We took a break today from listening to the Rolling Stones, to check out the two big ObamaCare cases up for a hearing. In the case before the Supreme Court, the Hobby Lobby contraception mandate case which the government will likely lose, we spotted something that no one else is mentioning Here’s the spring sprig which caught our attention:

“As Verrilli’s situation worsened, Justice Kennedy moved in to wonder why it was that Congress would allow a government agency — the Health and Human Services Department — “the power to decide a First Amendment issue of this consequence…. That is for Congress, not for an agency.” Kennedy would repeat that criticism later in the argument.”

It seems to us that Justice Kennedy was telegraphing something to the much more substantial case – the ObamaCare-killer hearing – in the circuit court which was also heard today:

“As has been recounted in this space before, the plain text PPACA authorizes tax credits and cost-sharing subsidies for the purchase of qualifying health insurance plans purchased in health insurance exchanges “established by the State under section 1311” of the Act. PPACA supporters believed every state would create its own exchange. They were mistaken, however, and over thirty states have refused. In response, the IRS promulgated a regulation authorizing tax credits and subsidies in all exchanges, whether or not they were “established by the State under 1311.Halbig is one of four pending challenges to this regulation.

On January 15, Judge Paul Friedman of the U.S. District Court for the District of Columba upheld the IRS rule. According to Judge Friedman’s opinion, an exchange may provide tax credits and cost-sharing subsidies even if it was neither “established by a State” nor “established . . . under section 1311.” As should be clear, I take a different view. Indeed, my work (with Michael Cannon) has been credited with inspiring this litigation and I co-authored an amicus brief in Halbig expanding on our research (see also here).”

It appears to us that Justice Kennedy in questioning whether a mere agency, not the Congress, had the authority to decide an issue of such consequence (namely a First Amendment religious freedom issue) in the Hobby Lobby case might be sending a strong signal to the Halbig litigants and justices that he is not kindly disposed to agencies, not the Congress, making consequential law. Perhaps Justice Kennedy believes that the legislature legislates?

Did we detect from Justice Kennedy something no one else saw? Or did the Rolling Stones put us in such a good mood we are deceived?

Yup, we are in a good mood. Those of us in winter quarters for these past six years see the jonquils of hope bursting out through the hard ground. Finding good news is as hard as spotting red roses blooming in the snow during these lean Obama years. But we’re optimists and we’re always on the lookout for pink petals floating from the sky.

One of the groups subject to boycott pressure is the Rolling Stones.

In a blow to the boycott movement, Rolling Stones confirm June 4 Israel show:

The Rolling Stones confirmed Tuesday that they will perform in Tel Aviv on June 4 as part of their “14 On Fire” world tour.

“It’s the first time in 35 years that I have no words to describe the enormity of this event,” said producer Shuki Weiss, who has been trying to get the renowned band to Israel for much of his career.

The concert had been rumored for months, but organizers were only able to announce the official confirmation at a press conference in Tel Aviv on Tuesday.

This is a historic moment,” said Weiss, who has produced many of Israel’s largest concerts. “It’s a huge honor to bring the Rolling Stones to Israel, an honor for the country, the citizens, and mostly for the fans who have waited for this moment.”

Israel continues to be under attack by the forces of “divestment” especially at American colleges and universities. If you’re a White House reporter, who is Jewish, traveling with Israel hating bow-to-Saudi-despots Barack Obama you’re out of luck in getting your travel papers to enter Saudi Arabia. Obama will no doubt denouce Israel and bow again to Saudi creeps instead of standing up for American values. Well, anyway, at least the British boys called the Rolling Stones stand up for American values.

Our regular readers know we have been strongly warning that Hillary Clinton 2016 better run away from Obama and ObamaCare. We believe Hillary Clinton and Bill Clinton are already doing that, albeit at a snail’s pace.

Yesterday, Bill Clinton continued to put pedal to the metal and increased the distance from Obama:

Clinton asked Wales on stage if he is concerned that this decision will negatively impact Internet freedom. In response, Wales said “yes, I’m very worried about it.

What else will Obama give away that weakens America? Obama’s already given away nuclear reductions unilaterally. Obama proved to be very “flexible” after the elections and given Crimea to Russia because of inaction. Missile deployment? Check. Iran nuclear weapons to threaten Israel? Check. What’s left? Even Michelle is in China!

Palin could have said a lot of avoid the topic entirely non-sequiturs Instead Sarah Palin smelled the pink roses. That’s the right thing to do in Spring.

  1. Admin. You are right about Kennedy. That is exactly what he was telegraphing. And Scalia, Thomas, and Alito will be with him. That’s four votes–the same four who were ready to strike down Obamacare. We will need a fifth vote, and it remains to be seen who, if anyone, will provide it.

    I am glad Bill spoke out against Obama’s plan to transfer control of the internet to a world body. As I stated today on the prior thread, this precipitous move must be preempted. A court could issue a temporary restraining order to prevent Obama from carrying out Soros directive. But again five votes will be needed, and where we will get that fifth vote God only knows.

    When the case comes before the court, I know Roberts will slink down below his desk (the way Marshall used to do when he wanted to grab a few winks–don’t laugh I sat in the court room and saw him do that). And after the case has been heard, I think I know a root cellar he can hide in until the storm passes.

But the good news is, like big media, the country sees the little shill game they are playing, and realizes they are part of the problem, not the solution.

    “The Obama administration has decided to give extra time to Americans who say that they are unable to enroll in health plans through the federal insurance marketplace by the March 31 deadline.

    Federal officials confirmed Tuesday evening that all consumers who have begun to apply for coverage on, but who do not finish by Monday, will have until about mid-April to ask for an extension.

    Under the new rules, people will be able to qualify for an extension by checking a blue box on to indicate that they tried to enroll before the deadline. This method will rely on an honor system; the government will not try to determine whether the person is telling the truth.

    The rules, which will apply to the federal exchanges operating in three dozen states, will essentially create a large loophole even as White House officials have repeatedly said that the March 31 deadline was firm. The extra time will not technically alter the deadline but will create a broad new category of people eligible for what’s known as a special enrollment period.

    The change, which the administration is scheduled to announce Wednesday, is supported by consumer advocates who want as many people as possible to gain insurance under the 2010 Affordable Care Act. But it’s likely to be criticized by Republicans who oppose the law and have denounced the way the administration is implementing it.

    Administration officials said the accommodation is an attempt to prepare for a possible surge of people trying to sign up in the final days before the deadline. Such a flood could leave some people unable to get through the system.

    “We are . . . making sure that we will be ready to help consumers who may be in line by the deadline to complete enrollment — either online or over the phone,” said Julie Bataille, director of the office of communications for the Centers for Medicare and Medicaid Services, the agency overseeing the federal health-care exchange.

    The extra time will not be restricted, though, to people who wait until the last minute to try to sign up. Although no one will be asked why they need an extension, the idea is to help people whose applications have been held up because of the Web site’s technical problems, or who haven’t been able to get the system to calculate subsidies to help them pay for coverage.

    According to a Health and Human Services official, who spoke on the condition of anonymity about decisions that have not been made public, an exact time frame for this extension has not been set, and it will depend in part on how many people request it. Nor have officials decided precisely how long people will have to select a health plan after they get the extra time.

    Starting in about mid-April, people will no longer be able to get extensions through After that, consumers will be able to request one through one of the federally sponsored call centers nationwide. At that point, the grounds for an extension will become narrower, matching rules for special enrollment periods that have existed for the past few months. Those include people who have a new baby, are getting a divorce, lose a job with health insurance or had a technical problem signing up for coverage through

    Once the narrower rules take effect, people will still be trusted to tell the truth about why they need more time — a method known as “self-attestation.”

    The new rules are similar to steps being taken — or contemplated — by some of the 14 states that are running their own health-insurance exchanges.”

    “No, sir,” was Sebelius’ categorical answer when asked about both prospects by Representative Kevin Brady of Texas at a hearing of the House of Representatives Ways and Means Committee.”

    Another day, another lie by the most “transparent” adminstration since 2009.

  5. VotingHillary, they waited until after the Supreme Court hearing to announce this? When the court strikes down the mandate for Hobby Lobby et al one of the reasons will be a lack of compelling government interest in forcing these corporations to do as ObamaCare dictates. A key reason will be all these exemptions and delays which demonstrate the government itself does not consider any of these “deadlines” or conditions as serious “compelling interests”.

    Several justices, including pivotal swing vote Anthony Kennedy, hammered Solicitor General Donald Verrilli on whether the exemptions the administration has granted on contraceptive coverage undermine the requirement’s importance. Businesses were given until 2014 to provide contraception, churches are excused, religious nonprofits get an accommodation and grandfathered plans don’t have to cover it at all. All of those caveats — approved for political and policy reasons — hurt the administration’s case in front of the justices on Tuesday.

    Justice Antonin Scalia, who questioned the administration sharply, said the government can’t claim it is trying to put together a uniform system of coverage while granting a “lot of exemptions.”

    Verrilli defended the administration’s approach, arguing that accommodations were made in a way that would still ensure most women can get contraception, even if not right away.

    Kennedy didn’t seem to buy that.

    It must have been because the health care coverage was not that important,” he told Verrilli in reference to contraception coverage.

    One point that seemed to stick with Kennedy in particular was that the contraception coverage requirement came from the administration — not Congress. The health law required the Department of Health and Human Services to decide what benefits had to be in an approved health plan, and it worked with the Institute of Medicine to do so.

    Opponents of the contraception policy say the government’s case would have been stronger had Congress actually wrote the birth control coverage into law.

    What kind of constitutional structure do we have if the Congress can give an agency the power to grant or not grant a religious exemption based on what the agency determined?” he said. “When we have a First Amendment issue of this consequence, shouldn’t we indicate that it’s for the Congress, not the agency to determine that this corporation gets the exemption on that one.

    Did anyone really doubt that the final Obamacare enrollment deadline would slip, too?

    It’s not like the Obama administration is setting a new precedent with its latest move — giving customers more time to enroll after next Monday’s deadline if they’re already in line.

    In reality, the administration is just continuing a long pattern of delays. They’re all designed to show flexibility and help the law work better, but they also fuel a public perception that Obamacare deadlines never really mean anything.

    The administration already went through the same exercise in December, cutting people some slack if they were stuck in cyber-traffic by the deadline for Jan. 1 coverage. Then and now, administration officials argued that it’s only fair to give people extra time if they were held up by the volume of last-minute sign-ups.

    But the list of delays covers so much more. The administration has bent deadlines for the employer mandate (twice), put off the launch of the Spanish-language enrollment site, and even delayed the enrollment season for 2015 — pushing it off until after the November mid-term elections.

    Working backwards, here’s a brief history of some of the most prominent Obamacare delays:

    March 25: Final enrollment deadline extended. The March 31 deadline — the end of enrollment for 2014 — will be loosened for people with special sign-up circumstances.

    March 14: High risk pools extended. The special, temporary coverage for people with serious pre-existing conditions — which was only supposed to last until the health insurance exchanges were in place — was extended a third time for another month.

    Feb. 10: Employer mandate delayed. This time, businesses with between 50 and 100 workers were given until 2016 to offer coverage, and the mandate will be phased in for employers with more than 100 workers.

    Jan. 14: High risk pools extended. The high-risk insurance pools, which originally had been slated to close Jan. 1, had already been extended once.

    Dec. 24: Enrollment deadline extended. In a message on, customers were told they could get help finishing their Jan. 1 applications if they were already in line on Dec. 24.

    Dec 12: Enrollment deadline extended. Customers on the federal enrollment website were given nearly two more weeks to sign up for coverage effective Jan. 1.

    Nov. 27: SHOP delayed. Online enrollment for the federal health insurance exchanges for small businesses was delayed.

    Nov. 21: Open enrollment delayed for 2015. The administration pushed back next year’s enrollment season by a month.

    July 2: Employer mandate delayed. The administration declared that it wouldn’t enforce the fines in 2014 for businesses with more than 50 full-time workers who don’t offer health coverage. The fines were pushed back to 2015.

    Nov. 15, 2012: Exchange deadline delayed. The Department of Health and Human Services gave states an extra month to decide whether they would set up their own health insurance exchanges — a decision they announced just one day before the original deadline.

    As usual Politico’s reporting is not to be trusted. Politico spins this latest snarky delay in the best light possible for Obama. For instance there is no mention that this latest delay can be applied for by anyone not just those who really truly began the process of enrollment. Contra Politico, there is no need to be “in line”.

  11. TheRock, that’s a great way to deal with Putin isn’t it? First Obama compared Putin to a kid in the back of the classroom who slouches in his seat and makes rude noises. Now Obama denigrates Russia even though it was Putin that ate Obama’s lunch during the Syria red line fiasco.

    Obama calls Russia a regional power which it might have been, before Obama. Post Obama Russia has ships in Latin America, friends in Latin America too. Ditto the middle east, especially Syria and Iran. Europe is slowing becoming a Russian colonial outpost. But to Obama that is weakness. Which country, without casualties nor injuries, is in control of Crimea again?

    Obama sounds like a sociology teacher in a small college lecturing on the differences between “power” and “influence”. In sociology “influence” is the stronger because there is no need for coercion. In academia this might all make sense but in the real world of real politics these are differences without distinction. When Stalin asked “how many divisions does the Pope have?” he was making his values known. Putin shares this sense of coercive power with Stalin. Obama? He’s in the faculty lounge.

    Obama should acquaint himself with another Stalinism: “the goal of every struggle is victory.”

    Party over: US Secret Service agents sent home over drunken Netherlands incident

    Three agents from the US secret service responsible for protecting President Obama in Amsterdam this week have been sent home after a night of drinking. The incident happened just a day before the president’s arrival.

    One of the agents was found drunk and passed out in a hotel hallway by hotel staff on Sunday morning, according to the people familiar with the incident who spoke on condition of anonymity, reported the Washington Post. The hotel workers immediately alerted the US embassy in the Netherlands, which then informed senior agents on the presidential trip, including its director, Julia Pierson.

    The same source added that the other two agents were also involved in the incident who “didn’t intervene despite being in a position to assist the drunken agent or tamp down his behavior.”

    The agency “did send three employees home for disciplinary reasons,” confirmed Secret Service spokesman Ed Donovan, adding that they were put on administrative leave pending an investigation. However, he declined to comment further on the case.

    All three men are GS-13-level agents of the elite Secret Service’s Counter Assault Team, known as CAT, which is responsible for ‘the last line of defense’ for the president, according to Washington Post sources.

    One of those involved in a drunken incident was a ‘team leader’ on counter­assault, however, he “was not in a supervisory position in the agency,” added the source.

    The agents’ duty was to prepare for Obama’s arrival and ensure his safety, including during his attendance at the Nuclear Security Summit in The Hague, the Netherlands.

    They would have been called on Sunday for a briefing ahead of the president’s arrival in Monday for a week-long trip to Europe and Saudi Arabia. Their drinking on Saturday evening and Sunday morning violated the rule adopted in 2012 which forbids anyone on an official trip from drinking alcohol in the 10 hours leading up to the assignment.

  14. More troops being sent. So who the Hell is Kony?

    In an expanded attempt to continue the hunt for warlord Joseph Kony, President Obama has authorized the deployment of military aircraft and about 150 Special Operations forces to Uganda.

    According to the Washington Post, the administration notified Congress of the deployments as they began on Sunday, and the troop movement was later confirmed to Reuters by the Defense Department.

    The move marks the first time that US military aircraft have been assigned to Uganda in order to help search for Kony, who is wanted by the International Criminal Court for war crimes. Under Obama’s orders, at least four CV-22 Osprey aircraft are scheduled to arrive in the country by the middle of the week, alongside a contingent of 150 Air Force Special Operations troops, pilots, and maintenance forces.

    The Post reports that the new influx of troops will “provide information, advice and assistance” to the African Union forces searching for Kony and his Lord’s Resistance Army. The troops are “combat-equipped,” but are barred from fighting the LRA themselves except in self-defense situations. The aircraft, meanwhile, will be used to move troops from one location to another.

    Despite the increased US presence, the troop deployment comes at a time when Kony’s whereabouts are unknown, though he and approximately 250 troops are believed to be hiding somewhere in the jungles bordering the Central African Republic, South Sudan and Democratic Republic of Congo. Already, a 5,000-unit African Union force is searching for Kony, but the LRA’s attack presence has dwindled 75 percent since 2010, and the man has not been sighted recently.

  15. It’s comforting to know that Kennedy is concerned about government functioning within the constitutional framework established. In the case of the contraceptives covered within ACA, congress gave its responsibility and power to the executive branch. In many cases, Obama has usurped the power of the legislative branch, with no objection from Dem members of that branch. The Democrats, especially in the senate, should be held accountable for their willingness to let Obama rewrite laws with a stroke of his damn pen. ( I don’t know what the hell he needed the phone for – the one he mentioned in his lame speech – but, I would like to suggest a thing or two he might do with it).

    What the Dems and MSM have overlooked is the issue of “constitutional structure” to which Kennedy referred. Whether they or anyone else agrees with Hobby Lobby’s position should be irrelevant. The ultimate test should be the legality of their actions, and of the constitutionality of the laws under which they (and all of us) are required to function.

    As we know, Hobby Lobby insurance will purchase around 16 forms of contraceptives. It’s the so-called abortion pills the corporation has chosen not to purchase. Quite honestly, Hobby Lobby is a tad conservative for me, and I’ll admit that I don’t like shopping there because of the gospel music they pipe in, non-stop. I’m just not a fan of that genre, but I willingly concede that the company has made a significant contribution to this country in terms of jobs provided, capital generated, etc. Additionally, it doesn’t matter one damn bit whether I or anyone else agree with the company philosophy. Again, All that matters is whether or not it complies with laws that can pass the constitutionality test.

    The Democrats have stomped all over the constitution and trampled the rights of the people of this country. They need to be held accountable at midterms.

    Which allows the federal government to step into the shoes of private employers in providing health insurance making employees dependent on government. The goal here is to erase the free market, and substitute the tyranny of large players for government tyranny. Ultimately, it leads to a result where faceless bureaucrats, who have never laid eyes on the patient, make categorical decisions about who lives and who dies. The only way this can possibly be equitable is if the wealthy are forced to consume the same shit sandwich as the rest of us.

  20. Circuit Court Judge Calls Obamacare Stupid, Unmitigated Disaster

    The case of Halbig v. Sebelius was heard yesterday by a three judge panel of the DC Circuit Court. The issue in the case is whether the federal government can offer subsidies to individuals who purchase health insurance through the federal Obamacare exchange. The language of the law says the subsidies will only be available under exchanges set up by the states, so the Obama administration is clearly in violation.

    The Washington Times has a report on what happened at the hearing, and one of the judges didn’t seem to be buying the administration’s arguments. He called the law an “unmitigated disaster” and “stupid,” and wondered why the courts should save it.

    One judge called the Obamacare rollout an “unmitigated disaster” and said the administration is stretching to try to cover up for how poorly the law was written.

    “I know there’s an absurdity principle, but is there a stupidity principle?” said Judge A. Raymond Randolph. “If the law is just stupid, I don’t think it’s up to the court to save it.” […]

    If the court rules that residents are able to get tax credits only if they are part of state-run exchanges, many of the Americans who live in the 34 states where the federal government runs the exchange will be less likely to sign up. If they don’t sign up and choose to pay the tax penalty under the individual mandate, it could skew the economics underpinning the entire law.


    Jimmy Carter: Obama May Be Too Embarrassed to Champion Black Causes

    On Tuesday, former President Jimmy Carter commented on President Barack Obama’s seeming reluctance to champion black cause during a HuffPost Live interview:

    “Some women when they are elected become champions of human rights,” Carter said “I’ve seen other women who are elected who didn’t pay any attention to that particular thing because it was kind of an embarrassment to them to single out women since they were a woman, like I think it might be an embarrassment to President Obama to single out African-American people.”

    Jimmy is wrongo again. If you are black, Obama really really cares about you – as long as you are rich and can help him. If you are poor or middle class black and can only give Obama a vote, you get words and more words but no jobs and nothing that helps you better your economic condition. This holds true for all skin colors and ethnicities. If you are rich and help Obama advance himself Obama cares about you. If you are poor, you’re out of luck and of no interest to Obama other than as a political prop.

    Braley referred to the popular Republican Iowa Sen. Chuck Grassley as “a farmer from Iowa who never went to law school.”

    Why is this so awful? Let us count the ways. Iowa is a farm state, and it’s never a good idea to disparage one of the state’s chief occupations. Next, it’s particularly not a good idea to demean your state when you’re somewhere else: In this case, Braley was speaking in Texas. Next, Braley, a trial lawyer, was making his pitch to a room full of trial lawyers at a private fundraiser (which is why he didn’t think he was being recorded). Trial lawyers are perhaps the most unpopular constituency among Republican base voters—besides Obama administration officials. Since midterm elections are all about motivating your base, Braley has given his opponent a turnout gift. Next, look where Braley is standing: If you’re going to talk down to Iowa farmers, at least don’t do it next to a table of booze. It makes for amusing viewing and that reinforces the idea for voters that you’re not one of them.

    Expect the very popular Grassley to campaign everywhere against Braley even though Braley is running against someone else. A riled up Grassley going up and down the state of Iowa reminding farmers of the contempt Braley has for farmers and wants to keep Grassley from passing tort reform is the biggest unmentioned part of the Gaffe of the Year.

    MSNBC is in serious trouble

    This is the story of MSNBC in a nutshell: It rose to prominence on its criticism of George W. Bush, peaked during Barack Obama’s historic 2008 campaign, and, by criticizing Republicans and championing liberal causes, sustained its viewership in the years that followed.

    Until now.

    MSNBC suffered harder loses in 2013 — in terms of both viewership and revenue — than either of its competitors at Fox News and CNN, according to Nielsen data featured in a new Pew Research report. Prime-time viewership declined by a staggering 24 percent (nearly twice the loss sustained by CNN and four-times that sustained by Fox News). Daytime viewership fell by 15 percent, even as it rose at both of the other networks.

    On the revenue side, MSNBC was projected to decline by 2 percent, while both CNN and Fox News were projected to experience growth of 2 percent and 5 percent, respectively. MSNBC was expected to bring in $475 million in revenue: less than half what CNN will make and roughly one-quarter of what Fox News will make.

    Conventional wisdom has it that cable news doesn’t have much of a future: The audience is old and getting older, the television landscape is growing more and more fractured, appointment viewing is becoming a thing of the past, etc. Certainly, every cable news network lost viewers last year. But this version of events often ignores the incredible revenue gains made each year by Fox News (like a rocket) and CNN (far more gradual, but we’re still talking billions).

    MSNBC isn’t seeing that growth, and it’s not clear how it will. In a world where liberals wanted to be outraged by George Bush every night, or celebrate the rise of Barack Obama, MSNBC had a theory of the case. But now Obama’s presidency has turned into a slog, and MSNBC isn’t compelling. Prime time is just hours of what often seems like feigned outrage. And the daytime strategy — giving shows to kids in their 20s and 30s, in an apparent bid to reach the youths — is comically bad, and rendered absurd at every commercial break when the catheter ads come on.

    2016 will help MSNBC, as it will help all cable news networks, but that’s not a long-term business strategy. The network needs to figure out what it’s going to do in the off years. There are a few powerful brands that are worth maintaining — Rachel Maddow, Chris Matthews, Morning Joe — but the rest is in need of a restart.

In 2008, then First Lady Laura Bush implicitly criticized China by visiting a camp for Burmese refugees en route to Beijing. She then urged the Chinese government to sanction the Burmese generals for human rights violations.
    As the mother of two children, Mrs. Obama could have spoken out against forced abortion under the One Child Policy. As the mother of two daughters, she could have taken aim also against gendercide – the sex-selective abortion of baby girls. She could have given condolences to the grieving family of Ms. Cao Shunli, a respected human rights activist who died just a couple of weeks ago after having been denied medical treatment. As the wife of a Nobel Peace Prize winner, she could have visited Liu Xia, wife of jailed 2010 Nobel Peace Prize winner Liu Xiaobo.
    Liu Xia has been languishing under illegal house arrest since her husband Liu Xiaobo’s illegal arrest in 2009. She was recently hospitalized after suffering a heart attack, but then returned to house arrest. According to an Amnesty International report of March 25, 2014, Liu Xia has finally received medical evaluation. Doctors have warned that her condition will not improve unless her current living situation changes.
    It is disheartening to see Mrs. Obama leave China without conveying any message on behalf of women’s rights. Instead, Mrs. Obama has chosen to ignore the intense suffering of hundreds of millions of women who have been victims of forced abortion, involuntary sterilization, gendercide and sexual slavery; and she has chosen to ignore the plight of Liu Xia and the family of Cao Shunli. These choices seriously undermine any claim that she is a champion of women’s rights.

    WASHINGTON (AP) — A split federal appeals court on Tuesday grappled with an issue that is crucial to the success of President Barack Obama’s health care law, debating whether the government can subsidize premiums for people who buy insurance on exchanges run by Washington.

    In a blunt assessment of the health overhaul and challengers to the Affordable Care Act, Judge A. Raymond Randolph described the launch of the act as “an unmitigated disaster” while Judge Harry Edwards said opponents of the law are seeking “to destroy the individual mandate and gut the statute.” The mandate is the requirement that nearly everyone have health insurance.

    The third judge on the appeals court panel, Thomas Griffith, expressed skepticism over the administration’s argument that the subsidies are available regardless of whether people buy insurance on a state-run or federally facilitated exchange.

    The exchanges in the Obama administration’s signature domestic program are of critical importance because most states have been unable or unwilling to set up their own exchanges. As a result, the federal government has stepped in to take the lead in 36 states.

    In the case before the U.S. Court of Appeals for the District of Columbia Circuit, a group of small business owners says the law authorizes tax credits only for people who buy insurance on exchanges established by the states.

    The business owners are challenging an Internal Revenue Service regulation based on the act that says the tax credits are available to all qualifying individuals, regardless of whether they buy insurance at the state level or federally.

    The case revolves around four words in the law, which says the tax credits are available to people who enrolled through an exchange “established by the state.”

  30. UK professor refuses to put his name to ‘apocalyptic’ UN climate change survey that he claims is exaggerating the effects

    A climate scientist has accused the United Nations of being too alarmist over global warming – and demanded his name be removed from a crucial new report.

    Professor Richard Tol, an economist at the University of Sussex, said fellow UN academics were exaggerating climate change and comparing it to the ‘apocalypse’.

    His comments are a blow to the UN Intergovernmental Panel on Climate Change (IPCC), which on Monday will publish its first update in seven years on the impacts of climate change.

    Previous IPCC reports on climate impact have been plagued by errors that damaged the body’s credibility.

    Most famously, it said in 2007 that glaciers in the Himalayas could disappear by 2035, a claim it has since withdrawn.

    Scientists are meeting in Japan this week to agree the wording of the final document, which will be used to inform policy decisions of governments around the world.

    Leaked drafts of the report predict that by the end of the century man-made global warming will have done serious harm to the global economy, displaced hundreds of millions of people and created violent conflict. Chapters on flooding, water supply and agriculture estimate huge impacts.

    Prof Tol, the lead co-ordinating author of the report’s chapter on economics, was involved in drafting the summary for policymakers – the key document that goes to governments and scientists. But he has now asked for his name to be removed from the document.

    Negative views of President Obama have hit a new high, according to a poll.

    The AP-GfK poll shows 59 percent of Americans now disapprove of Obama — a point higher than the previous high set in December.

    Obama’s approval rating stands at 41 percent. That’s the second-lowest figure the poll has ever found.

    Part of Obama’s problems appear to be related to foreign policy: The poll shows Americans disapprove of his handling of the situation in Ukraine 57-40 and disapprove of how he handles relationships with other countries 58-40.

    In January, Americans were evenly split on Obama’s diplomacy skills.

    Bill McInturff, the founder of the Republican polling firm Public Opinion Strategies, offered me a succinct comment to explain how the midterm elections are shaping up:

    “ON THE RECORD: Thank you President Obama.”

    Going largely unmentioned in most analyses is the inability of the Obama administration to markedly improve the economy, which could end up playing a big role in the unraveling of the Democratic Party’s electoral fortunes, not only in 2014 but also in 2016. [snip]

    The worst period for Obama was from late October through early December, 2013, after the disastrous launch of the Affordable Care Act’s open enrollment period. On Dec. 3, Obama hit his nadir, with 39.8 percent approving and 55.9 percent disapproving of his job performance.

    Perhaps McInturff should also be thanking Kathleen Sebelius, Obama’s secretary of Health and Human Services, whose department oversaw the fiasco.

    The damage inflicted on the Democratic Party by the dysfunctional website and the reaction to it is hard to overestimate. A graph (Figure 2) of the generic House vote in a second RealClearPolitics chart shows a dramatic drop in Democratic support coinciding with the site malfunction. [snip]

    As the figure illustrates, the generic vote shifted from a 5.5 percentage point Democratic advantage on Oct. 15, 2013, to a 2.5 percentage point Republican advantage on Dec. 2.

    Some political scientists, with a longer-term perspective, argue that no matter how dire Democratic prospects are for the midterm elections, future trends may be more positive.

    Edward G. Carmines of Indiana University wrote me to make the case that in the 2016 presidential election, the changing demographic character of the electorate threatens Republicans: “Only if the Republicans lose in 2016 will they finally come to the realization of the painful changes they need to make if their party is to be regularly competitive in future presidential elections.”

    Stephen Ansolabehere, of the Harvard government department, argued in an email that there “is the long-run (structural) challenge facing the G.O.P. and there is the short-run, immediate opportunity.” The election this year is particularly problematic for Democrats because the senators up for election last faced the voters in 2008 when Democrats, with Obama at the top of the ticket for the first time, “won some seats that no one expected them to.”

    Ansolabehere is pessimistic about Democratic presidential prospects in 2016, noting that since the election of Harry Truman in 1948, no party has won the presidency three times in a row except the Republican Party of Ronald Reagan and George H. W. Bush. “It’s not impossible, but it is unlikely,” Ansolabehere says.

    Gary Jacobson of the University of California, San Diego, a specialist on Congress, predicts that the House will remain in Republican hands through the end of the decade because “the distribution of voters across districts strongly favors Republicans.”

    Alan Abramowitz, a political scientist at Emory University, suggests that the key turning point favoring Democrats may not come until 2020: “Republicans are not defying long range, adverse trends. They might even win the presidency in 2016 despite those trends if short-term forces favor them. But the longer-term outlook, meaning 2020 and beyond, is still pretty grim for them.”

    David Axelrod, a senior political strategist in both Obama presidential campaigns and, between campaigns, a senior adviser in the White House (he is now the director of the Institute of Politics at the University of Chicago), argues in an email that “there are structural elements that favor the Republicans this year. Gerrymandering of districts has given the Republicans a solid edge in the House, and there are seven Senate seats up this year that are currently held by Democrats in red states that Romney carried in 2012. All Democrats had a little more wind at their backs six years ago when they ran in a midterm election and Obama was at his zenith of popularity.”

    Sean Trende, a senior election analyst at RealClearPolitics, in some respects concurs: “What we’re really seeing this cycle is a function of the Democrats’ declining ability to win white voters, especially in the South and border states. The demographic changes that are working in Democrats’ favor elsewhere simply are not helping them in many of the most competitive states this cycle: South Dakota, West Virginia, Montana, Michigan, Louisiana, Arkansas, Alaska, New Hampshire and Iowa.”

    In addition, Trende argues, “whites might be a declining share of the electorate, but they’re still over 70 percent of the electorate, meaning that if Republicans make relatively small improvements in their vote share with whites, they will achieve stasis.”

    In fact, a relatively modest boost in white turnout, combined with a slight drop in Democratic margins among minorities when Obama no longer the tops the ticket, Trende writes, will lead to numbers “well within tolerance for a big Republican win.”

    These analyses do not address a separate issue: the failure of the Obama administration to propel strong economic growth.

    Democratic election victories in recent years have resulted more from hostility to the Republican Party than from support gained through positive economic achievements.

    The Obama years have been marked by a prolonged period of economic stagnation, a falling standard of living for those in the bottom half and a growing schism in the distribution of income between top and bottom.

    Median family income has declined and inequality has grown worse, even as Obama has called inequality “the defining challenge of our time.” The plight of the long-term unemployed is particularly vexing.

    Alan Krueger, the chairman of President Obama’s Council of Economic Advisers from November 2011 to August 2013, writing with two co-authors about unemployment earlier this month, found that “from 2008 to 2012, only 11 percent of those who were long-term unemployed in a given month returned to steady, full-time employment a year later.” This “unlucky subset of the unemployed,” Krueger writes, has become a peripheral constituency receding “into the margins of the labor market” or withdrawing “from the labor force altogether.”

    Separately, the center-left Urban Institute has concluded that this unemployed constituency represents what is likely to be a growing problem: a “mismatch” between current job requirements and workers’ obsolete skills. Stunningly, 62 percent of the long-term unemployed are 25 to 54 years old, according to the National Employment Law Project.

    Kathleen Geier, commenting on the Krueger paper in The Washington Monthly, declared: “it is the most thoroughly depressing policy document I’ve read in quite some time.”

    Can the Democratic Party do much – or anything of significance – to ameliorate economic conditions? Outsourcing, technological substitution for human workers (robotization), global wage competition and slow growth circumscribe the ability of the Obama White House to promote equality or to intervene in behalf of economic losers.

    Demographics look promising for the Democratic Party, but the people who make up those demographics seek economic change that the party shows no signs of delivering – and may not be able to deliver. The party has mastered the techniques of turning out its voters, at least in presidential election years, but it now faces the much more difficult task of improving the lives of its supporters.

    It’s not clear that the Democratic Party, as currently constituted, is prepared to take on that task. Has it even conceptualized, let alone implemented, adequate economic or political innovation? Nor is it clear whether the global and domestic forces now imposing such heavy costs on the poor and even the middle class lend themselves to government-directed amelioration.

    Edsall is a Democrat so this is quite a stunning indictment of the “coalition of the ascendant” strategy that led the party “leaders” to gift Obama the nomination. We never agreed with the inevitable demographic bright future of the party. We thought the road to prolonged and deserved victory at the polls required a competent president.

    Now more and more analysts are writing what we started writing back in 2007. Soon they will be writing what we have been hitting hard on: Hillary Clinton 2016 must run away from Barack Obama and all his Obaminations as fast and as soon as possible.

    For Democrats, politicians in handcuffs point to image problems

    Americans have low—exceedingly low—opinions about government. It’s supposed to stay out of their hair until needed, at which point it’s supposed to solve problems instantly. For the full range of American needs, government is supposed to provide only two things: competence and honor.

    For Democrats who have long championed government as a force for social good, competence is perhaps the biggest potential victim of the rocky rollout of the Obamacare insurance program.

    Millions of Americans will gain coverage under the plan—some enjoying insurance for the first time—but their voices have been drowned out by the months-long criticisms of websites that wouldn’t work, deadlines that had to be extended, exceptions that had to be made. (The most recent: Tuesday’s news that the supposedly firm March 31 sign-up deadline was actually a bit squishy, extended into April for people who have started the sign-up process by the end of this month.)

    The other component—honor—has come sharply into question this week, and not in a good way for the image of Democrats. Handcuffs are almost always a bad sign.

    On Wednesday, California state Sen. Leland Yee was arrested as part of a public corruption investigation, the FBI confirmed. No charges were detailed, and Yee was due in court later Wednesday. A Democrat from San Francisco, Yee has been seeking the job of secretary of state, the office that runs California’s elections.

    Yee is the third California Democrat caught in seemingly unrelated criminal scandals this brief year.

    Sen. Rod Wright of Inglewood was convicted in January of perjury and voter fraud stemming from charges that he had lied about his address on voter registration and candidacy papers. His attorney has said he will appeal, and a court date has been set for May 16. Weeks after that conviction, Sen. Ronald S. Calderon of Montebello pleaded not guilty after his indictment on charges of bribery and money laundering.

    In both his and Yee’s cases, the Capitol was treated to the specter of FBI agents wading through offices in search of evidence.

    At almost the same time that Yee was taken into custody, a Southern Democrat, Mayor Patrick Cannon of Charlotte, N.C., was arrested on a federal complaint that charged him with theft, bribery and extortion.

    According to U.S. Atty. Anne M. Tompkins, the complaint alleges that Cannon repeatedly took bribes from undercover FBI agents—the last time accepting $20,000 in cash in a meeting in the mayor’s office. Cannon’s arrest followed by days the resignation of Rhode Island House Speaker Gordon Fox after investigators involved in a secret inquiry searched through the Democrat’s home and office.

    None of these things had happened the last time the Pew Research organization studied trust in government, which is probably a good thing. Even then, last fall, only 19% of Americans said that they trusted government most or all of the time. That was down 7 points from January.

    The percentage who trusted government only sometimes, or never?

    Eighty percent.

  34. So good to see some good news. I cracked a crown and it is going to cost $600 (with insurance) to get it replaced. The dentist started lecturing me on wearing a night guard and I told him that I was already sleep deprived and stressed – that is why I cracked the crown, grinding my teeth. Just one more demand, one more tax, one more pay deduction or cut. I told him I just did not have any more. Of anything.

    We had a presentation on local 211 services the other day and I was overwhelmed just how bad the need is out there. The homeless, the suicidal.

    I live in Florida with a horrid Tea Party Governor who has cut environmental protections and health services to levels harmful to the public. You have NO idea how bad this is. I suspect the scum sucker wants people sick so they have to go to the privatized clinics run by him and his chronies.

    He is up for election in the fall. Charlie Crist is polling well against him, but the O touch of failure is hovering over him.

    We here is Florida have the distinction of leading the nation in Foreclosures. Just in our county alone, there are around 300 per week. The banks are collecting them all up. The housing market is insane and the prices are still too high for purchase by qualified home buyers. I wonder what will happen after the 2014 elections.

His primary duty is not to the American people. It is to himself and to his stature as a global icon. In the twilight of her career Peggy Lee gave us a depressing song Is That All There Is? In the case of Barack Hussein Obama, the answer is an unequivocal yes. The problem is he had a legion of unindicted co-conspirators who either aided and abetted him, or refused to speak out on behalf of millions of Americans. Tom Brokaw, Bill Moyers, George Step-and-Fetch It, Ly’n Brian Williams, their corporate executives and scores of Harvard trained jurists bureaucrats and information age opportunists like Fuckerburg and Schmitzie. And what is to be done about them? What indeed? Because they will be around long after Obama is history. Speaking of which, when he is gone, a full blown effort must be undertaken to debunk the image and refute the lies which his handlers will commit, in order to create a myth. He must be portrayed as a citizen of the world, who did not give a good goddamn for the country and its people he supposedly serves.

    UK professor refuses to put his name to ‘apocalyptic’ UN climate change survey that he claims is exaggerating the effects

    A climate scientist has accused the United Nations of being too alarmist over global warming – and demanded his name be removed from a crucial new report.

    Professor Richard Tol, an economist at the University of Sussex, said fellow UN academics were exaggerating climate change and comparing it to the ‘apocalypse’
    It would be . . . nice . . . if we could rely on the scientific community to proceed on the basis of pure science, skepticism, identification of assumptions, objective methodology and empirical analysis.

    Yes, that would be very nice.

    But that is not at all what it is. In the scientific community, as in most other walks of life, the question is not are you right, but who are you. Are you respected by your peers, and do you have a trove of meaningless awards to buttress that perception. And that is true, even if you have not made a scientific contribution for thirty years, and spend most of your time hob nobbing and playing king of the mountain in order to suppress new ideas by people who do not have your credentials.

    The bitter truth?

    The scientific community is global, political, and it has a star system that makes Sammy Goldwin, Louie B Mayer, and their Hollywood successors look like mere pikers.

The flaw which I see in the entire global warming position is it tends to proceed through inductive logic to a pre-determined political outcome (i.e. to redistribute the wealth of the American Middle Class, consistent with Soros observation that the latter consumes too much of the world resources to support their lifestyle):

    “Induction: In the process of induction, you begin with some data, and then determine what general conclusion(s) can logically be derived from those data. In other words, you determine what theory or theories could explain the data. While deduction gives absolute proof, it never makes contact with the real world, there is no place for observation or experimentation, no way to test the validity of the premises. And, while induction is driven by observation, it never approaches actual proof of a theory. The development of the scientific method involved a gradual synthesis of these two logical approaches.”

There is no lower scumbag in the universe than David Brock–a former Republican hit man against the Clintons, who came out of the closet, founded the deceitful Media Matters with the financial assistance of George Soros, and now is a Hillary ally, according to today’s New York Times. This is consistent with Soros’s involvement in the Hillary pact. Obviously, he sees her as a tool to continue his vile program of creative destruction of this nation. This will be brought out in spades in the general election–and if the Republican Party is smart enough and not too corrupt themselves, then it will be exploited to hell and back, and it will be no answer that the Koch Brothers are in pare delicto, because even if they were, which they are not, the argument lacks proportionality. Given a choice between running from Obamacare and running from Soros, I would counsel her to do both. But if the genie in the bottle gave me only one choice, I would say run from Soros, because that old Nazi is the destroyer of worlds. The effort would begin by telling Brock begone.

    When the Democratic Party lost the ability to rely on soft money (as a result of McCain Feingold) they panicked. Soros provided them with a solution. He invited big money donors to contribute to his network of left wing organizations rather than the Democratic National Committee. As a result, he siphoned off $300 million from the Party and privatized the party.

    As Don Iverson observed “Soros is the most powerful man in the democratic party today because he is able to make large donations to which ever candidate supports his views. This makes the future democratic nominee very beholden to him.”

    It is not just that we were right and they were wrong. Hell, that can happens to all of us. Rather, it is the fact that millions of Americans took no time to study Obama, and discover that he was incompetent, inexperienced and had an anti American globalist agenda dictated to him by the likes of George Soros. His primary duty is not to the American people. It is to himself and to his stature as a global icon.


    this will be the questions that historians 75 – 100 years from now will try to dissect. Understand the relevance of the conundrum – it happened twice in back-to-back presidents. What is it about so many members of our society that a foolhardy leadership is sought and then RETURNED to power? And this (for the last eight years anyway) in lieu of someone whose record and character scream competent leadership. The start of this century has been the worst consecutive 16 years (considering the overall picture of our place in the world, the state of the world in general, and our general domestic attitudes and standings, including our economic progress) since before the industrial revolution during the post civil war reconstruction.

    And its not getting better anytime soon. The Texas School Board just passed a resolution reducing the number of math credits needed to graduate high school. I myself am a happy practicing good little Catholic, and I find the efforts of the Kansas legislature to cast Creationism as a competing theory of the origin of the universe alongside Physics, Chemistry and Biology just preposterous. School shootings nationwide are becoming frighteningly normal as evidenced by the sheer number of them every year now. All this with the foundation of federal education policy rooted in the failure that is No Child Left Behind. This has spawned a generation of youngsters that find ‘The Knockout Game’ a good way to spend an afternoon after school. A generation that is swayed by celebrity rather than accomplishment.

    It seems that cure for this is going to hurt like hell because the cancer is so big and widespread. And as much as I love Hillary and really really really hope to see her in the White House, this cure will take a while to take. That is a daunting task that must be undertaken from the top and have the solutions work their way down.

    Hopefully, the healing will start when the millions do their homework and put the right person in that top spot in 2016.

    The Obama administration has just appointed a notorious entertainment industry lawyer to serve as the Solicitor General of the USA. Donald Verrilli Jr. is the industry lawyer who masterminded the case against Grokster, successfully arguing that online service providers should be held liable for the actions of their users and that online libraries containing millions of noninfringing works should be shut down if they also contain infringing works.
    Subsequently, he led Viacom vs. YouTube suit, in which he sought to extend the Grokster principle, holding YouTube liable for not reviewing the 29 hours’ worth of video they receive every minute to ensure they don’t infringe copyright.

    Viacom also sought to ban YouTube’s privacy features (which allow you to specify that certain videos can only be seen by friends and family) because the ability to restrict viewership of a video made it harder for them to detect infringement.

    Insurers feel that the administration has taken advantage of them by making repeated delays and changes to the law, even as they have gone above and beyond the call of duty to fix problems with the rollout.

    The administration is nursing grievances as well, feeling insurers don’t have the best interests of consumers at heart and should temper their criticism as they do more to make the law work.

    The tensions between insurers and the White House were described to The Hill by five healthcare lobbyists, both Republican and Democrat, who requested anonymity to speak freely.

    And, under a more realistic assessment, these two are bent bringing down the system, not for some abstract idea of social justice, which Bill O deludes about in an effort to give Obama his usual pass, thus guaranteeing future interviews, but for the sake of transforming not just the nation but the world, as his master Soros has decreed.

    The end result? Looting the public treasury, breaking their law, and violating their oath to the Constitution and the voters.

    And it is no solace that Holder’s Justice Department acted in some of these cases, because the pressure within the FBI compelled them to do so.

    Without that, Obama and his big media butt boys would have buried the story, like they always do.

Specifically conspiring with known organized crime lord Kwok Cheung “Shrimp Boy” Chow to illegally import firearms and sell them without a license . . .

    The affidavit charges that the $2 million worth of weapons to have been secreted into the country from the Philippines included rocket launchers and machine guns, some of which Yee himself had fired while on Mindanao. A portion of the weapons Yee conspired to bring into the U.S. through New Jersey were to have been forwarded on to North Africa via Sicily.

    At NRO’s Corner, Tim Cavanaugh adds, “California State Senator Leland Yee, a Democrat representing San Francisco, was arrested Wednesday by the Justice Department in an apparent sting that involves a famous Chinatown criminal, local media report“:

    Yee is the third Democrat in the California state senate facing criminal charges. The other two are in Los Angeles County. Rod Wright of Inglewood is taking a leave of absence after being convicted of perjury and voter fraud related to charges that he lied about his residence when running for office in 2008. Monetebello’s Ron Calderon is also on leave while fighting 24 felony counts related to bribery in exchange for steering legislation.

    The Democratic Party has 28 out of 40 seats in the state senate. Wright’s and Calderon’s absences have already left the Democrats without the two-thirds supermajority they often claim to need, presumably so they can stand up to Democratic Governor Jerry Brown, the Democratic-controlled State Assembly, and the Democrats who hold all statewide elected offices.

    Like the Truth About Guns Website, Rush Limbaugh is also having a schadenfreude overdose:

    Beyond Yee, as I said, today was quite a day for Democrats and the police blotter. Democrat Charlotte NC Mayor Patrick Cannon resigned today after less than six months in office, “just hours after he was arrested and accused of taking more than $48,000 in bribes from undercover FBI agents posing as businessmen who wanted to do work with North Carolina’s largest city,” the Blaze reports:

    Cannon submitted his resignation letter to city manager Ron Carlee and city attorney Bob Hagemann, Charlotte spokesman Keith Richardson said in an email. The 47-year-old Cannon is charged with bribery and public corruption. The Democrat took cash, airline tickets, a hotel room and the use of a luxury apartment as bribes and solicited more than $1 million more, according to a criminal complaint from the U.S. Attorney’s office.

    Cannon said in his resignation letter that the pending charges “will create too much of a distraction” for the business of the city to go forward. He said it was effective immediately.

    Keith Farnham, 66, a Democrat Illinois state rep, resigned today. In an article dated Monday, but updated to reflect Farnham’s resignation today, the Chicago Tribune reported:

    Reports that federal agents were looking for evidence of child pornography when they seized computers from the Elgin district office of former state Rep. Keith Farnham shocked local officials who said the lawmaker was well-liked and active in the community.

    “I couldn’t even fathom it. I was stunned,” said former Elgin Mayor Ed Schock, adding that Farnham always worked on the city’s behalf.

    Farnham has not been accused of any crime. Federal agents were searching for documents “pertaining to the possession, receipt or distribution of child pornography” as well as computer files, copies and negatives of child pornography or any documents that depicted minors “engaged in sexually explicit conduct,” according to a search warrant released Friday.

    And the hits just keep on coming.

    “Pa. State Sen. LeAnna Washington ordered to stand trial,” Philadelphia’s ABC affiliate reports today:

    Pennsylvania state prosecutors won a first step Wednesday in their corruption case against state Sen. Leanna Washington, securing a judge’s ruling that they have enough evidence for a trial on charges that Washington crossed the line when she allegedly ordered taxpayer-paid employees to organize an annual “birthday party” political fundraiser.

    For eight years, Washington pressured her Senate staff to devote weeks to drawing up guest lists that included city and state officials, creating invitations and taking money from invitees that ultimately went to Washington’s campaign account, prosecutors say.

    They also allegedly used taxpayer-paid computers, copiers and office supplies.

    District Judge John Kessler ruled that testimony from one of Washington’s former employees, Jamila Hall, was strong enough to allow the case to go to trial. In a grand jury presentment issued with the charges March 12, prosecutors listed seven current or former employees or interns, including Hall, who said they witnessed or carried out tasks to organize the fundraisers.

    Washington, 68, declined comment after the two-hour hearing at Kessler’s Montgomery County office. Washington, a Democrat who represents parts of Philadelphia and Montgomery County, is running for a third full term this year.

    Meanwhile, “Agents from the Federal Bureau of Investigation raided the Albany office of Assemblyman William Scarborough this morning, he confirmed to reporters,” Capital New York reported, also today:

    Scarborough, a Queens Democrat, said the F.B.I. asked questions about the per diem reimbursements that legislators collect for each day they spend in the Capitol. Agents took papers from his offices in Albany and Jamaica, and also accosted him in his hotel room this morning.

    ”I’m innocent, but I understand the reality,” Scarborough said to a group of reporters who, hearing rumors, flocked to his office on the sixth floor of the Legislative Office Building. “I don’t know what’s going to go on. I am going to talk to a lawyer, this is just stunning to me.”

    Scarborough received $59,085 in per diem payments between 2010 and 2011. He submitted voucher payments claiming $825 for five nights in Albany from March 13th to March 17th 2011, while public records showed he attended a town meeting at York College in Jamaica Queens that Thursday.

    “I may very well have gone to that meeting, turned around and gone back to Albany that night,” Scarborough told the New York Post in 2012. “If we arrive in Albany before midnight, we’re entitled to put in for the night.”

    The Assembly doesn’t require members to submit hotel receipts and Scarborough told the Post he would not look for them.

    “I don’t think I have to give you proof,” he said at the time.

    And, “Law enforcement officials raided the office and home of House Speaker Gordon Fox on Friday as part of a criminal investigation by the U.S. attorney’s office, FBI, IRS and state police,” AP reported:

    Officials would not say who or what was being investigated, but authorities worked for hours inside the Democratic House speaker’s Statehouse office while state troopers stood outside.

    Authorities entered the office carrying an evidence bag and empty cardboard boxes Friday morning. Fox’s spokesman, Larry Berman, said state police had asked everyone working in the office to leave but he didn’t know why.

    Yesterday, AP added that Nicholas Mattiello, a fellow Democrat, replaced Fox after he resigned, following the raid.

    Mattiello, a Democrat from Cranston, comfortably won the vote to succeed Gordon Fox, 61-6, with six abstentions and two absent. Oversight Committee Chairman Michael Marcello, D-Scituate, had challenged Mattiello for the top House spot but conceded earlier Tuesday, saying he didn’t have enough votes.

    The vote came during the first meeting of the House since the dramatic series of developments that began Friday morning when state and federal authorities, including the FBI, the IRS and the state police, searched Fox’s office and home and carried away boxes of material. Officials have declined to detail what the probe is about or say whether Fox is a target. Neither Fox nor his lawyer has commented on the investigation.

    “Today, Democrats Across The Country Have Won Some Pretty Heinous Headlines For Their Actions,” notes.

    “Unexpectedly,” as would say.

    Update: “I’ll just say this: Remember Jack Abramoff? Duke Cunningham? Babes in the woods.     Turkey blocks YouTube week after Twitter shutdown

    Turkish officials have expanded their attack on social media, moving from a blockage of Twitter to a shutdown of YouTube.

    The country’s telecom authority said Thursday it had taken an “administrative measure” against the Google-owned video site, but gave few specifics.

    The announcement followed a leaked recording on YouTube that appears to reveal top-level Turkish officials weighing reasons for a possible attack on Syrian militants. Prime Minister Recep Tayyip Erdogan denounced social media last week for spreading false information, particularly related to corruption allegations against him. The move comes just days before significant local elections.

    “We’re seeing reports that some users are not able to access YouTube in Turkey,” a Google spokesperson said. “There is no technical issue on our side and we’re looking into the situation.”

    Turkish residents decried the Twitter blockage, which prevented them from using the site in any way. A Turkish court overturned the ban on Wednesday, although it could stay in place until after Sunday’s elections. The Twitter crackdown came after similar information appeared on the site questioning the government’s credibility.

    Twitter on Wednesday announced the company had filed “petitions for lawsuits” that challenged aspects of the ban. The company will fight demands to remove an account that accused a former minister of corruption, Twitter general counsel Vijaya Gadde said in a blog post.

    “Political speech is among the most important speech,” Gadde said, “especially when it concerns possible government corruption. That’s why today we have petitioned the Turkish court on behalf of our users to reverse this order.”

    Even so, Twitter has agreed to use its “Country Withheld Content” tool on that account and for several other tweets involving the “safety of an individual.” This tool prevents tweets from appearing in a certain geographic area, even if it they are visible elsewhere in the world.

    Whereas infringement of press freedom in Turkey is a serious concern, with more journalists currently imprisoned in Turkey than in any other country;

    Whereas millions of people in Turkey, including senior members of the Government of Turkey, use Twitter and other social media sites to communicate on a daily basis;

    Whereas the Government of Turkey imposed a country-wide ban on access to Twitter on March 20, 2014, blocking the use of the communications platform to engage in political speech;

    Censorship of social media platforms must stop in Turkey, says OSCE media freedom representative

    Let us turn our attention to Matthew Yglesias, the Executive Editor of Ezra Klein’s new site. As my friend Pejman Yousefzadeh has well documented, Yglesias is just not that bright. He thinks Joe Lieberman is a dumb Jewish politician; was shocked to discover Senators represent the states as opposed to populations; was unaware of a black conservative tradition; couldn’t understand why Miami didn’t expand westward (hint: a giant swamp); had no idea an incumbent President had been defeated in primaries (Jimmy Carter lost 13 primaries in 1980 to Ted Kennedy and Jerry Brown); thought Bobby Jindal’s reputation for intelligence was just ethnic stereotyping; argued it was okay to lie about having kids; wanted to know why Egypt didn’t have a Parliamentary system as if it’d matter and, by the way, it already does have one; thinks there are too many banks; thinks no banks have been chartered in 2013 even though banks were chartered in 2013; and the list goes on.

    More importantly, Matthew Yglesias believes it is okay for liberals to lie in debates. He claimed “Fighting dishonesty with dishonesty is sometimes the right thing for advocates to do”. After all, according to Yglesias, Republicans are bad people; there are few if any conservatives he respects; and liberals aren’t condescending enough to conservatives who make stupid arguments no matter how smart they are.

    So it’s okay to lie.

    Which brings us to his video at the JuiceVox Media website. He tries to explain the National Debt and out of the gate beings with a lie. He claims the national debt is $5 trillion less than the U.S. Treasury says it is.

    Then he uses deficit and debt interchangeably.

    Then he claims the U.S. Government can never run out of money.

    He goes through all of this to conclude that the national debt, which he understated, is just not anything to worry about.

    This isn’t education. It is not explaining. It is left-wing propaganda. It is also sponsored by General Electric. Why is General Electric sponsoring left-wing propaganda?

    Perhaps they don’t know. After all, Yglesias himself says it is okay for the left to lie in order to win an argument.

    Obamacare Navigators Helping People Enroll At Mexican Consulates

    The Obama administration has been helping to facilitate a series of events nationwide at Mexican Consulate offices to enroll people in Obamacare – and a key activist says the efforts are “our responsibility” regardless of citizenship.

    “Whether they’re Mexican nationals or whether they’re United States citizens or whether they’re in transition– and if they’re there it is our responsibility within all of America to educate on the Affordable Care Act,” Enroll America Field Organizer Jose Medrano told Breitbart News on Wednesday.

    Health Care insurance navigator groups hosted an Obamacare enrollment fair on Tuesday in the Mexican Consulate’s Brownsville office, The Rio Grande Guardian reported last Friday, where Mexican nationals among others were counseled about enrolling in the ACA.

    “The Mexican consulate is a very reliable source of information to the Latino community. And therefore when they host their events, yesterday being the health fair, there are several hundred people that show up,” Medrano said.

    Under the Affordable Care Act (ACA), undocumented immigrants aren’t supposed to be receiving government-run health benefits or subsidized coverage. However, President Barack Obama told Latinos in early March that the website would not be used to find out about an individual’s immigration status.

    None of the information that is provided in order for you to obtain health insurance is in any way transferred to immigration services,” he said. [snip]

    This is not the first time the Mexican Consulate has been used to enroll individuals into Obamacare. Get Covered Illinois announced in late February that the Erie Family Health Center hoped to increase its enrollment numbers at the Mexican Consulate in Chicago, The Sun Times reported.

    According to Vegas Seven, in Nevada, the Latino community is being targeted for ACA enrollment at the Mexican Consulate in downtown Las Vegas. Insurance News says Hispanic National Advocacy groups like National Alliance for Hispanic Health have helped lead the push to get more Latinos enrolled in Obamacare.

    “Promoting Obamacare at a Mexican consulate raises three major policy concerns,” Stephen Miller, a spokesman for top immigration hawk Sen. Jeff Sessions (R-AL) told Breitbart News.

    “One, the possibility that illegal immigrants could fraudulently access federal subsidies; two, that such promotions provide a financial inducement to unlawfully enter the U.S. (or overstay a visa) by offering households headed by illegal immigrants federal subsidies through their legal relatives or dependents; and three, that these activities widen an existing flaw in our legal admissions process by continuing to subvert the principle that those seeking to lawfully enter the US should be financially self-sufficient,” Miller said.

    Mexican Consulates have been used previously to advance USDA assistance programs like food stamps to Mexican nationals, The Daily Caller reported in July of 2012. Mexico promoted the program to 50 of its consular offices in the U.S.

    Dozens of additional employees described as junior officers at those bases will be disciplined as well, the Associated Press reported first on Thursday afternoon, and will join an ever-expanding list of Air Force personnel who have been reprimanded in recent months as part of an embarrassing scandal that has increasingly generated criticism directed at the Pentagon’s nuke program.

    His Russian psyche guides him; his accurate assessment of NATO emboldens him.

    NATO has always been a sore spot for Russia: it is the one entity that has been able to keep together the formerly warring West European tribes for more than sixty years.

    They still see the North Atlantic Treaty Organization as its first secretary general did — a means of keeping “The Russians out, the Americans in, and the Germans down.”

    And since Germany was allowed into NATO in 1955, only the first two of its original three goals of NATO still remain.

    This means that if America is out, Russia is in. Or at least, that’s the hope of Moscow. NATO has to die if Russia is to take its rightful place as a major European power. And, furthermore, if without NATO, Berlin, Paris, and London resume their triangulating ways, imperial Russians believe that Moscow becomes Europe’s preeminent power. NATO is the immediate obstacle to the Russian Empire’s long-hoped for subjugation of Europe.

    Do not mistake that to mean Russia intends to conquer Europe militarily. Better than any other country, Russia understands the tyranny of distance, and knows that it can no more hope for a successful military conquest of the Continent than could Napoleon or Hitler hope to hold Moscow. Imperial Russia simply wants to call the shots, just as Putin told Medvedev what to do for four years.

Can anything he does be explained as an honest attempt to govern this country? And by anything I mean just that–does anything he does pass the red face test? I submit that the answer is an unequivocal know. I submit, further, that there has never been anyone in that office who is more of a fuck up, when it comes to the one thing that matters: governing in such a way as to promote the general welfare of the people of the United States. That is the only superlative he deserves, and it is not a felicitous one.

    Thank you freespirit. It is good to see that Brenda has re surfaced. She did some world class research on Obama and was the one who found the Dean Plan which was the Soros initiated plan to capture the democratic party by the hard core left. This eventuated in a book which was fairly good, but was not successful because the country at that time was still living in the world of delusion, whereas now only 55% are–the 55% who told pollsters recently that Obama is a strong leader. Yea, you got that right a strong leader.

    Mrs. Smith on this blog had a pipeline to Brenda, and I offered her my 50 page mangnum opus on Soros. She published the first chapter and then backed out. The proffered explanation was it was simultaneously published on Mrs. Smith’s blog–she being part of the Hillary wing of Democratic Underground, which as later expelled by the hard leftists bloggers employed by Soros. I think the real reason was she was focused on her book.

  90. Speaking of Progressives, this article from Think Progress defends Meechelle against complaints made by former W H speech writer. The Think Progress author tries to make the issue about gender equality. Perhaps, as the article states, there would have been fewer complaints about a male boss who demanded perfection, and whose self-described importance made it imperative that not one second of his valuable time be wasted . Or possibly, the employee recognized an over-inflated ego with an exaggerated sense of relevance and importance. Perhaps the employee had grown tired of FLOTUS’s entitled, less than gracious attitude.

    Sometimes an obnoxious boss is just an obnoxious boss. No need to try to classify honest complaints as sexist, racist, homophobic, climate-change doubter, etc.

    It’s clear from his conversations with staffers that Obama is a perfectionist who demands high performance from her staff. “Former staffers describe a high-stress, high-stakes workplace,” he writes, “in which Mrs. Obama scrutinized the smallest facets of her schedule.” She conveyed that her time wasn’t to be wasted. “Mrs. Obama made it clear to her staff that…her time was a valuable asset and requests to use it would have to meet an exceptionally high bar,” he says. One ex-aide said the message conveyed about events was, “Don’t do it if it’s not going to be perfect.”
    That certainly sounds stressful. One ex-aide told Cherlin that the situation “just made you super anxious.” But would the situation have been different if, say, they worked for the president? Or for a Senator? The nature of working in a high-stakes political environment is that you have to cope with a lot of intense demands.

    Some ‘well connected’ students are pushed thought the system and ‘gifted’ with a Ph.D. They are babied along, and often not pushed as hard if they are a minority, (only by certain professors).

    From the little scrubbed history this fraud still has, he was a lecturer. Ph.D. students can help teach a class and earn tuition fees paid and a little extra, while they are working on their Ph.D. (‘Helped teach a class’, meaning that the Professor of Record, has hired this student to teach her/his class and has already set up the class and it’s content.)

    Some Ph.D. graduates teach classes, but are not hired permanently by a university, they are also called lecturers at some schools.

    A Professor is someone that has a PH.D. and has worked their way up the chain, normally taking several years to become a full professor.

    From what I know, oBama was never a professor.

    It would be like calling someone that passed the Bar, a well established Judge.

    Speaking on Kosovo yesterday, Obama said : “…Kosovo only left Serbia after a referendum was organised not outside the boundaries of international law, but in careful cooperation with the United Nations and with Kosovo’s neighbours. None of that even came close to happening in Crimea.”

    But none of it came close to happening in Kosovo either, as Milos Subotic, the International Relations Officer of the University of Pristina, Kosovo told Breitbart London.

    The California Department of Motor Vehicles is setting up new facilities to process driver’s license applications for illegal immigrants.

    Last year, Gov. Jerry Brown signed into law a bill, AB 60, which will allow illegal immigrants to obtain the documents beginning Jan. 1, 2015.

    The bill was signed along with a number of others laws seen as favorable to undocumented immigrants.

    The AP-GFK poll released Friday showed little change from a January AP poll that found 27 percent of the public supported the law.

    Opposition to the law stands at 43 percent. Opposition peaked shortly after the law’s passage in 2010 at 50 percent.
    The AP poll finds that, while support for the law has diminished in the last few years, opposition hasn’t drastically increased. That is because a large section of the public, 30 percent, now say they neither support nor oppose the law. That number stood at 14 percent when the law was first signed.

    This is of course after intelligence chief Hakan Fidan suggested seizing the opportunity to secure Turkish intervention in the Syrian conflict – a war that has already claimed 140,000 lives, and counting. In the conversation, Davutoğlu is heard saying that Prime Minister Recep Tayyip Erdoğan sees any attack as an “opportunity” to increase troop presence in Syria, where it has staunchly supported the anti-Assad rebels.

  105. Jamilah Lemieux, senior editor at Ebony, launched a Twitter tirade against black conservatives, such as Ben Carson, and attacked Republican National Committee deputy press secretary Raffi Williams after incorrectly assuming he was white.

    She was set off by news that Carson and Armstrong Williams were going to start a magazine for black conservatives.

    Lemieux’s reaction sparked Williams to weigh in questioning why she was seemingly opposed to intellectual diversity.

    After her apology, she continued to denigrate conservatives, comparing them to cockroaches and calling Carson “insane.”

You can keep Crimea if you pull back from Ukraine and I will ask Mr. Soros to stop stirring up trouble in Crimea and thereby threatening world war III. Just give me a headline so I can take a few victory laps around the world, and I will be flexible.
