“If I was a betting man, I’d probably go the same way.  I think there’s still a decent chance that the court might uphold it, but a slightly better chance that the whole thing will get tossed, more out of convenience than anything else, but the mandate will still be the key.

Of course, if that happens, be prepared for a full-court meltdown among the Left, where the argument has already arisen that the Roberts Court is the Most Activististist Court Evah, with Jeffrey Toobin and (Politico’s) Roger Simon leading the way.  Gabriel Malor demolished this argument on Twitter yesterday, and he compiled his rebuttal into a blog post this morning:”

We’ll know soon enough if there is a lump coal in the stocking or a lump of gold from a melted golden calf.

It’s going to be an update kind of day. We do feel safe in making several predictions. We’ll make those predictions here and we will likely have several articles posted today.

Prediction: The next Supreme Court Justice will be Paul Clement. Clement is the unofficial Solicitor General for the political opposition. When Mitt Romney wins – the young, able, intelligent, hero of conservatives, will be on the Supreme Court where he has argued so many cases.

Prediction: It’s going to be a bad day for Barack Obama. The most he can hope for is that the hated Obama health care scam is upheld by the court. This will enrage opponents of “HellCare”. It will be Apocalyptic Panic At The Black Hole.

The real Game Changer, right Mark?



If the Supreme Court rules against key parts of HellCare then Katie, don’t bother locking the door because the gates of Hell will open against Barack Obama.

After the Supreme Court decision comes in the Eric Withholder contempt vote in the House of Representatives (more on that later) will erupt. It’s going to be a bad day at 1600 Pennsylvania Avenue. Michelle Obama will leave no sleeve behind.

Prediction: Big Media will erupt in defense of their Golden Calf. Already we hear “Our Supreme Court has lost its honor“. This isn’t really a prediction it’s standard operating procedure for Big Media.

Prediction: Logic tells us that the Supreme Court will strike down the Obama Health Scam root and branch. But anything is possible. We certainly would not listen to the idiocy from Laurence Tribe: I think my former student, John Roberts, will vote to uphold ObamaCare. Clearly Chief Justice John Roberts has not exactly been a protege of Tribe. So, ignore Tribe. Listen to the war drums coming from the Teepees of the opposition to Obama.

Prediction: We were right about Junemageddon. August will be worse.

    Apparently the WH has “prepared” 3 different speeches in response to the SCOTUS ruling. According to one blogger who says he has obtained copies of all 3 speeches the responses are:

    1. It’s Bush’s fault
    2. Those supreme court (unelected representatives) are all racists.
    3. You’re all gonna die now that this has failed!

  6. I am anxious to see how today works out. I would like to see the court keep the extension of coverage on the young people and people who have pre existing conditions. People really are worried about that. However, we need a better health care bill, and in my etimates that is not possible until we shore up the economy, and the country. Hope for the Best and Prepare for the Worst.

    Closed-minded dismissal of opposing views has gone from being a bad habit of conservatives to a core strategy of the Left.

    As we await the Supreme Court’s Obamacare ruling, liberal commentator after liberal commentator has declared that only a dishonest partisan or a complete fool could find the individual mandate unconstitutional.

    This is where the liberal elites have been headed for a couple of years, and not just on health care. In many cases, it’s simply a matter of the liberal bubble. For others, it’s a cynical way of moving the bounds of permissible dissent. This latter phenomenon I’ve given the florid name “Strategic Epistemic Closure.”

    The other side’s views need not be entertained, the argument goes, because the other side is not serious. And we know they are not serious because they are on the other side. Any reporter who gives as much weight to the Right’s argument as to the Left’s is guilty of false equivalence and “he-said-she-said” analysis.

    Paul Krugman, the acid-penned New York Times columnist, is the trendsetter when it comes to Strategic Epistemic Closure.

    “I don’t know of any economics or politics sites on that side that regularly provide analysis or information I need to take seriously,” Krugman writes, explaining why he reads no conservatives or free-marketers. “I know we’re supposed to pretend that both sides always have a point; but the truth is that most of the time they don’t.”

    Those conservatives they can’t dismiss as “ignorant yahoos” (Krugman’s term) they vilify as corporate shills. Yahoos and shills being the only two sources of conservative or free-market argumentation, they can all safely be ignored.

    This is related to what liberal blogger Ezra Klein recently described as “building a permission structure.” Klein wrote this week of how the Right built a “permission structure” allowing conservative judges to rule the individual mandate unconstitutional.

    Here’s the flip side of that story: liberal Strategic Epistemic Closure is all about dismantling any permission structure on the Right. For instance, get enough elites to dismiss an idea, and boom, it’s “discredited.” Get enough liberals to act shocked at a proposal, and you’ve made it “controversial.” Then pretend some objective standard has been met, and warn the media not to give credence to discredited or controversial ideas.

    Congress ability to tax and spend is unlimited but ability to regulate human behavior is limited.

Her opinion, for herself and Sotomayor, Breyer and Kagan, joins the key section of Roberts opinion on that point. She would go further and uphold the mandate under the Commerce Clause, which Roberts wouldn’t. Her opinion on Commerce does not control.

    SCOTUSblog: Apologies – you can’t refuse to pay the tax; typo. The only effect of not complying with the mandate is that you pay the tax.

    So Obama just raised taxes on everyone. He’s fucked.

This seems to me like the Supreme court was attempting, through CJ Roberts direction, to give a hollow victory to Obama, but in reality, jettison the true intent of the provisions of the healthscam bill.     Which is a huge campaign point for Mitt. Before SCOTUS ruling, even with a Repub. Senate, there wouldn’t be 60 R votes for cloture on Obamacare repeal or enough R votes to override an Obama veto. Now with an R President and simple majority, it’s gone or so that is how it appears.
