformational moment it is.

Small minds will talk about abortion, the second amendment to the Constitution, religious liberty, and all their pet causes. But the nomination of Neil Gorsuch is greater than all that.

Shortly after the November presidential election we proposed that “The Vastness Of The Trump Revolution Is Immeasurable“:

Archimedes postulated that if he had a lever long enough and firm ground underneath he could move the world. In that spirit we note that if we had a measuring tape that could circumnavigate the political world it would fall short of measuring the immeasurable Trump triumph of 2016.

That’s where we are right now.

Ten days ago our comments section noted an article about Neil Gorsuch with the speculation “This will likely be the next Justice to the Supreme Court.”

The article from SCOTUSblog (which we suggest reading in full) discussed Neil Gorsuch, how smart he is, how he is Scalia-like in his writing and wit, personal details, his employment history, his jurisprudence, etc. But we honed in on what matters, what really really matters:

Another area of the law in which Gorsuch has shown both his writing talent and his similarity to Scalia is in the application (and critique) of doctrines surrounding the so-called “dormant commerce clause.” These doctrines treat the commerce clause not only as a grant of power to Congress to make laws regulating interstate commerce, but as a kind of presumptive limitation on the power of states to make laws that either unduly burden or unfairly discriminate against interstate commerce, without regard to whether Congress has ever passed a law in the relevant area. Because — as its name suggests — the dormant commerce clause cannot actually be found in the text of the Constitution, Scalia eventually came around to the view that it should not be a thing, and refused to endorse any future expansions of the doctrine. For example, in 2015, in a dissenting opinion in Comptroller v. Wynne, Scalia stated: “The fundamental problem with our negative Commerce Clause cases is that the Constitution does not contain a negative Commerce Clause.” Although a court of appeals judge lacks the same freedom to disparage and/or depart from existing Supreme Court precedent, Gorsuch’s opinions also reveal a measure of distrust towards unwritten constitutional provisions like the dormant commerce clause.

For example, a 2015 10th Circuit decision written by Gorsuch, Energy and Environment Legal Institute v. Epel, declined to apply the dormant commerce clause to strike down a clean-energy program created by Colorado on the grounds that it might negatively affect traditional energy producers outside the state. The opinion explains that this result is consistent with the limited reach of the dormant commerce clause’s “judicial free trade policy” even under existing precedent. But while acknowledging that lower courts must take the Supreme Court’s doctrine as they find it, Gorsuch’s opinion shows respect for the doctrine’s “[d]etractors,” like Scalia, who “find dormant commerce doctrine absent from the Constitution’s text and incompatible with its structure.” Though Gorsuch’s personal constitution seems to require him to write clearly about the many unclear aspects of the doctrine, his opinion plainly takes some joy in the act of demonstrating that not only does the dormant commerce clause not apply — the doctrine also doesn’t make much sense. That same instinct is present in a prominent concurrence last year in Direct Marketing Association v. Brohl, in which Gorsuch singled out one aspect of dormant commerce clause doctrine—the Quill rule that exempts out-of-state mail order sales from state sales tax—as an “analytical oddity” that “seems deliberately designed” to be overruled eventually. This opinion aligned him with Justice Anthony Kennedy (who has called for overruling Quill), and again with Scalia, who identified Quill as part of the “bestiary of ad hoc tests and ad hoc exceptions that we apply nowadays” under the dormant commerce clause.

The dormant commerce clause isn’t a particularly hot-button issue, nor does it have obvious liberal/conservative fault lines. But it’s noteworthy that criticism of the dormant commerce clause is of a piece with criticism of the “right to privacy” that undergirds the Supreme Court ‘s abortion jurisprudence, as well as other judge-made doctrines that do not have a strong connection to the constitutional text. Again, Gorsuch’s opinions seem to follow the lead of textualists and federalists like Scalia in expressing great skepticism towards such doctrines, which allow judges to strike down duly enacted local laws on the basis of vague principles that cannot be found in the concrete text of the national charter.

The first step will be to destroy the dormant Commerce Clause. The second step will be to greatly trim the entire Commerce Clause which has been used by the federal government to claim jurisdiction over just about anything. That’s the meaning in full of the Neil Gorsuch nomination.

The nomination of Neil Gorsuch to the Supreme Court will bring real Niagara level tears, not fake tears to Obama Dimocrats. President Trump with this nomination attempts to be what lazy Barack Obama wanted to be: transformational.

In the coming weeks there will be lots of strategies and tactics deployed around this Supreme Court nomination. President Trump will develop a courageous strategy and deploy smart political tactics to this fight. The Obama Dimocrats will only have tactics and chickens screaming as their heads are separated from their bodies, wings flapping in death.

President Trump has demonstrated immeasurable vastness of courage with his selection of Neil Gorsuch. This will be an epic battle for confirmation.

Trump could have selected Thomas Hardiman as his choice. Hardiman is conservative enough and his personal story (taxi driver to pay for college, first in his family to go to college) would have been hard for Obama Dimocrats to oppose, even though they would have. We suspect Hardiman would have moved to the left on the court and become another Souter. President Trump also could have selected William Pryor. Pryor is a staunch conservative but he also had problems on the right. Hardiman and Pryor would have faced a fight against Obama Dimocrats but nothing like what Neil Gorsuch will face.

Neil Gorsuch is young, willing, Oxford, and most able. He will need all his talents to accomplish the attack against the Commerce Clause which began and was then abandoned by the Rehnquist Court. All other sexy hot-button issues will be sub-issues to the great battle against the Commerce Clause.

It might not be sexy, but Neil Gorsuch, intends to trim the Commerce Claws, er Clause.
