WASHINGTON — The Supreme Court is letting the Trump administration enforce its 90-day ban on travelers from six mostly Muslim countries, overturning lower court orders that blocked it.
The action Monday is a victory for President Donald Trump in the biggest legal controversy of his young presidency.
Trump said last week that the ban would take effect 72 hours being cleared by courts.
The justices will hear arguments in the case in the fall.
The lower courts and their orders that overturned Constitutional government are the big losers on this one – right alongside their jihadist Muslim terrorist brethren. Trump wins bigly.
The Supreme Court will hear the case sometime in the fall, long after the Trump travel ban has expired. We fully expect that with this UNANIMOUS Supreme Court decision President Trump will win again (and again, and again) on immigration issues. Make America Safe Again!
The now-deleted story, by investigative reporter Thomas Frank, was published Thursday and cited a single, unnamed source who claimed that the Senate Intelligence Committee was looking into a “$10-billion Russian investment fund whose chief executive met with a member of President Donald Trump’s transition team four days before Trump’s inauguration.”
But by Friday evening, the story had vanished from CNN’s website. It was not immediately clear when the story was removed, but a tweet linking to the story, from CNN’s Politics account, was also deleted sometime Friday evening.
A source close to the network, who requested anonymity to discuss the matter, told BuzzFeed News earlier that the story was a “massive, massive [f***] up and people will be disciplined.” The person said CNN Worldwide President Jeff Zucker and the head of the company’s human resources department are “directly involved” in an internal investigation examining how the story was handled.

The Georgia 6th district race was not about the not very good candidate Karen Handel. Obama Dimocrats didn’t even really care about the voters of the Georgia 6th. Their candidate did not even live in the district. Their candidate ran in the primary by declaring “Make Trump Furious”. In the general election the Obama Dimocrat candidate ran almost as a Trump supporter in order to get votes. The Obama Dimocrats had bigger fish to fry other than the voters they despise.
The Obama Dimocrats targeted their $31 million terror campaign against the RINOs and the WHINOs.
The goal of the Obama Dimocrats was to separate President Trump from the GOP RINOs and whiners. The GOP RINOs and whiners (hereinafter WHINOs) wanted an excuse to run away from President Trump. The Obama Dimocrats know that the GOP establishment would like an excuse to run away from President Trump. So, the Obama Dimocrats calculated that if they spent tens of millions to defeat President Trump in a district he barely won, the GOP RINOs and WHINOs would stampede away from President Trump in pretend fear of losing their elections.
Obama Dimocrats did not count on President Trump trumping. Obama Dimocrats thought that President Trump would avoid mention of the GA6 race because President Trump would never want to get involved in a race that had everything against him. Obama Dimocrats had tens of millions, a young male candidate to attack a not so young woman, enthusiasm from the Obama Dimocrat left as well as the Bernie Sanders Socialist left, and Big Media and the rest of the party were all in to defeat the hapless Karen Handel who barely came in first in the crowded GOP primary.

Lessons? This election was essentially meaningless. The only lasting lesson from this election we can think of is one we wrote about years ago.

The big lesson for Obama Dimocrats is that if they can’t win in a district with lots of “high education” voters that don’t love President Trump even after they spend tens of millions of dollars to get a victory, they won’t win. If Trump voters stick with President Trump then the GOP leadership has to stick with President Trump and the 2016 elections are a rerun. Obama Dimocrats can’t get the voters they disparage daily.

Just how much will Trump factor into the outcome? The president has sent a flurry of tweets and robocalls supporting Handel’s campaign. But she’s also allied with other GOP leaders, including House Speaker Paul Ryan and Georgia Gov. Nathan Deal.
Ossoff has tried to hone in on Republicans frustrated with Trump. Mailers vow he’ll “stand up” to the president while he talks of how both parties are “complicit” in wasteful spending.
The reason for the dual-track messaging: He needs at least 10 percent, perhaps as much as 15 percent, of GOP voters to back him. And if he doesn’t win over enough GOP support, he might be in for a long night.
Ossoff’s Georgia Special Election Loss to GOP’s Handel Exposes Deep Fissures in the Democratic Party in the Trump Era
Democrats continued their special election losing streak on Tuesday as one of the party’s bright hopes, Jon Ossoff, lost his bid for a suburban Atlanta Congressional seat long held by Republicans—a painful defeat that highlights deep fissures in the party.
Democrats have lost every special Congressional election since President Donald Trump took office. In addition to the Georgia race, the party failed to pick up seats vacated by Republican House members who joined the Trump cabinet in Kansas, Montana and South Carolina, although they ran far ahead of their usual numbers.
The seat in Georgia was a tantalizing one for Democrats. Hillary Clinton only lost the district by 1 percent in the 2016 presidential race, and when Trump tapped Representative Tom Price to be his Health and Human Services Secretary, Democrats hoped they could win this seat for the first time since the 1970s. But Ossoff’s centrism alienated some progressives. Vermont Senator Bernie Sanders eventually endorsed him, but only after publicly questioning whether he was a true progressive. And some on the left never cottoned to a Democrat who stressed his fiscal conservatism. In the end, Ossoff lost the seat by six points, more than the margin in Tuesday’s congressional race in South Carolina to replace Mick Mulvaney, now Trump’s budget director. Speaking after her win, Handel said her first priorities in Congress will be finishing the GOP health-care bill and working to lower corporate and individual tax rates. [snip]
Underscoring the national attention on the race, Trump repeatedly chimed in on it multiple times leading up to the results.
In a Tuesday tweet that started with “KAREN HANDEL FOR CONGRESS,” Trump said she would “fight for lower taxes, great healthcare” and “strong security.”
As Handel won Tuesday, Trump tweeted that Handel did a “fantastic job” and said “we are all very proud of you.”
He later issued a comment on the overall result in both races that lauded a 5 -0 record in congressional races since his election.
Handel also thanked the president in her victory speech, prompting chants of “Trump!” from supporters.

As we recall how two years ago today, this website watched in awe, as the next President announced his run for president we remain in awe of the strength exhibited by the President every day. Today the same toughness that amazed us on June 16, 2015, is once again on display. Today President Donald J. Trump continues to dismantle the Obama legacy sh*thouse by sh*thouse. Also today, our analysis (see, Hiroshima/Nagasaki and More Special Prosecutors please), has been proven prescient and correct. Today, we have to take allies to the woodshed, give advice to one and all, and of course, gloat.

Because of the shooting of House GOP Whip Steve Scalise some Trump supporters delude themselves that maybe the leftist thugs will soften their “resistance” and stop their assassination dreams against President Trump. This belief that the left will relent is as we have stated before, a very dangerous delusion.
Before we critique the dangerously deluded, let’s fully explain what the left sees in the wake of the shooting of Steve Scalise. The left sees success. The left sees “Hope and change”. The left sees their anime dreams of assassination, political or somatic, about to be realized.
The only aspect of the Steve Scalise shooting the left regrets is that the leftist thug assassin did not accomplish his mission. To all those foolish, idiotic, dangerous dwellers in delusion, who have Pollyanna mindsets, get this through your thick heads: The left believes the shooting of Steve Scalise shows the way back to power and that the only problem with the plan was that only Steve Scalise was effectively neutralized, not the two dozen that would put Obama Dimocrats in charge.
After the attack, the office of Congresswoman Claudia Tenney (R-N.Y.) received an email reading “One down, 216 to go”. Congressman Tom Garrett (R-Va.) needed security after receiving threats reading, “This is how we’re going to kill your wife”. Other threats described graphic atrocities against his daughters and even his dog.
For the present everyone on the left, right, and center, should understand that the leftist Obama Dimocrat insanity will continue unabated. Some on the right foolishly and mistakenly believe the madness will break during the Supreme Court confirmation fight for soon-to-be Justice Gorsuch. Some on the right, not understanding Obama Dimocrats, foolishly don’t understand the political battle as they concoct wild theories about why the filibuster won’t be deployed against soon-to-be Justice Gorsuch. These are dangerous delusions. The left is not even near full madness.
The hysteria, I admit, has gone on far longer, and has been far more virulent, than I anticipated. I thought the insanity would dissipate quickly after January 20, when Donald Trump was inaugurated. Instead, it has accelerated, abetted by a scurrilous and irresponsible media and grandstanding Democratic politicians encouraged by their deep-state enablers. [snip]

Doubtless many of the blasts will come from James Comey’s very good personal friend (“brothers in arms”) Robert Mueller, recently appointed special counsel to investigate allegations of Russian involvement in the 2016 election. It’s conceivable that Mueller will be forced to recuse himself, but in the meantime, he is busy packing his investigative staff with Obama and Clinton loyalists. [snip]
Moreover, as Conrad Black argues in The National Interest, Trump is actually winning the war on Washington. His greatest problem, Black points out, is not “spurious charges or media hostility . . . but the cowardice of congressional Republicans.”

Success has a way of blotting out or at least marginalizing criticism. As Trump forges ahead, quietly racking up victory after victory, the yapping chihuahuas are going to appear more and more absurd to the public. Those pups are yapping, but as the old Arab mot puts it, the caravan is nevertheless traveling on. Forecast: 10% chance of crisis, 90% chance of sun.
That is exactly what President Trump is doing and the examples from today are many. Obama’s Cuba legacy is removed. Obama’s DAPA legacy is destroyed. ObamaCare is about to be destroyed. Obama’s lead from his behind policies which hurt America are likewise being destroyed.

Conservative Treehouse dreamed up some silly scenario, so bizarre that you can read and reread it and it still can’t be understood, not even by the initial commentors, about why Neil Gorsuch was a shoe-in and no filibuster would be deployed by Chuck Schumer. The “rationale” for such a bizarre conclusion was too silly to even explain in any reality-based way. The Conservative Treehouse “analysis”: “Senate Minority Leader Chuck Schumer will not filibuster the nomination. Relax, it’s 100%. 100%. Done.”
That Treehouse analysis is nutty as a squirrel’s sac. It did not get any better after Chuck Schumer confirmed that indeed, as we predicted, there will be a filibuster. After delusional theory #1 exploded, the Treehouse churned up some more nutty butter to spread which made as little sense as their first flub. It was something about Russians and… well… this latest theory was again too silly to give serious consideration to.
We explained back then to the Treehouse that for the leftist kooks stopping Gorsuch was THE fight. It wasn’t the next fight. The left understood that once Gorsuch was on the court the power to intimidate or collude with certain Republicans (hello McCain, Collins, Graham, Murkowski, Flake, Sasse, etc.) would be gone. For the left the analysis was that Gorsuch had to be stopped at all costs and that defeat of Trump on the Gorsuch nomination (to neatly supplement the House failure on ObamaCare) meant the left was in control, not the electorate or Trump. A defeat on Gorsuch would have meant that President Trump would have to get permission from the Obama Dimocrats for every Supreme Court nomination and indeed every nomination. For the Treehouse, the next fight was the big one. We pointed out the errors of that foolishness. In this case the leftist kooks, who constantly require judicial overreach to rule, had the correct analysis/strategy/tactics and the Treehouse was chock full o’ nuts.
Now the Conservative Treehouse is at it again. This time the delusions are more dangerous. This time the delusion is that Special Counsel Mueller and his Obama Dimocrat prosecutors are working alongside Deputy AG Rosenstein to clear President Trump of all charges!!! This is delusion! This is madness! This is all out nuts and dangerous to President Trump.

Somehow, the Conservative Treehouse believes that: James Comey is all evil and a mastermind who is terrified of Special Counsel Mueller because Mueller will expose Comey; Mueller is some sort of hero out to trap his long time friend Comey (the guy Mueller worked with on the Ashcroft mugging) in order to help President Trump and that indeed all those Obama Dimocrats Mueller has hired are hired to gull Comey and the Obama Dimocrats because hey, won’t those Obama Dimocrats be surprised when Obama Dimocrat prosecutors who worked for the Clinton Foundation and donated money to Hillary Clinton’s campaigns and other Obama Dimocrat campaigns exonerate President Trump; and yeah, President Trump is playing games and pretending to be upset with the Special Counsel because he somehow is in on a plot of collusion with Special Prosecutor Mueller and President Trump knows that Mueller will exonerate him but President Trump has to pretend to be upset so that his exoneration announcement by Mueller will be even more glorious when it comes on that glorious day; Vice President Pence hiring private lawyers to defend himself against the Special Counsel is somehow part of the plot to defeat Obama Dimocrats by hiring Obama Dimocrats; likewise hiring Jay Sekulow to waste his valuable time he could be spending on other issues is part of the collusion plot by Trump/Mueller; oh, and, um, believe it or not Mueller is not really investigating President Trump because Mueller’s real target is his long time friend and collaborator James Comey; all these collusions and camouflage ruses have entirely fooled and sent down the wrong path not only this website but Newt Gingrich, Sean Hannity, and Lou Dobbs.

The man that wrote the memo to President Trump which provided the many reasons to fire the FBI Director James Comey, is none other than Deputy Attorney General Rod Rosenstein. And guess what Ladies and Gentlemen, Rosenstein might be recusing himself:

Rep. Brian Schatz, D-Hawaii, asked Rosenstein specifically whether he might have a conflict of interest if he becomes a witness in the investigation.
“I’m not going to answer hypothetical questions,” Rosenstein said. “[But] I am working with career professionals who know these rules and are responsible for enforcing these rules, and I can assure you that we’re going to do the right thing, and we’re going to defend the integrity of that investigation.” [snip]
But inside his office in recent days, the deputy attorney general has been grappling with what to do about the expanding probe, and seething over news accounts laying out some of its details, according to one source.
Late last night, he issued what many online are calling a “bizarre” statement, condemning recent reports.
“Americans should exercise caution before accepting as true and stories attributed to anonymous ‘officials,'” Rosenstein said. “Americans should be skeptical about anonymous allegations. The Department of Justice has a long-established policy to neither confirm nor deny such allegations.”

A gunman in Alexandria, Va., fired scores of rounds at Republican lawmakers and aides who were practicing before the bipartisan Congressional Baseball Game, which was set to take place on Thursday.
GOP Majority Whip Steve Scalise (La.), an aide to Rep. Roger Williams (R-Texas) and others were wounded, according to multiple reports.
The tweet refers to the Public Theater’s New York current run of “Julius Caesar.” The actor playing Caesar is intended to resemble Trump with blondish hair, a two-piece suit with a long tie and an American flag pin.
The president’s son is among those who have questioned if art that is turned into “political speech” could affect its taxpayer funding after the Shakespeare in the park production.
The play followed on the heels of the public outcry when comedian Kathy Griffin posed in a photo shoot where she held a fake, bloody severed head that resembled Trump.
Scalise is undergoing surgery after being shot and he is said to be in stable condition, according to his office.

There are a lot of details. It was the security detail of Steve Scalise that returned fire on the leftist thug. If not for the fact that Steve Scalise is a member of the GOP leadership and therefore has a security detail, the leftist thug would have been in a free fire zone able to kill Republican congressional members and staff at will:

But according to Sen. Rand Paul (R-KY), who was there, it could have been far, far worse. Had Capitol Police not been there as part of a security detail for Scalise, Paul said in an interview with MSNBC, “it would’ve been a massacre.”
Paul explained that after the gunman fired 50 to 60 shots, hitting Scalise and others, he was eventually taken down by Capitol Police. But, he pointed out, those Capitol Police officers were only there in such force because Scalise himself — as Majority Whip, he is a member of the Republican leadership team who travels with a security detail — was present.
“Everybody probably would’ve died except for the fact that the Capitol Hill Police were there, and the only reason they were there is because we had a member of leadership on our team,” Paul said. “If Scalise wouldn’t have been on the team — unfortunately he was hit and I hope he does well — but also by him being there it probably saved everyone else’s life, because if you don’t have a leadership person there, it would’ve been no security there.”
He continued: “Because there’s no escaping a guy with — if he’s got several hundred bullets, and we had no weapons, and no place to hide. So if he would’ve advanced on the rest of us, there would’ve been no chance. The only chance we had was that the shots were returned by the Capitol Hill Police.”

Make the F.B.I. great again – arrest, prosecute, imprison James Comey. If Special Counsel Mueller does not immediately raid the homes and offices of James Comey and his partner in crime Daniel Richman (who has now fled the scene of the crime[s] in order to avoid interrogation by the authorities), to seize computers and other materials pertinent to his investigation, then Robert Mueller himself deserves to be investigated by a special prosecutor. Robert Mueller has a decision to make: stand by the law or by his long time pal the corrupt James Comey.
When Robert Mueller was appointed Special Counsel we celebrated. We celebrated because the more Swamp Deep State players come forth to attack President Trump openly, not from the shadows, the easier it will be to take down the Deep State “resistance” to a duly elected President. We wrote, “The more the political establishment swamp tries to destroy President Trump however, the closer they are to their own destruction.” This prediction is comeying truer and truer.
At the time we also declared, “We’re gonna need a special prosecutor to investigate the special prosecutor.” Ain’t that the truth!
We were wrong about one particular detail. We thought the leaker of the Comey memo was Comey crony Benjamin Wittes. We were wrong in that particular instance but Robert Mueller should question Wittes under oath (and seize his computers) to determine if Wittes conspired to leak on behalf of Comey previously.
Because of his self-confession we now know the illegal leaker was Former F.B.I. Director James Comey himself using a cutout crony from Columbia. What Comey confirmed is the extent of Deep State corruption and that we face an attempted coup by the Obama Dimocrat and GOP establishment Deep State against a duly elected President. Former Speaker of the House Newt Gingrich strikes all the necessary warnings about why we believe Special Counsel Mueller is a crony creep of clown Comey:
The most startling revelation from fired FBI Director James Comey’s testimony this week was his barefaced admission that he intentionally leaked details of his private conversations with the president to the press in an effort to prompt the appointment a special counsel.
When asked Thursday by Republican Senator Susan Collins of Maine whether he shared the memos he wrote about his conversations with President Trump with anyone outside the Department of Justice, Comey answered:
“I asked a friend of mine to share the content of the memo with a reporter – didn’t do it myself for a variety of reasons – but I asked him to, because I thought that might prompt the appointment of a special counsel.”
This statement is tremendously important because it completely delegitimizes Robert Mueller’s so-called independent investigation and reveals it as poisoned fruit.
Poisoned fruit of corruption. Robert Mueller must either prove himself via a raid of Comey’s hideouts and computers, as well as the deep holes of his crony friends and computers, or Robert Mueller himself must be viewed as corrupt.
Special Counsel Robert Mueller was appointed though the efforts of James Comey. James Comey wanted to interfere in the ongoing investigations by Congress and the F.B.I. So James Comey corruptly interfered with the investigations and thereby violated the law which prohibits interference with government investigations. Corruption. Jeff Sessions must intervene and demand the resignation of Robert Mueller and prosecution of Mueller and his leaker employment office pal James Comey.
Think about it: Comey was the top law enforcement officer in the nation before he was fired on May 9. Had he felt a special counsel was necessary to investigate possible Russian influence in the 2016 election, he could have requested one from Congress at any time. If he felt his conversations with President Trump warranted additional attention, he could have approached Deputy Attorney General Rod Rosenstein about it.
But instead he decided to do nothing. Comey apparently didn’t think there was need for a special counsel until the Monday after he was fired, according to his testimony.
In a clear act of retaliation, Comey went outside the system and shared secret information with the media via a college professor-friend, in a calculated attempt to inflict pain on the Trump administration. Further, he said he turned all his memos about his conversations over to the special counsel upon his termination – so Mueller’s investigators already had all they needed to make their own decisions.
But Comey knows that the press feed off attacking Trump. He also knows that they have an incomplete, false understanding of the Russia investigation and would therefore gladly perpetuate the false narrative that Trump was somehow under investigation. He saw a chance to cause drama, and he took it.
Yet this is the same person who on Thursday, under oath, exonerated Trump on the Russia question. Collins asked Comey two very direct, simple questions. She asked, “whether there was any kind of investigation about the President underway” and “was the President under investigation at the time of [Comey’s] dismissal on May 9?”
For both questions – under oath – Comey answered “no.”
Gingrich correctly announces the death of the “collusion” angle of the Deep State abuse of power against a duly elected President. Then Newt Gingrich goes for the kill:
But there’s another wrinkle in this story: Comey and Mueller are very close.
Throughout his testimony, Comey described Mueller as “one of this country’s great, great pros,” called him “the right person” to lead the Russia investigation, and said “Bob Mueller is one of the finest people and public servants this country’s ever produced. He will do it well. He is a dogged, tough person, and you can have high confidence that, when it’s done, he’s turned over all the rocks.”
When Senator John Cornyn asked whether anything Comey had testified would “impede the investigation of the FBI or Director Mueller’s commitment to get to the bottom of this,” Comey stressed that the appointment of Mueller was “a critical part of that equation.”
Let’s also not forget that 97 percent of campaign donations from Department of Justice employees went to Hillary Clinton in the 2016 election. The culture and people at DOJ are predisposed to be hostile to President Trump.
So, what we have here is a fired FBI director, who leaked private material to the press, so he could get his friend appointed as a special counsel in order to take retribution on the President – with the aid of a department full of federal lawyers who would have rather seen Hillary in the White House. And we are supposed to believe this will be an objective, unbiased investigation?
Comey’s testimony – and the situation he orchestrated around it – really show the depths to which the deep state will go – working around Congress, outside of even the federal process – to damage and undermine President Trump. And it perfectly illustrates how sick the system has become. [snip]
Make no mistake: This is not about law and order, it is not about justice, it is not even about any investigation. This is about influence peddling, this is about the search for vengeance, and this is about stopping the revolution President Trump was elected to implement.
This is everything that sickens normal Americans about the swamp.
America is on a knife’s edge. The question is now whether Republicans in Congress will have the courage to stand with President Trump and fight the deep state that was personified in Comey’s testimony Thursday.
The GOP establishment is in cahoots with the Obama Dimocrat Deep State opposition to a duly elected President of the United States. It is citizens who must stand up against the cowardly Comey cronies who strike from the protection of shadows.
The testimony of James Comey proved long on atmospherics and short on ethics. While many were riveted by Comey’s discussion of his discomfort in meetings with President Trump, most seemed to miss the fact that Comey was describing his own conduct in strikingly unethical terms. The greatest irony is that Trump succeeded in baiting Comey to a degree that even Trump could not have imagined. After calling Comey a “showboat” and poor director, Comey proceeded to commit an unethical and unprofessional act in leaking damaging memos against Trump.
Comey described a series of ethical challenges during his term as FBI director. Yet, he almost uniformly avoided taking a firm stand in support of the professional standards of the FBI. During the Obama administration, U.S. Attorney General Loretta Lynch gave Comey a direct order to mislead the public by calling the ongoing investigation a mere “matter.” Rather than standing firm on the integrity of his department and refusing to adopt such a meaningless and misleading term, Comey yielded to Lynch while now claiming discomfort over carrying out the order.
When Trump allegedly asked for Comey to drop the investigation of Michael Flynn or pledge loyalty, Comey did not tell the president that he was engaging in wildly inappropriate conduct. He instead wrote a memo to file and told close aides. He now says that he wishes he had the courage or foresight to have taken a stand with the president.
However, the clearest violation came in the days following his termination. Comey admits that he gave the damaging memos to a friend at Columbia Law School with the full knowledge that the information would be given to the media. It was a particularly curious moment for a former director who was asked by the president to fight the leakers in the government. He proceeded in becoming one of the most consequential leakers against Trump.
Comey said that he took these actions days after his termination, when he said that he woke up in the middle of the night and realized suddenly that the memos could be used to contradict Trump. It was a bizarrely casual treatment of material that would be viewed by many as clearly FBI information. He did not confer with the FBI or the Justice Department. He did not ask for any classification review despite one of the parties described being the president of the United States. He simply sent the memos to a law professor to serve as a conduit to the media.
As a threshold matter, Comey asked a question with regard to Trump that he should now answer with regard to his own conduct. Comey asked why Trump would ask everyone to leave the Oval Office to speak with Comey unless he was doing something improper. Yet, Trump could ask why Comey would use a third party to leak these memos if they were his property and there was nothing improper in their public release.
In fact, there was a great deal wrong with their release, and Comey likely knew it. These were documents prepared on an FBI computer addressing a highly sensitive investigation on facts that he considered material to that investigation. Indeed, he conveyed that information confidentially to his top aides and later said that he wanted the information to be given to the special counsel because it was important to the investigation.
Many in the media have tried to spin this as not a “leak” because leaks by definition only involve classified information. That is entirely untrue as shown by history. Leaks involve the release of unauthorized information — not only classified information. Many of the most important leaks historically have involved pictures and facts not classified but embarrassing to a government. More importantly, federal regulations refer to unauthorized disclosures not just classified information.
James Comey must be prosecuted by Special Counsel Mueller or Mueller will be incontrovertibly exposed as a Comey crony who owes his job to Comey and further exposed as a co-conspirator in a conspiracy to interfere in a federal investigation[s]. Turley correctly notes how Comey corruption taints the entire F.B.I.:
Comey’s position would effectively gut a host of federal rules and regulations. He is suggesting that any federal employee effectively owns documents created during federal employment in relation to an ongoing investigation so long as they address the information to themselves. FBI agents routinely write such memos in investigations. They are called 302s to memorialize field interviews or fact acquisitions. They are treated as FBI information.
The Justice Department routinely claims such memos as privileged and covered by the deliberative process privilege and other privileges. Indeed, if this information were sought under the Freedom of Information Act (FOIA) it would likely have been denied. Among other things, the Justice Department and FBI routinely claim privilege “inter-agency or intra-agency memorandums or letters which would not be available by law to a party other than an agency in litigation with the agency.” [snip]
Besides being subject to nondisclosure agreements, Comey falls under federal laws governing the disclosure of classified and unclassified information. Assuming that the memos were not classified (though it seems odd that it would not be classified even on the confidential level), there is 18 U.S.C. § 641, which makes it a crime to steal, sell, or convey “any record, voucher, money, or thing of value of the United States or of any department or agency thereof.”
There are also ethical and departmental rules against the use of material to damage a former represented person or individual or firm related to prior representation. The FBI website warns employees that “dissemination of FBI information is made strictly in accordance with provisions of the Privacy Act; Title 5, United States Code, Section 552a; FBI policy and procedures regarding discretionary release of information in accordance with the Privacy Act; and other applicable federal orders and directives.”
One such regulation is § 2635.703, on the use of nonpublic information, which states, “An employee shall not engage in a financial transaction using nonpublic information, nor allow the improper use of nonpublic information to further his own private interest or that of another, whether through advice or recommendation, or by knowing unauthorized disclosure.”
The standard FBI employment agreement bars the unauthorized disclosure of information “contained in the files, electronic or paper, of the FBI” that impact the bureau and specifically pledges that “I will not reveal, by any means, any information or material from or related to FBI files or any other information acquired by virtue of my official employment to any unauthorized recipient without prior official written authorization by the FBI.”
Had Comey taken the minimal step of seeking clearance, the department would likely have said that this was FBI information and not personal information. Comey instead decided to ask forgiveness rather than permission.
Comey is also subject to bar rules on releasing information inimical to the interests of his former employer. For example, under professional rule 1.6, lawyers need to secure authority to release information that “(1) reveal a confidence or secret of the lawyer’s client; (2) use a confidence or secret of the lawyer’s client to the disadvantage of the client; [or] (3) use a confidence or secret of the lawyer’s client for the advantage of the lawyer or of a third person.”
Comey actually showed both how to and how not to disclose such information. When Comey released the information, he knew that he was going to be called to Congress where he could disclose this information properly after giving the White House a chance to claim privilege. Instead, he decided to release the information early. Why?
Comey gave two equally implausible explanations. First, he suggested that he wanted to get the information to investigators. However, he knew not only that he was likely to testify but that these memos would inevitably be demanded by both congressional and federal investigators. Second, he said that he wanted to ensure the appointment of a special counsel. However on that Monday, many of us were saying that such an appointment was virtually inevitable. More importantly, he could have given the memos to investigators and properly laid the foundation for a special counsel.
The fact is that the leaking of the memos worked to the advantage of James Comey, not Robert Mueller. Comey was able to take over the narrative and news cycle after Trump had publicly belittled him and his record. Special counsels do not like leaks of this kind. It would have been far better for the special counsel (or Comey’s own former investigatory team and congressional investigators) to have the memos confidentially.
Um, didn’t James Comey lead an “investigation” swamp thing Lynch dubbed a “matter”, against Hillary Clinton for the very reason of mishandled government documents?
If we are to believe Jimmy Comey, he is a self-confessed coward. If we are to believe Jimmy Comey, Special Counsel Robert Mueller is a coward too. Special Counsel Robert Mueller has not seized computers from Comey and his Columbia crony. Special Counsel Rober Mueller is either a corrupt co-conspirator against a duly elected President or a coward – OR BOTH!
Former FBI Director James Comey is master operator on the Washington scene. That is the predominant impression I came away with from Comey’s testimony to the Senate Intelligence Committee yesterday. It is an impression that is consistent with his self-serving confessions of uneasiness, discomfort, confusion, cowardice, fright, tongue-tied wonderment and the like. What manner of man (let alone FBI Director) is this?
Comey has met with his friend Robert Mueller, the special counsel appointed to supervise the investigation into Russia-related matters and whatever else strikes his fancy. Comey is Mueller’s old colleague and friend. We learned yesterday that once he was fired by President Trump Comey himself sought to engineer the appointment of a special counsel. Mission accomplished. [snip]
Comey testified that he read the memo to Richman for the purpose of having Richman transmit the contents to “a reporter” (presumably a Timesman).
Why use a cutout? Comey testified: “Because I was weary [of] the media [that] was camping at the end of my driveway at that point. I was actually going out of town with my wife to hide. I worried it would be feeding seagulls at the beach, if it was I who gave it to the media.”
Here the clock strikes thirteen. This is ridiculous. [snip]
What is Comey talking about? And by the way, what other seagulls has he fed? As I say, this guy is a master operator. He is a master operator who can dish out a patently absurd story with a perfectly straight face.
Today fired former FBI Director James Comey stated that he leaked data to a Columbia University friend who in turn provided the leaked information to the New York Times. Comey did this even though he stated under oath in the past that he never leaked information to the press.
The current updated analysis of the most recent list of so-called ‘leaks’ being reported and repeated by the liberal mainstream media (MSM) involving President Trump includes at least 38 leaks in total.

One of the most interesting new disclosures today in the Comey hearing was the admission by former FBI Director James Comey that he intentionally used a “friend” on the Columbia law faculty to leak his memos to the media. Comey says that he did so to force the appointment of a Special Counsel. However, those memos could be viewed as a government record and potential evidence in a criminal investigation. [snip]
The problem is that Comey’s description of his use of an FBI computer to create memoranda to file suggests that these are arguably government documents. Comey admitted that he thought he raised the issue with his staff and recognized that they might be needed by the Department or Congress. They read like a type of field 302 form, which are core investigatory documents.
The admission of leaking the memos is problematic given the overall controversy involving leakers undermining the Administration. Indeed, it creates a curious scene of a former director leaking material against the President after the President repeatedly asked him to crack down on leakers.
Besides being subject to Nondisclosure Agreements, Comey falls under federal laws governing the disclosure of classified and nonclassified information. Assuming that the memos were not classified (though it seems odd that it would not be classified even on the confidential level), there is 18 U.S.C. § 641 which makes it a crime to steal, sell, or convey “any record, voucher, money, or thing of value of the United States or of any department or agency thereof.”
There are also ethical and departmental rules against the use of material to damage a former represented person or individual or firm related to prior representation. [snip]
Moreover, if Comey was sure of his right to release the memo, why use a law professor to avoid fingerprints?
I find Comey’s admission to be deeply troubling from a professional and ethical standpoint. Would Director Comey have approved such a rule for FBI agents? Thus, an agent can prepare a memo during office hours on an FBI computer about a meeting related to his service . . . but leak that memo to the media. [snip]
Comey’s statement of a good motivation does not negate the concerns over his chosen means of a leak. Moreover, the timing of the leak most clearly benefited Comey not the cause of a Special Counsel.

Asked about the Montana special election, Rep Jim Clyburn (D-S.C.), the DCCC’s 2016 national mobilization chair, told HuffPost last month he “didn’t know about that.” But as the race heated up, the party began spending more money, tripling its initial investment to $600,000 earlier this month.
“It seems clear that Gianforte’s massive edge in early funding allowed him to attack Quist’s character viciously before there were sufficient funds for Quist to respond to the vitriol,” Jeff Hauser, a longtime Democratic operative and director of the Revolving Door Project, told HuffPost. “If Quist should lose, the national Democrats who provided financial assistance after mail-in voting had already begun will have to question anew their initial reluctance to engage in the race in March and early April.”

The new chair of the Democratic National Committee recently began cursing — “Republicans don’t give a shit about people” — as a way to fire up the base in his attempt to unify the party against President Trump. But in the three months since the Democratic party elected Perez as DNC chair over Minnesota Rep. Keith Ellison, Perez has struggled to bridge the gap between the establishment and progressive wings of the party.
Perez and the DNC have been especially unsuccessful in convincing their supporters to give the kind of money the RNC has brought in every month. The DNC brought in just $4.7 million in April — less than half of the RNC’s $9.6 million haul over that same time, according to FEC filings submitted by the parties this week. The RNC finished the month with $41.4 million cash on hand, dwarfing the DNC’s $8.8 million in cash on hand.
RNC chairwoman Ronna McDaniel took a victory lap after the numbers showed the RNC again dominating the DNC in the fundraising game. “These numbers are evidence of the overwhelming enthusiasm for President Trump and the tireless work by Republicans everywhere to ensure we work together to build on our majorities and elect Republicans up and down the ballot headed into 2017, 2018, and beyond,” McDaniel said.
Perez, an establishment figure on the left, has been unsuccessful in winning over the party’s left-wing, where many leaders believe the party has drifted too far right.
Throughout his speech at a Democratic convention in California over the weekend, Perez was heckled and interrupted by supporters of Vermont Sen. Bernie Sanders.
One of the groups leading the resistance to Perez was the California Nurses Association, which packed the convention hall decked out in red clothing. The group’s leader, RoseAnn DeMoro criticized the Democratic party for being out of touch with its base.
“They are a party in absolute crisis and denial,” DeMoro told the Sacramento Bee. “They are too comfortable.”
“We are booing because we feel Perez is part of the establishment that keeps co-opting the progressive movement,” protester Gilbert Feliciano told the San Diego Tribune. “The corporatists have an ally with Tom Perez. We felt like it was important to come and voice our discontent.”
The heckling got so bad during Sacramento Mayor Darrell Steinberg’s attempt to speak that the head of the California Democratic Party seized the microphone and told protesters to “shut the fuck up or go outside.” [snip]

“My worry is, is that a week from now we get a bill dropped on the Senate that nobody’s really talked about because the focus has been elsewhere.
“We’re going to have to shift some of this back to domestic policy, because that agenda, I don’t think has stopped while this story has moved very quickly in the last few days.”
At a news conference two days ago (Tuesday), Senate Majority Leader Mitch McConnell (R-Ky.) said Republican senators have been having “extensive discussions about the way forward on health care.”
“We’ll be doing that Tuesday, Wednesday, Thursday — trying to come together behind a proposal to repeal and replace Obamacare.”
And as Senate Republicans work on health care, House Republicans are moving forward on tax reform.

Nearly two-thirds of Americans say the mainstream press is full of fake news, a sentiment that is held by a majority of voters across the ideological spectrum.

Israeli Prime Minister Benjamin Netanyahu took a subtle yet significant swipe at Barack Obama’s foreign policy legacy without even mentioning the name of that former president.
“I want to tell you,” Netanyahu said to President Trump during a joint press conference Monday, “how much we appreciate the reassertion of American leadership in the Middle East.” Veiled as a compliment to Trump, the implication was a clear swat against Obama. [snip]
With his praise of the current president, Netanyahu expressed his opinion in the relative goodness of Trump and awfulness of Obama.
Where Obama tried negotiating with Iran, Trump has rattled his saber. And while Obama gave the Jewish state a cold shoulder, Trump has promised closer cooperation to avoid nuclear proliferation in the region.
“The United States and Israel can declare with one voice,” Trump said Monday, “that Iran must never be allowed to possess a nuclear weapon, never ever, and must cease its deadly funding, training and equipping of terrorists and militias, and it must cease immediately.”
That’s notably different in tone and substance from Obama’s marquee foreign policy achievement. The Iran nuclear agreement, which the former president negotiated in 2015, keeps Iran from getting a nuclear weapon in the short run in exchange for more than $100 billion in sanctions relief from the U.S.
As both Netanyahu and Trump have criticized, that agreement does not prohibit Iran from enriching uranium and only lasts for about a decade.

And that will help reconciliation between Israel and the Palestinians. Of course not all, that I will like to discuss before the cameras, but I do look forward to our discussions which are pregnant with possibilities.
President Trump: You know with Iran, Iran should be very grateful to the United States because Iran negotiated a fantastic deal with the previous administration. A deal that is unbelievable from any standpoint. Some people don’t understand even how it could be even thought of. And instead of being thankful and saying “thank you”, because they were in serious trouble.
I think they would have failed, totally failed within six months. We gave them a life-line. And we not only gave them a life-line, we gave them wealth and prosperity. And we also gave them an ability to continue with terror, and with all of the things they’ve been doing.
Because, no matter where we go we see the signs of Iran in the middle east. No matter where we go. Whether it’s Syria where we were really forced to shoot the 59 missiles a few weeks ago. No matter what area we’re in we see… Yemen, Iraq, no matter where we are, we see the signs, every sign, whether it’s soldiers, whether it’s money and guns, it’s Iran.
And, instead of saying “thank you” to the United States, they now feel emboldened. Maybe they figure ‘the deal was so good we can do it every time’. They can’t do it, believe me. But it was a terrible, a terrible thing for the United States to enter that deal. And, believe me, Iran will never have a nuclear weapon.
JERUSALEM — U.S. President Donald Trump assailed Iranian aggression and military ambitions Monday on his first visit to Israel as the American leader, drawing quick approval from Israeli Prime Minister Benjamin Netanyahu.
Trump attacked the administration of former U.S. President Barack Obama for agreeing to the 2015 international deal restraining Iran’s nuclear weapons program in exchange for lifting economic sanctions against Tehran, a pact the Jewish state adamantly, but unsuccessfully, opposed.
“I want you to know how much we appreciate the change in American policy on Iran,” Netanyahu told Trump at the end of a day of meetings and ceremony. “I want want to tell you also how much we appreciate the reassertion of American leadership in the Middle East.”
Trump attacked Iran throughout the day, saying, “Instead of being thankful, saying thank you” for the nuclear deal, Iranians “now feel emboldened,” with signs of Tehran’s fighters, money and weapons in Yemen, Iraq and Syria. “We not only gave them a lifeline, we gave them wealth and prosperity. It was a terrible thing for the United States to enter into that deal.”

Body language and rhetoric dramatically changed with new president in the White House
President Donald Trump’s warm reception in Israel this week cast a sharp contrast with the often visibly icy state of U.S.-Israeli relations under the previous administration.
Gone was the often stiff and hostile body language on display when former President Barack Obama and Prime Minister Netanyahu met, replaced with frequent smiles and laughter.
“Just look at the footage you just showed. Look at the body language, look at the smiles,” said White House advisor Dr. Sebastian Gorka on Fox News Tuesday. “It’s so very different. How much different after eight years of Israel being shunned by the last administration?” he said.
“The smiles tell you everything,” Gorka said. “Our closest ally is now being treated as our closest ally in the Middle East,” he said.
U.S.-Israeli relations deteriorated significantly under the previous administration. Obama and his administration often criticized Israel over the issue of settlements, and his pursuit of a nuclear deal with Iran infuriated Israeli leaders.
The tension over U.S. rhetoric and policies often became personal.
“I have no doubt we’ll get along very well,” Netanyahu predicted following Barack Obama’s election in 2008. But by 2015, the Huffington Post was dissecting “The Worst Relationship Between A U.S. President And An Israeli Prime Minister Ever.”
In March 2010, a meeting between the two world leaders in the White House was widely reported to be disastrous.
“One Israeli newspaper called the meeting ‘a hazing in stages,’ poisoned by such mistrust that the Israeli delegation eventually left rather than risk being eavesdropped on a White House telephone line,” reported the New York Post.
“Another said that the Prime Minister had received ‘the treatment reserved for the President of Equatorial Guinea,’” the Post reported.
“The Prime Minister leaves America disgraced, isolated, and altogether weaker than when he came,” the Israeli daily newspaper Haaretz said.
Obama — whose very first trip outside North America as President included a jaunt to Muslim countries in the Middle East — would not visit Israel until his second term in office.
JERUSALEM (Reuters) – U.S. President Donald Trump said on Monday that shared concern about Iran was driving Israel and many Arab states closer and demanded that Tehran immediately cease military and financial backing of “terrorists and militias”.

Trump will have visited significant centers of Islam, Judaism and Christianity by the end of his trip, a point that his aides say bolsters his argument that the fight against Islamist militancy is a battle between “good and evil”.
